Procedures by which Permits for the Opening and Operation of Representative Offices of Foreign Institutions of Higher Education are Issued

Issued pursuant to Section 86, Paragraph four
of the Law on Higher Education Institutions

1. These Regulations prescribe the procedures by which the Ministry of Education and Science shall issue a permit for the opening and operation of a representative office of a foreign institution of higher education (hereinafter - a permit).

2. A permit shall be issued by the Ministry of Education and Science in accordance with the decision of the Licensing Commission of Higher Education Study Programmes (established and operating in accordance with regulatory enactments regarding the licensing of study programmes implemented in institutions of higher education).

3. In order to receive a permit, a foreign institution of higher education (hereinafter - an institution of higher education) shall submit to the Ministry of Education and Science an application. The application shall specify the following information:

3.1. the name, legal status and address of the institution of higher education;

3.2. concise substantiation of the necessity to open a representative office; and

3.3. the given name, surname and position of the person authorised by the institution of higher education to arrange the matters related to the opening of a representative office.

4. The following shall be appended to the application:

4.1. a document that certifies that the institution of higher education has been accredited in the foreign state (recognised by the state);

4.2. the decision of the institution of higher education regarding the opening of a representative office; and

4.3. draft articles of association (statutes) of the representative office.

5. The Ministry of Education and Science, within a period of one month after the date of receipt of the application, shall issue a permit or substantiated refusal.

6. The operation of the representative offices of foreign institutions of higher education shall be supervised by the Ministry of Education and Science.

7. The Ministry of Education and Science shall cancel the permit issued if violations of regulatory enactments regarding education have been established in the operation of the representative office of a foreign institution of higher education.
