Regulations Regarding the Conditions and Procedures for Applying for the Position of the Head of the Corruption Prevention and Combating Bureau by Applicants, and also the Procedures for Selecting and Evaluating the ApplicantsIssued pursuant to I. General Provisions1. This Regulation prescribes the conditions and procedures for applying for the position of the Head of the Corruption Prevention and Combating Bureau (hereinafter - the Bureau) by applicants (hereinafter - the applicant), and also the procedures for selecting and evaluating the applicants. 2. The Cabinet shall announce an open competition for the position of the Head of the Bureau (hereinafter - the competition) by determining the time period of 20 working days for the submission of the applications of applicants (Annex 1). After announcement of the competition, the State Chancellery shall inform the Public Consultative Council of the Corruption Prevention and Combating Bureau (hereinafter - the Public Consultative Council) regarding the time period within which representatives for the work in the Commission referred to in Section 4, Paragraph three of the Law on Corruption Prevention and Combating Bureau (hereinafter - the Commission) shall be delegated. 3. The competition shall take place in two rounds and include selection of the applicants in accordance with the mandatory requirements laid down in external laws and regulations, and also assessment of the qualification of the applicant and the experience and knowledge necessary for the position. The status of the information created or received during the activity of the Commission is specified in accordance with the procedures laid down in the Freedom of Information Law. [28 February 2017] II. Operation of the Commission5. The Commission shall take decisions at Commission meetings. The Commission meetings shall be convened and chaired by the Head of the Commission. The Commission meetings may take place in person or using video conferencing equipment. The Commission meetings are recorded in audio format, and also minutes are taken, and the minutes shall be signed by all members of the Commission. 6. The Commission shall take the decisions by the majority of votes. 7. If a member of the Commission refrains himself or herself from taking a decision in some issue, taking into account a conflict of interests or other considerations of ethical nature, it shall be regarded that the Commission is functioning in full composition. 8. Before commencement of the operation of the Commission the Head of the Commission shall ensure timely informing of the representatives delegated by the Public Consultative Council regarding the Commission meetings, indicating the time and place of occurrence thereof. 9. The Commission shall start the activity with an action planning meeting which is convened by the Head of the Commission not later than 10 working days after the Cabinet has announced the competition. During the action planning meeting: 9.1. the schedule of the working hours of the Commission shall be agreed upon; 9.2. [28 February 2017] 9.3. other issues related to the work organisation of the Commission shall be decided. [28 February 2017] 10. Authorised representatives of the Public Consultative Council shall participate in the Commission meetings (except for the meetings in which issues containing official secret are examined) in an advisory capacity. The opinion of the representatives of the Public Consultative Council shall be of recommendatory nature. [28 February 2017] 11. Each authorised representative of the Public Consultative Council shall attest that there are no such facts or circumstances due to which he or she would be interested in selection of any particular applicant, and also he or she shall undertake not to disclose restricted access information which has become known to the authorised representative during the course of the competition. [28 February 2017] 12. The Head of the Commission shall ensure publication of the information referred to in Sub-paragraph 9.1 of this Regulation on the website of the Cabinet (www.mk.gov.lv). 13. The material and technical facilities for the activity of the Commission shall be ensured by the State Chancellery. III. Announcement of the Competition and Requirements for Applicants14. On the basis of the Cabinet decision to announce the competition the State Chancellery shall ensure publication of the announcement in the official gazette Latvijas Vēstnesis and on the website of the Cabinet (www.mk.gov.lv). 15. In order to apply for the competition, the applicant shall submit the following documents to the State Chancellery: 15.1. an application letter for the participation in the competition (Annex 1), providing the motivation and expanded vision on the priorities of the activity, development of the Bureau and improvement of anti-corruption measures in Latvia (at least 350 words); 15.2. the description of curriculum vitae (CV) of the applicant in conformity with Europass CV standard which is available on the website www.europass.lv; 15.3. at least two references from previous working places (indicating the provider of the reference) at which he or she has worked during the last three years. If the applicant has worked only at one working place during the last three years, he or she shall submit one reference; 15.4. copies of the documents attesting his or her education; 15.5. a copy of the document attesting fluency in the official language if the Latvian language is not the native language and the person has not worked in the authorities referred to in Section 6, Paragraph one of the Official Language Law; 15.6. documents attesting the skills of at least two foreign languages (for example, a certificate, diploma, or degree which is issued by the institution implementing a licensed education programme) or copies thereof which attest that the language skills of the applicant have been assessed at least on level B according to the European language passport assessment table; 15.7. the questionnaire sheet completed by the applicant himself or herself in accordance with Annex 2 to Cabinet Regulation No. 21 of 6 January 2004, Regulations Regarding the Protection of Official Secrets, and Classified Information of the North Atlantic Treaty Organisation, the European Union and Foreign State Institutions. The applicant shall insert the questionnaire sheet completed by himself or herself and autobiography written by himself or herself in a separate closed envelope and submit it to the State Chancellery in person, indicating on the envelope "Aptaujas lapa" [Questionnaire Sheet]. In order to ensure verification of the compliance of the applicant, the Commission, where necessary, may ask the applicant to present originals of the documents and submit additional documents or information. [28 February 2017] IV. Course of the First Round of the Competition17. In order to verify the conformity of the applicants with the mandatory requirements laid down in Section 4, Paragraph five of the Law on Corruption Prevention and Combating Bureau, in the first round of the competition the Commission shall assess the documents submitted by the applicants and the opinion provided by the Constitution Protection Bureau on the conformity of the applicant with the requirements laid down in the law in order to obtain a special permit for access to official secret, and complete the assessment sheet of the first round (Annex 2). The Commission shall verify the information submitted by the applicants regarding the conformity with the mandatory requirements laid down in Section 4, Paragraph five of the Law on Corruption Prevention and Combating Bureau, where necessary, requesting additional information from the competent authorities. 18. If any doubts have arisen to the Commission, when assessing the documents submitted by the applicant or self-assessment of the language skills, on knowledge of foreign languages of the applicant, it may send the applicant to a foreign language knowledge examination to an educational institution or commercial company which ensures a licensed educational programme in the acquisition of foreign languages in the Republic of Latvia, specifying a time period within which the applicant shall submit a document attesting for his or her examination results of foreign language knowledge. 19. Applicants who fail to comply with the mandatory requirements laid down in Section 4, Paragraph five of the Law on Corruption Prevention and Combating Bureau are rejected. 20. If the Commission, when evaluating the compliance of the applicants in accordance with the procedures referred to in Paragraph 17 of this Regulation with the requirements laid down in Section 4, Paragraph five of the Law on Corruption Prevention and Combating Bureau, takes a decision to forward one or several applicants to the second round of the competition, the Head of the Competition Commission shall, within one working day, inform the Prime Minister and within five working days - each applicant, in writing thereof. [28 February 2017] 20.1 If, upon evaluating the compliance of the applicants with the requirements laid down in Section 4, Paragraph five of the Law on Corruption Prevention and Combating Bureau in accordance with the procedures referred to in Paragraph 17 of this Regulation, the Commission takes a decision to reject all applicants: 20.1 1. it shall decide to terminate the competition; 20.1 2. the Head of the Commission recommends the Cabinet to announce the competition repeatedly. [28 February 2017] 21. The Head of the Commission shall, within one working day, inform the Prime Minister and each applicant - within five working days, in writing regarding the decision of the Commission to refuse all applicants. When informing the Prime Minister and applicants regarding the decision taken, the Head of the Commission shall append an explanation on the reasons for each refusal in accordance with the requirements laid down in Section 4, Paragraph five of the Law on Corruption Prevention and Combating Bureau. [28 February 2017] V. Course of the Second Round of the Competition22. In order to thoroughly evaluate the qualification of the applicants forwarded to the second round, the experience and knowledge necessary for the position, the Commission shall: 22.1. carry out interviews with applicants; 22.2. ask applicants to provide verbally their vision on the priorities of the activity and development of the Bureau; 22.3. Assessment of each applicant in the second round of the competition shall take place according to the method and criteria referred to in Annex 3 to this Regulation. Each member of the Commission shall individually complete the assessment sheet of each applicant (Annex 3). 24. Compilation of individual assessments of members of the Commission and calculation of the joint assessment of each applicant shall be ensured by the Head of the Commission. Joint assessment shall be calculated by summing up the number of the points granted to the applicant by all members of the Commission and dividing it with the number of the members of the Commission who participated in the assessment. The result obtained shall be rounded up by indicating the value in decimal fractions after the point up to hundredths of the figure (for example, five point twenty five). 25. The Commission shall forward the applicant who has obtained the highest number of points in the total assessment for approval at the Cabinet meeting. If it is supported by the majority of members of the Commission, the Commission may take a decision to forward candidacies of two applicants who have obtained the highest number of points in the total assessment for approval at the Cabinet meeting. 26. After assessment of all applicants the Commission shall take one of the following decisions: 26.1. to submit a proposal to the Prime Minister on forwarding the candidacy(ies) of the applicant(s) for approval at the Cabinet meeting in accordance with Paragraph 25 of this Regulation; 26.2. to recommend the Cabinet to announce the competition repeatedly if all applicants are rejected. 27. The Head of the Commission shall, within one working day after taking of the Commission decision, inform the Prime Minister and within five working days - each applicant, in writing thereof.
