Par Eiropas Padomes 1949.gada 2.septembra Vispārējo līgumu par Eiropas Padomes privilēģijām un imunitātēm, tā protokolu un otro, ceturto, piekto un sesto protokolu

1.pants. Eiropas Padomes 1949.gada 2.septembra Vispārējais līgums par Eiropas Padomes privilēģijām un imunitātēm (turpmāk — Vispārējais līgums), tā protokols (turpmāk — Protokols) un otrais, ceturtais, piektais un sestais protokols ar šo likumu tiek pieņemti un apstiprināti.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Vispārējais līgums, tā Protokols un otrais, ceturtais, piektais un sestais protokols angļu valodā un to tulkojums latviešu valodā.

3.pants. Pilnvarot Latvijas Republikas ārkārtējo un pilnvaroto vēstnieku Eiropas padomē Andri Teikmani parakstīt Vispārējā līguma otro, ceturto, piekto un sesto protokolu bez atrunas par to ratifikāciju.

4.pants. Ārlietu ministrija sadarbībā ar Finansu ministriju nodrošina Vispārējā līgumā, tā Protokolā un otrajā, ceturtajā, piektajā un sestajā protokolā paredzēto saistību izpildi.

5.pants. Vispārējais līgums un tā Protokols stājas spēkā Protokola 7.pantā noteiktajā laikā un kārtībā, otrais protokols stājas spēkā tā 6.pantā noteiktajā laikā un kārtībā, ceturtais protokols stājas spēkā tā 10.pantā noteiktajā laikā un kārtībā, piektais protokols stājas spēkā tā 3.pantā noteiktajā laikā un kārtībā, sestais protokols stājas spēkā tā 8.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".

General Agreement on Privileges and Immunities of the Council of Europe

The Governments of the Kingdom of Belgium, the Kingdom of Denmark, the French Republic, the Kingdom of Greece, the Irish Republic, the Italian Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands, the Kingdom of Norway, the Kingdom of Sweden, the Turkish Republic and the United Kingdom of Great Britain and Northern Ireland;

Whereas under the provisions of Article 40, paragraph (a), of the Statute, the Council of Europe, representatives of Members and the Secretariat shall enjoy in the territories of its Members such privileges and immunities as are necessary for the exercise of their duties;

Whereas under the provisions of paragraph (b) of the above-mentioned Article, the Members of the Council have undertaken to enter into an agreement for the purpose of fulfilling the provisions of the said paragraph ;

Whereas in pursuance of the above-mentioned paragraph (b), the Committee of Ministers has recommended to Member Governments the acceptance of the following provisions;

Have agreed as follows:

PART I

PERSONALITY - CAPACITY

Article I

The Council of Europe shall possess juridical personality. It shall have the capacity to conclude con-tracts, to acquire and dispose of movable and immovable property and to institute legal pro

In these matters the Secretary-General shall act on behalf of the Council of Europe.

Article 2

The Secretary-General shall co-operate at all times with the competent authorities of the Members to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuse in connection with the privileges, immunities, exemptions and facilities enumerated in the present Agreement.

PART II

PROPERTY, FUNDS AND ASSETS

Article 3

The Council, its property and assets, wheresoever located and by whomsoever hold, shall enjoy immunity from every form of legal process except in so far as in any particular case, the Committee of Ministers has expressly authorized the waiver of this immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution or detention of property.

Article 4

The buildings and premises of the Council shall be inviolable. Its property and assets, wheresoever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation or any other form of interference whether by administrative, judicial or legislative action.

Article 5

The archives of the Council, and in general all documents belonging to it or held by it, shall, be inviolable wheresoever located.

Article 6

Without being restricted by financial controls, regulations or financial moratoria of any kind:

(a) the Council may hold currency of any kind and operate accounts in any currency ;

(b) the Council may freely transfer its funds from one country to another or within any country and convert any currency held by it into any other currency;

(c) In exercising its rights under sub-paragraphs (a) and (b) above, the Council of Europe shall pay due regard to any representations made by the Government of a Member and shall defer to such representations in so far as it considers this can be done without detriment to the interests of the Council.

Article 7

The Council, its assets, income and other property shall be exempt:

(a) from all direct taxes; the Council will not, however, claim exemption from rates, taxes or dues which are no more than charges for public utility services ;

(b) from all customs duties and prohibitions and restrictions on imports and exports in respect of articles required by the Council for its official use ; articles imported under such exemption will not be sold in the country into which they are imported, except under conditions approved by the Government of that country;

(c) from all customs duties, and prohibitions and restrictions on imports and exports in respect of its publications.

PART III

COMMUNICATIONS

Article 8

The Committee of Ministers and the Secretary-General shall enjoy in the territory of each Member, for their official communications, treatment at least as favourable as that accorded by that Member to the diplomatic missions of any other Government.

No censorship shall be applied to the official correspondence and other official communications of the Committee of Ministers and of the Secretariat.

PART IV

REPRESENTATIVES OF MEMBERS TO THE COMMITTEE OF MINISTERS

Article 9

Representatives at the Committee of Ministers shall, while exercising their functions and during their journeys to and from the place of meeting, enjoy the following privileges and immunities:

(a) Immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind.

(b) Inviolability for all papers and documents.

(c) The right to use codes and to receive papers or correspondence by courier or in sealed bags.

(d) Exemption in respect of themselves and their spouses from immigration restrictions or aliens registration in the State which they are visiting or through which they are passing in the exercise of their functions.

(e) The same facilities in respect of currency or exchange restrictions as are accorded to representatives of comparable rank of diplomatic missions.

(f) The same immunities and facilities in respect of their personal baggage as are accorded to members of comparable rank of diplomatic missions.

Article 10

In order to secure for the representatives at the Committee of Ministers complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Article 11

Privileges and immunities are accorded to the representatives of Members, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions in connection with the Committee of Ministers. Consequently, a Member not only has the right, but is under a duty to waive the immunity of its representative in any case where, in the opinion of the Member, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 12

(a) The provisions of Articles 9, 10 and 11 are not applicable in relation to the authorities of a State of which the person is a national or of which he is or has been a representative.

(b) In Articles 9, 10, 11 and 12 (a) above, the expression "representatives" shall be deemed to include all representatives, alternate representatives, advisers, technical experts and secretaries of delegations.

PART V

REPRESENTATIVES TO THE CONSULTATIVE ASSEMBLY

Article 13

No administrative or other restriction shall be imposed on the free movement to and from the place of meeting of Representatives to the Consultative Assembly and their substitutes.

Representatives and their substitutes shall, in the matter of customs and exchange control, be accorded:

(a) by their own Government, the same facilities as those accorded to senior officials travelling abroad on temporary official duty;

(b) by the Governments of other Members, the same facilities as those accorded to representatives of foreign Governments on temporary official duty.

Article 14

Representatives to the Consultative Assembly and their substitutes shall be immune from all official interrogation and from arrest and all legal proceedings in respect of words spoken or votes cast by them in the exercise of their functions.

Article 15

During the sessions of the Consultative Assembly, the Representatives to the Assembly and their substitutes, whether they be Members of Parliament or not, shall enjoy:

(a) on their national territory, the immunities accorded in those countries to Members of Parliament;

(b) on the territory of all other Member States, exemption from arrest and prosecution.

This immunity also applies when they are travelling to and from the place of meeting of the Consultative Assembly. It does not, however, apply when Representatives and their substitutes are found committing, attempting to commit, or just having committed an offence, nor in cases where the Assembly has waived the immunity.

PART VI

OFFICIALS OF THE COUNCIL

Article I6

In addition to the immunities and privileges specified in Article 18 below, the Secretary-General and Deputy Secretary-General shall be accorded in respect of themselves, their spouses and minor children the privileges and immunities, exemptions and facilities accorded to diplomatic envoys in accordance with International Law.

Article 17

The Secretary-General will specify the categories of officials to which the provisions of Article 18 below shall apply. He shall communicate them to the Governments of all Members. The names of the officials included in these categories shall from time to time be made known to the above mentioned Governments.

Article 18

Officials of the Council of Europe shall:

(a) be immune from legal process in respect of words spoken or written and all acts performed by them in their official capacity and within the limit of their authority;

(b) be exempt from taxation on the salaries and emoluments paid to them by the Council of Europe;

(c) be immune, together with their spouses and relatives dependent on them, from immigration restrictions and aliens' registration;

(d) be accorded the same privileges in respect of exchange facilities as are accorded to officials of comparable rank forming part of diplomatic missions to the Government concerned;

(e) be given, together with their spouses and relatives dependent on them, the same repatriation facilities in time of international crisis as diplomatic envoys;

(f) have the right to import free of duty their furniture and effects at the time of first taking up their post in the country in question, and to re-export the same free of duty to their country of domicile.

Article 19

Privileges and immunities are granted to officials in the interests of the Council of Europe and not for the personal benefit of the individuals themselves. The Secretary-General shall have the right and the duty to waive the immunity of any official in any case where, in his opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the Council of Europe. In the case of the Secretary-General and of the Deputy Secretary-General, the Committee of Ministers shall have the right to waive immunity.

PART VII

SUPPLEMENTARY AGREEMENTS

Article 20

The Council may conclude with any Member or Members supplementary agreements modifying the provisions of this General Agreement, so far as that Member or those Members are concerned.

PART VIII

DISPUTES

Article 21

Any dispute between the Council and private persons regarding supplies furnished, services rendered or immovable property purchased on behalf of the Council, shall be submitted to arbitration, as provided in an administrative order issued by the Secretary-General with the approval of the Committee of Ministers.

PART IX

FINAL PROVISIONS

Article 22

The present Agreement shall be ratified. Instruments of ratification shall be deposited with the Secretary-General. The Agreement shall come into force as soon as seven signatories have deposited their instruments of ratification.

Nevertheless, pending the entry into force of the Agreement in accordance with the provisions of the preceding paragraph, the signatories agree, in order to avoid any delay in the efficient working of the Council, to apply it provisionally from the date of signature, so far as it is possible to do so under their respective constitutional systems.

In witness whereof, the undersigned, being duly authorized thereto, have signed this Agreement.

Done at Paris, this 2nd day of September 1949, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary-General shall transmit certified copies to each member State of the Council of Europe.

Protocol to the General Agreement on Privileges and Immunities of the Council of Europe

The Governments signatory to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on the 2nd September 1949 (hereinafter referred to as the Agreement)

Desirous of extending the provisions of the Agreement,

Have agreed as follows:

Article 1

Any present or future Member of the Council of Europe not a signatory of the Agreement may accede to the latter and to this Protocol by depositing its instrument of accession to them both with the Secretary - General of the Council of Europe, who shall notify the Members of the Council thereof.

Article 2

a) The provisions of Part IV of the Agreement shall apply to representatives attending meetings of the Ministers' Deputies.

b) The provisions of Part IV of the Agreement shall apply to representatives other than Representatives to the Consultative Assembly attending meetings convened by the Council of Europe and held when neither the Committee of Ministers nor the Ministers' Deputies arc in session save that representatives attending such meetings shall not be exempt from arrest and prosecution when found committing, attempting to commit, or just having committed an offence.

Article 3

The provisions of Article 15 of the Agreement shall apply to Representatives to the Assembly, and their Substitutes, at any time when they are attending or travelling to and from, meetings of Committees and Sub-Committees of the Consultative Assembly, whether or not the Assembly is itself in session at such time.

Article 4

The permanent representatives of Members of the Council of Europe shall, while exercising their functions and during their journey to and from the place of meetings, enjoy the privileges, immunities and facilities normally enjoyed by diplomatic envoys of comparable rank.

Article 5

Privileges, immunities and facilities are accorded to the representatives of Members-not for the personal benefit of the individuals concerned, but in order to safeguard the independent exercise of their functions in connection with the Council of Europe. Consequently, a Member has not only the right but the duty to waive the immunity of its representative in any case where, in the opinion of the Member, the immunity would impede the course of justice and it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 6

The provisions of Article 4 are not applicable in relation to the authorities of the State of which the person is a national or of the Member of which he is or has been a representative.

Article 7

a) This Protocol shall be open to signature by all Members which have signed the Agreement. The Protocol shall be ratified at the same time as or after the ratification of the Agreement.

Instruments of ratification shall be deposited with the Secretary General of the Council of Europe.

b) This Protocol shall enter into force on the day when it shall have been ratified by all the signatories who at that date have ratified the Agreement, on condition that the number of signatories who have ratified the Agreement and the Protocol shall not be fewer than seven.

c) As regards any signatory ratifying subsequently, the Protocol shall enter into force at the date of the deposit of its instrument of ratification.

d) In the case of Members which have acceded to the Agreement and Protocol in accordance with the terms of Article 1 the Agreement and Protocol shall enter into force:

(i) On the date specified in paragraph (b) above in cases where the instrument of accession has been deposited prior to this date; or

(ii) On the date of deposit of the instrument of accession in cases where this instrument is deposited at a date subsequent to that specified in paragraph (b) above.

In witness hereof the undersigned, being duly authorised thereto, have signed the present Protocol.

Done at Strasbourg on the 6th day of November 1952, in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary - General shall transmit certified copies to each of the signatory and acceding Governments.

Second Protocol to the General Agreement on Privileges and Immunities of the Council of Europe

The Governments signatory hereto, being Members of the Council of Europe,

Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4th November, 1950, the members of the European Commission of Human Rights (hereinafter referred to as " the Commission are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder;

Considering that it is necessary to specify and define the said privileges and immunities in a Protocol to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2nd September, 1949,

Have agreed as follows

Article 1

The members of the Commission shall, while exercising their functions and during their journeys to and from their place of meeting, enjoy the following privileges and immunities :

(a) immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

(b) inviolability for all papers and documents;

(c) exemption in respect of themselves and their spouses from immigration restrictions or aliens registration in the State which they are visiting or through which they are passing in the exercise of their functions.

Article 2

1. No administrative or other restrictions shall be imposed on the free movement of members of the Commission to and from the place of meeting of the Commission.

2. Members of the Commission shall, in the matter of customs and exchange control, be accorded:

(a) by their own Government, the same facilities as those accorded to senior officials travelling abroad on temporary official duty;

(b) by the Governments of other Members, the same facilities as those accorded to representatives of foreign Governments on temporary official duty.

Article 3

In order to secure for the members of the Commission complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Article 4

Privileges and immunities are accorded to the members of the Commission, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions. The Commission alone shall be competent to waive the immunity of its members; it has not only the right, but is under a duty, to waive the immunity of one of its members in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 5

This Protocol shall be open to the signature of the Members of the Council of Europe who may become Parties to it either by :

(a) signature without reservation in respect of ratification or by

(b) signature with reservation in respect of ratification followed by ratification.

Instruments of ratification shall be deposited with the Secretary - General of the Council of Europe.

Article 6

1. This Protocol shall enter into force as soon as three Members of the Council of Europe shall, in accordance with Article 5, have signed it without reservation in respect of ratification or shall have ratified it.

2. As regards any Member subsequently signing it without reservation in respect of ratification, or ratifying it, this Protocol shall enter into force at the date of signature or deposit of the instrument of ratification.

Article 7

The Secretary-General of the Council of Europe shall notify Members of the Council of the date of entry into force of this Protocol and shall give the names of any Members who have signed it without reservation in respect of ratification or who have ratified it.

In witness whereof the undersigned, being duly authorised to that effect, have signed the present Protocol.

Done at Paris, this 15th day of December, 1956, in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary - General shall send certified copies to each of the signatory Governments.

Fourth Protocol to the General Agreement on Privileges and Immunities of the Council of Europe

The Governments signatory hereto, being Members of the Council of Europe,

Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4th November 1950 (hereinafter referred to as "the Convention''), the members of the European Court of Human Rights (hereinafter referred to as "the Court") are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder;

Considering that it is necessary to specify and define the said privileges and immunities in a Protocol to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2nd September 1949;

Have agreed as follows :

Article 1

For the purposes of this Protocol, the term "judges" means judges elected in accordance with Article 39 of the Convention as well as any ad hoc judge appointed by a State party concerned in pursuance of Article 43 of the Convention.

Article 2

The udges shall, while exercising their functions and during journeys made in the exercise of their functions, enjoy the following privileges and immunities

(a) immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

(b) exemption in respect of themselves and their spouses as regards any restrictions on their freedom of movement on exit from and return to their country of residence, and entry into and exit from the country in which they exercise their functions; and from aliens' registration in the country which they are visiting or through which they are passing in the exercise of their functions.

Article 3

In the course of journeys undertaken in the exercise of their functions, the judges shall, in the matter of customs and exchange control, be accorded:

(a) by their own Government the same facilities as those accorded co senior Government officials travelling abroad on temporary official duty;

(b) by the Governments of other Members, the same facilities as those accorded to heads of diplomatic missions.

Article 4

l. Documents and papers of the Court, judges and Registry, in so far as they relate to the business of the Court, shall be inviolable.

2. The official correspondence and other official communications of the Court, its members and the Registry may not be held up or subjected to censorship.

Article 5

In order to secure for the judges complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Article 6

Privileges and immunities are accorded to judges not for the personal benefit of the individuals themselves but in order to safeguard the independent exercise of their functions- The Court alone, sitting in plenary session, shall be competent to waive the immunity of judges; it has not only the right, but is under a duty, to waive the immunity of a judge in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 7

1. The provisions of Articles 2 to 5 of this Protocol shall apply co the Registrar of the Court and co the Deputy Registrar when he is acting as the Registrar, without prejudice to any privileges and immunities to which they may be entitled under Article 18 of the General Agreement on Privileges and Immunities of the Council of Europe.

2. The provisions of Article 18 of the General Agreement on Privileges and Immunities of the Council of Europe shall apply to the Deputy Registrar of the Court in respect of his services as such when he is not acting as Registrar.

3. The privileges and immunities referred to in paragraphs I and 2 of this Article are accorded to the Registrar and Deputy Registrar, not for the personal benefit of the individuals themselves but to facilitate the discharge of their duties. The Court alone, sitting in plenary session, shall be competent to waive the immunity of its Registrar and Deputy Registrar; it has not only the right, but is under a duty, to waive such immunity in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 8

1. Any State may, at the time of its signature without reservation in respect of ratification, of its ratification or at any time thereafter, declare, by notification addressed to the Secretary-General of the Council of Europe, that the present Protocol shall extend to all or any of the territories for whose international relations it is responsible and where, according to Article 63 of the Convention for the Protection of Human Rights and Fundamental Freedoms, the said Convention applies.

2. The Protocol shall extend to the territory or territories named in the notification as from the thirtieth day after the receipt of this notification by the Secretary-General of the Council of Europe.

Article 9

This Protocol shall be open to the signature of the Members of the Council of Europe who may become parties to it either by :

(a) signature without reservation in respect of ratification, or by

(b) signature with reservation in respect of ratification followed by ratification.

Instruments of ratification shall be deposited with the Secretary-General of the Council of Europe.

Article 10

1. This Protocol shall enter into force as soon as three Members of the Council of Europe shall, in accordance with Article 9, have signed it without reservation in respect of ratification or shall have ratified it.

2. As regards any Member subsequently signing it without reservation in respect of ratification, or ratifying it, this Protocol shall enter into force at the date of signature or deposit of the instrument of ratification.

Article 11

The Secretary-General of the Council of Europe shall notify Members of the Council of:

(a) the names of signatories and the deposit of any instrument of ratification;

(b) the date of entry into force of this Protocol.

In witness whereof the undersigned, being duly authorised to that effect, have signed the present Protocol.

Done at Paris, this 16th day of December, 1961, in English and in French, both texts being equally authoritative, i a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary - General shall send certified copies to each of the signatory Governments.

Fifth Protocol to the General Agreement on Privileges and Immunities of the Council of Europe

The member States of the Council of Europe, signatories hereto,

Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as "the Convention"), signed at Rome on 4 November 1950, the members of the European Commission of Human Rights (hereinafter referred to as "the Commission") and of the European Court of Human Rights (hereinafter referred to as "the Court") are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder;

Recalling that the said privileges and immunities have been specified and defined in the Second and Fourth Protocols, signed at Paris on 15 December 1956 and 16 December 1961 respectively, to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2 September 1949;

Considering that it is necessary, in the light of changes in the operation of the Convention's control machinery. to supplement the above-mentioned General Agreement by another Protocol,

Have agreed as follows:

Article 1

1. Members of the Commission and members of the Court shall be exempt from taxation on salaries, emoluments and allowances paid to them by the Council of Europe.

2. The term "members of the Commission and members of the Court" includes members who, after having been replaced, continue to deal with cases which they already have under consideration as well as any ad hoc judge appointed in pursuance of the provisions of the Convention.

Article 2

1. This Protocol shall be open for signature by the member States of the Council of Europe, which may express their consent to be bound by:

a. signature without reservation as to ratification, acceptance or approval, or

b. signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.

2. No member State of the Council of Europe shall sign without reservation as to ratification, ratify, accept or approve this Protocol unless it has already ratified. or simultaneously ratifies, the General Agreement on Privileges and Immunities of the Council of Europe.

3. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 3

1. This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which three member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 2.

2. In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of signature or of the deposit of the instrument of ratification, acceptance or approval.

Article 4

Pending the entry into force of this Protocol in accordance with paragraphs I and 2 of Article 3, the Signatories agree to apply the Protocol provisionally from the date of signature, so far as it is possible to do so under their respective constitutional systems.

Article 5

The Secretary - General of the Council of Europe shall notify the member States of the Council of:

a. any signature;

b. the deposit of any instrument of ratification, acceptance or approval;

c. any date of entry into force of this Protocol in accordance with Article 3

d. any other act, notification or communication relating to this Protocol.

In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.

Sixth Protocol to the General Agreement on Privileges and Immunities of the Council of Europe

The member States of the Council of Europe, signatories here to,

Having regard to the Convention for the Protection of Human Rights and Fundamental

Freedoms, signed at Rome on 4 November 1950 (hereinafter referred to as "the Convention");

Having regard to Protocol No. 1 1 to the Convention, restructuring the control machinery established thereby, signed at Strasbourg on 11 May 1994 (hereinafter referred to as "Protocol No. 11 to the Convention"), which establishes a permanent European Court of Human Rights (hereinafter referred to as "the Court") to replace the European Commission and Court of Human Rights;

Also having regard to Article 51 of the Convention which specifies that judges are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the agreements made thereunder;

Recalling the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2 September 1949, (hereinafter referred to as "the General Agreement"), and its Second, Fourth and Fifth Protocols;

Considering that a new Protocol to the General Agreement is advisable to accord privileges and immunities to the judges of the Court;

Have agreed as follows:

Article 1

In addition to the privileges and immunities specified in Article 18 of the General Agreement, judges shall be accorded in respect of themselves, their spouses and minor children the privileges and immunities, exemptions and facilities accorded to diplomatic envoys in accordance with international law.

Article 2

For the purposes of this Protocol, the term "judges" means judges elected in accordance with Article 22 of the Convention as well as any ad hoc judge appointed by a State Party concerned in pursuance of Article 27, paragraph 2, of the Convention.

Article 3

in order to secure for the judges complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Article 4

Privileges and immunities are accorded to judges not for the personal benefit of the individuals themselves but in order to safeguard the independent exercise of their functions. The plenary Court alone shall be competent to waive the immunity of judges; it has not only the right, but is under a duty, to waive the immunity of a judge in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 5

1. The provisions of Articles 1, 3 and 4 of this Protocol shall apply to the Registrar of the Court and a Deputy Registrar formally notified as Acting Registrar to the State Parties to the Convention.

2. The provisions of Article 3 of this Protocol and Article 18 of the General Agreement shall apply to a Deputy Registrar of the Court.

3. The privileges and immunities referred to in paragraphs 1 and 2 of this Article are accorded to the Registrar and a Deputy Registrar not for the personal benefit of the individuals themselves but to facilitate the discharge of their duties. The plenary Court alone shall be competent to waive the immunity of its Registrar and a Deputy Registrar; it has not only the right, but is under a duty, to waive such immunity in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

4. The Secretary General of the Council of Europe shall be competent to waive, with the agreement of the President of the Court, the immunity of other staff members of the registry in accordance with the provisions of Article 19 of the General Agreement and having due regard to the considerations set out in paragraph 3.

Article 6

1. Documents and papers of the Court, judges and registry, in so far as they relate to the business of the Court, shall be inviolable.

2. The official correspondence and other official communications of the Court, judges and the registry may not be held up or subjected to censorship.

Article 7

1. This Protocol shall be open for signature by member States of the Council of Europe signatories to the General Agreement, which may express their consent to be bound by:

a. signature without reservation as to ratification, acceptance or approval; or

b. signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.

2. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 8

1. This Protocol shall enter into force on the first day of the month following the expiration of a period of one month after the date on which three Parties to the General Agreement have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 7 or on the date of entry into force of Protocol No. 1 1 to the Convention, whichever is the later.

2. As regards any State Party to the General Agreement which shall subsequently sign this Protocol without reservation in respect of ratification, acceptance or approval or which shall ratify, accept or approve it, this Protocol shall enter into force one month after the date of such signature or after the date of deposit of the instrument of ratification, acceptance or approval.

Article 9

1. Any State may, at the time of its signature without reservation in respect of ratification, of its ratification or at any time thereafter, declare, by notification addressed to the Secretary General of the Council of Europe, that the present Protocol shall extend to all or any of the territories for whose international relations it is responsible and where the Convention and its Protocols apply.

2. The Protocol shall extend to the territory or territories named in the notification as from the thirtieth day after the receipt of this notification by the Secretary General of the Council of Europe.

3. Any declaration made pursuant to paragraph 1 may, in respect of any territory specified in such declaration, be withdrawn or modified by a notification addressed to the Secretary General. The withdrawal or modification shall become effective on the first day of the month following the expiration of one month after the receipt of notification by the Secretary General.

Article 10

The Secretary General of the Council of Europe shall notify the member States of the Council of:

a. any signature;

b. the deposit of any instrument of ratification, acceptance or approval;

c. any date of entry into force of this Protocol in accordance with Articles 8 and 9;

d. any other act, notification or communication relating to this Protocol.

Vispārējais līgums par Eiropas Padomes privilēģijām un imunitātēm

Beļģijas Karalistes, Dānijas Karalistes, Francijas Republikas, Grieķijas Karalistes, Īrijas Republikas, Itālijas Republikas, Luksemburgas Lielhercogistes, Nīderlandes Karalistes, Norvēģijas Karalistes, Zviedrijas Karalistes, Turcijas Republikas un Lielbritānijas un Ziemeļīrijas Apvienotās Karalistes valdības,

ievērojot to, ka saskaņā ar Eiropas Padomes Statūtu 40.panta (a) punktu Eiropas Padome, tās Dalībvalstu pārstāvji un Sekretariāts Dalībvalstu teritorijās bauda visas privilēģijas un imunitātes, kas nepieciešamas viņu pienākumu veikšanai;

ievērojot to, ka saskaņā ar minētā panta (b) punktu Padomes Dalībvalstis ir apņēmušās noslēgt Līgumu, lai pilnībā izpildītu iepriekš minētā punkta noteikumus;

ievērojot to, ka Ministru Komiteja ir nolēmusi ieteikt Dalībvalstu valdībām pieņemt zemāk izklāstītos nosacījumus;

vienojās par sekojošo:

I NODAĻA

PERSONA — PILNVARAS

1.pants

Eiropas Padome ir juridiska persona. Tā ir tiesīga slēgt līgumus, iegādāties un pārdot kustamus un nekustamus īpašumus un uzsākt procesuālas darbības. Šajos jautājumos Eiropas Padomes vārdā darbojas Ģenerālsekretārs.

2.pants

Ģenerālsekretārs pastāvīgi sadarbojas ar kompetentām Dalībvalstu institūcijām, lai sekmētu taisnīgas tiesas spriešanu, nodrošinātu policijas noteikumu ievērošanu un izvairītos no jebkuras šajā līgumā uzskaitīto privilēģiju, imunitāšu un nodokļu atvieglojumu ļaunprātīgas izmantošanas.

II NODAĻA

ĪPAŠUMS, LĪDZEKĻI UN AKTĪVI

3.pants

Padome, tās īpašums un aktīvi neatkarīgi no to atrašanās vietas un turētāja bauda juridisku imunitāti, izņemot atsevišķus gadījumus, kad Ministru Padome no tās ir īpaši atteikusies. Tomēr atteikšanās no imunitātes netiek attiecināta uz īpašuma konfiskāciju un piedzīšanas pasākumiem.

4.pants

Padomes ēkas un telpas ir neaizskaramas. Tās īpašumi un aktīvi neatkarīgi no to atrašanās vietas un turētāja tiek atbrīvoti no kratīšanas, rekvizīcijas, konfiskācijas, ekspropriācijas vai jebkuras citas administratīvas, juridiskas vai leģislatīvas iejaukšanās formas.

5.pants

Padomes arhīvi un visi dokumenti kopumā, kas tai pieder vai ko tā glabā, ir neaizskarami neatkarīgi no to atrašanās vietas.

6.pants

Nebūdama pakļauta nekādām finansu kontrolēm, noteikumiem vai moratorijiem:

a) Padome ir tiesīga turēt īpašumā jebkuru valūtu un atvērt bankas rēķinus jebkurā valūtā;

b) Padome ir tiesīga brīvi pārvest savus līdzekļus no vienas valsts uz otru valsti vai arī jebkuras valsts iekšienē un mainīt jebkuru tai piederošu valūtu pret citu;

c) darbojoties to tiesību robežās, kas tai piešķirtas augšminētajos punktos (a) un (b), Eiropas Padome ņem vērā visus iesniegumus, ko tai izteikusi jebkuras Dalībvalsts valdība, ciktāl tas pēc Padomes ieskata nekaitē tās interesēm.

7.pants

Padome, tās aktīvi, ienākumi un citi īpašumi tiek atbrīvoti :

a) no visiem tiešajiem nodokļiem; tomēr Padome neprasīs atbrīvošanu no nodokļiem, likmēm vai nodevām, kas ir tikai maksājumi par komunālo pakalpojumu veidiem;

b) no visām muitas nodevām un no aizliegumiem un ierobežojumiem uz to priekšmetu importu un eksportu, kas paredzēti Padomes oficiālai lietošanai; priekšmeti, kas ievesti bez muitas nodokļa, netiks pārdoti valstī, kurā tie ievesti, izņemot apstākļos, kam piekritusi šīs valsts valdība;

c) no visiem muitas nodokļiem, aizliegumiem un ierobežojumiem attiecībā uz tās publikāciju importu un eksportu.

III NODAĻA

SAKARI

8.pants

Ministru Komiteja un Ģenerālsekretārs jebkuras Dalībvalsts teritorijā attiecībā uz saviem oficiālajiem sakariem ir tiesīgi saņemt ne mazāk labvēlīgu režīmu, kāds tas ir jebkuras citas valsts diplomātiskajām pārstāvniecībām šajā Dalībvalstī.

Ministru Komitejas un Sekretariāta oficiālā korespondence un citas oficiālas komunikācijas netiek pakļautas cenzūrai.

IV NODAĻA

DALĪBVALSTU PĀRSTĀVJI MINISTRU KOMITEJĀ

9.pants

Pārstāvji Ministru Komitejā savu funkciju izpildes laikā un atrodoties ceļā no un uz sanāksmju vietām bauda sekojošas privilēģijas un imunitātes :

a) imunitāti pret arestu vai aizturēšanu un pret personiskās bagāžas konfiskāciju, un neaizskaramība attiecībā uz izteikto vai rakstīto vārdu, veiktajām darbībām savu tiešo pienākumu veikšanas laikā un pret jebkura veida jurisdikciju;

b) visu materiālu un dokumentu neaizskaramību;

c) tiesības lietot kodus un saņemt dokumentus vai korespondenci ar kurjeriem vai ar diplomātiskajām valīzēm;

d) viņu pašu un viņu laulāto tiesības netikt pakļautiem imigrācijas ierobežojumiem vai ārvalstnieku reģistrācijai valstī, kurā viņi iebrauc vai cauri kurai viņi dodas, pildot savus pienākumus;

e) tādas pašas priekšrocības attiecībā uz valūtas un maiņas ierobežojumiem kā tās, kas tiek piešķirtas diplomātisko misiju tāda paša ranga pārstāvjiem;

f) tādas pašas imunitātes un priekšrocības attiecībā uz personisko bagāžu kā tās, kas tiek piešķirtas diplomātisko misiju tāda paša ranga pārstāvjiem.

10.pants

Lai nodrošinātu Ministru Komitejas pārstāvjiem pilnīgu runas brīvību un pilnīgu neatkarību savu pienākumu izpildes laikā, viņiem piešķirtā neaizskaramība pret jebkuru jurisdikciju attiecībā uz izteikto vai rakstīto vārdu vai uz veiktajām darbībām, pildot savas tiešās funkcijas, turpinās arī pēc tam, kad šo personu mandāts ir beidzies.

11.pants

Dalībvalstu pārstāvjiem tiek piešķirtas privilēģijas un imunitātes nevis personīgā labuma gūšanai, bet ar mērķi nodrošināt viņu pienākumu neatkarīgu izpildi Ministru Komitejā. Līdz ar to Dalībvalstij ir ne tikai tiesības, bet arī pienākums atcelt sava pārstāvja imunitāti ikreiz, kad pēc tās ieskata imunitāte varētu traucēt spriest tiesu un kad to var atcelt, nekaitējot mērķim, kā dēļ imunitāte tika piešķirta.

12.pants

a) 9., 10. un 11.panta noteikumi nevar tikt pielietoti attiecībā uz tās valsts varas institūcijām, kuras pilsonis ir šī persona, vai tās Dalībvalsts varas institūcijām, ko viņš pārstāv vai ir pārstāvējis.

b) 9., 10., 11. un 12.(a) pantā apzīmējums «pārstāvis» lietojams attiecībā uz visiem pārstāvjiem, pārstāvju pienākumu izpildītājiem, padomniekiem, tehniskajiem ekspertiem un delegācijas sekretārēm.

V NODAĻA

PĀRSTĀVJI KONSULTATĪVAJĀ ASAMBLEJĀ

13.pants

Nekādi administratīvi vai citi ierobežojumi netiek piemēroti attiecībā uz Konsultatīvās Asamblejas pārstāvju un to vietnieku brīvu pārvietošanos, dodoties uz Asamblejas tikšanās vietu vai prom no tās.

Pārstāvjiem un to vietniekiem tiek piešķirtas sekojošas tiesības attiecībā uz muitu un apmaiņas kontroli:

a) no savas valdības puses — tās pašas priekšrocības, kādas tiek piešķirtas augsta ranga ierēdņiem, dodoties uz ārzemēm oficiālā pagaidu misijā;

b) no citu dalībvalstu valdību puses — tās pašas priekšrocības kā tās, ko bauda ārzemju valsts ierēdņi, atrodoties oficiālā pagaidu misijā.

14.pants

Konsultatīvās Asamblejas pārstāvji un viņu vietnieki nedrīkst tikt pakļauti nopratināšanai, arestam un jebkāda veida tiesvedībai sakarā ar viņu izteicieniem vai balsošanas rezultātiem, veicot savus tiešos pienākumus.

15.pants

Konsultatīvās Asamblejas sesijas laikā Asamblejas pārstāvji un to vietnieki, neskatoties uz to, vai viņi ir vai nav parlamenta locekļi, bauda:

a) savas valsts teritorijā — imunitāti, kas tajā tiek piešķirta parlamenta locekļiem;

b) jebkuras citas Dalībvalsts teritorijā — imunitāti pret arestu un tiesas procesa ierosināšanu.

Šī imunitāte viņus aizsargā, līdzko viņi ierodas Konsultatīvajā Asamblejas sēžu vietā vai dodas projām no tās. Tomēr imunitāte netiek ņemta vērā, ja pārstāvis vai tā vietnieks tiek pieķerts pārkāpumā vai mēģinot to izdarīt, vai tūlīt pēc tā izdarīšanas, kā arī gadījumos, ja Asambleja ir atcēlusi kāda pārstāvja vai tā vietnieka imunitāti.

VI NODAĻA

PADOMES IERĒDŅI

16.pants

Bez 18.pantā uzskaitītām privilēģijām un imunitātēm Ģenerālsekretārs un Ģenerālsekretāra vietnieks attiecībā uz sevi, savu laulāto un saviem nepilngadīgajiem bērniem bauda privilēģijas, imunitātes, atvieglojumus un atbrīvojumus, kas saskaņā ar starptautisko tiesību normām tiek piešķirti diplomātiskajiem pārstāvjiem.

17.pants

Ģenerālsekretārs nosaka to ierēdņu kategorijas, uz kuriem attiecas sekojošā 18. panta noteikumi. Viņš dara to zināmu visu Dalībvalstu valdībām. Šajās kategorijās ietilpstošo ierēdņu vārdi periodiski tiek paziņoti Dalībvalstu valdībām.

18.pants

Eiropas Padomes ierēdņi:

a) bauda imunitāti pret jurisdikciju attiecībā uz visām savām darbībām, ieskaitot izteikto vai rakstīto vārdu, pildot viņu oficiālās funkcijas savas kompetences robežās;

b) tiek atbrīvoti no nodokļiem uz algām un ienākumiem, ko viņiem maksā Eiropas Padome;

c) tāpat kā viņu laulātie un citi apgādājamie ģimenes locekļi netiek pakļauti imigrācijas ierobežojumiem un ārvalstnieku reģistrācijai;

d) bauda tādus pašus maiņas atvieglojumus kā līdzvērtīga ranga diplomātisko misiju ierēdņi, kas akreditēti pie attiecīgās valdības;

e) kopā ar viņu laulātajiem un citiem apgādājamiem ģimenes locekļiem starptautiskas krīzes gadījumā saņem tādas pašas repatriācijas iespējas kā diplomātiskie pārstāvji;

f) ir tiesīgi sākotnējās iekārtošanās laikā ievest valstī savas mēbeles un citus iedzīves priekšmetus bez ievedmuitas un pēc savu funkciju izbeigšanās izvest tos atpakaļ uz savu valsti bez izvedmuitas.

19.pants

Privilēģijas, imunitātes un atvieglojumi tiek piešķirti ierēdņiem Padomes interesēs un nevis personīgā labuma gūšanai. Ģenerālsekretāram ir tiesības un pienākums atcelt jebkura ierēdņa imunitāti tajos gadījumos, ja, viņaprāt, šī imunitāte varētu traucēt tiesas spriešanu un ja tā var tikt atcelta, nekaitējot Eiropas Padomes interesēm. Ģenerālsekretāra un Ģenerālsekretāra vietnieka imunitāti ir tiesīga atcelt Ministru Komiteja.

VII NODAĻA

PAPILDUS VIENOŠANĀS

20.pants

Padome ir tiesīga slēgt ar jebkuru Dalībvalsti vai Dalībvalstīm papildus līgumus, grozot šī Vispārējā Līguma noteikumus, ciktāl tas attiecas uz šo Dalībvalsti vai Dalībvalstīm.

VIII NODAĻA

STRĪDI

21.pants

Jebkurš strīds starp Padomi un privātpersonu attiecībā uz veiktajām piegādēm, sniegtajiem pakalpojumiem vai nekustamajiem īpašumiem, ko iegādājusies Padome, tiek iesniegts izskatīšanai arbitrāžā saskaņā ar Ģenerālsekretāra administratīvu rīkojumu, ko apstiprinājusi Ministru Komiteja.

IX NODAĻA

NOSLĒGUMA NOSACĪJUMI

22.pants

Šis Līgums ir ratificējams. Ratifikācijas instrumenti iesniedzami Eiropas Padomes Ģenerālsekretāram. Līgums stājas spēkā, tiklīdz ratifikācijas instrumentus iesniegušas septiņas to parakstījušās valstis.

Taču, kamēr Līgums saskaņā ar iepriekšējā paragrāfā izklāstītajiem noteikumiem vēl nav stājies spēkā un, lai izvairītos no jebkuras aizkavēšanās Padomes efektīvā darbībā, parakstītājas valstis vienojas ievērot šo Līgumu provizoriski, sākot ar parakstīšanas dienu, ciktāl tas ir iespējams, ņemot vērā attiecīgo valstu konstitucionālo sistēmu.

To apliecinot, apakšā parakstījušies, šim nolūkam attiecīgi pilnvarotie parakstīja šo Līgumu.

Sastādīts Parīzē, 1949.gada 2.septembrī, angļu un franču valodās, kur abiem tekstiem ir vienāds spēks, vienā eksemplārā, kas glabājas Padomes arhīvā. Ģenerālsekretārs izsūta apstiprinātas kopijas katrai Eiropas Padomes Dalībvalstij.

Vispārējā līguma par Eiropas Padomes privilēģijām un imunitātēm protokols

Parīzē, 1949.gada 2.septembrī Vispārējā Līguma par Eiropas Padomes privilēģijām un imunitātēm (turpmāk sauktu "Līgums') parakstījušo valstu valdības,

vēloties papildināt Līguma nosacījumus,

vienojās par sekojošo:

1. pants

Jebkura Eiropas Padomes pašreizējā vai nākamā Dalībvalsts, kas nav parakstījusi Līgumu, var pievienoties tam un šim Protokolam, iesniedzot pievienošanās instrumentus par abiem līgumiem Eiropas Padomes Ģenerālsekretāram, kas par to paziņos Padomes Dalībvalstīm.

2. pants

a) Līguma 4.nodaļas noteikumi attiecināmi uz pārstāvjiem, kas piedalās Ministru vietnieku sēdēs.

b) 4.nodaļas noteikumi attiecināmi uz pārstāvjiem (izņemot pārstāvjus Konsultatīvajā Asamblejā), kuri piedalās Eiropas Padomes sasaukto sēžu darbā, kas notiek ārpus Ministru Komitejas un Ministru vietnieku sesiju perioda; tai pat laikā pārstāvji, kas piedalās šajās sēdēs, nebauda imunitāti pret arestu un tiesas procesa ierosināšanu, ja tie tiek pieķerti pārkāpumā, mēģinot to izdarīt, vai tūlīt pēc tā izdarīšanas.

3. pants

Līguma 15.panta noteikumi attiecināmi arī uz Konsultatīvās Asamblejas pārstāvjiem un to [SD1]vietniekiem, tiklīdz viņi piedalās sēdē vai ierodas kādas Asamblejas komitejas vai apakškomitejas sēdē vai dodas projām no tās neatkarīgi no tā, vai sēde notiek Konsultatīvās Asamblejas sesijā vai nē.

4. pants

Dalībvalstu pastāvīgie pārstāvji Eiropas Padomē savu funkciju izpildes laikā un atrodoties ceļā uz sanāksmju vietām un no projām no tās, bauda tādas pašas privilēģijas, imunitātes un atvieglojumus, kādas tiek piešķirtas diplomātisko misiju tāda paša ranga pārstāvjiem.

5. pants

Dalībvalstu pārstāvjiem tiek piešķirtas privilēģijas un imunitātes nevis viņu pašu personīgajam labumam, bet ar mērķi nodrošināt viņu pienākumu neatkarīgu izpildi Eiropas Padomē. Tātad Dalībvalstij ir ne tikai tiesības, bet arī pienākums atcelt sava pārstāvja imunitāti ikreiz, kad pēc tās ieskata imunitāte varētu traucēt spriest tiesu un kad to var atcelt, nekaitējot mērķim, kā dēļ imunitāte tika piešķirta.

6. pants

4.panta noteikumi nevar tikt pielietoti attiecībā uz tās valsts varas institūcijām, kuras pilsonis ir šī persona, vai tās Dalībvalsts varas institūcijām, ko viņš pārstāv vai ir pārstāvējis.

7. pants

a) Šis Protokols ir atvērts parakstīšanai Līgumu parakstījušām Dalībvalstīm. Protokols ratificējams vienlaicīgi ar Līgumu vai pēc tā ratifikācijas. Ratifikācijas dokumenti iesniedzami Eiropas Padomes Ģenerālsekretāram.

b) Šis Protokols stājas spēkā dienā, kad to būs ratificējušas visas to parakstījušās valstis, kas uz to laiku būs ratificējušas Līgumu ar nosacījumu, ka Līgumu un Protokolu parakstījušo valstu skaits nav mazāks par septiņām.

c) Attiecībā uz tām valstīm, kas Protokolu ratificēs vēlāk, tas stājas spēkā dienā, kad iesniegti ratifikācijas instrumenti.

d) Dalībvalstīs, kas pievienojas Līgumam un Protokolam saskaņā ar 1.panta noteikumiem, Līgums un Protokols stājas spēkā:

(i) dienā, kas norādīta augšminētajā (b) paragrāfā, gadījumos, ja pievienošanās dokuments ir iesniegts pirms šīs dienas, vai

(ii) dienā, kad iesniegts pievienošanās instruments gadījumos, ja tas tiek iesniegts pēc dienas, kas norādīta augšminētajā (b) paragrāfā.

To apliecinot, apakšā parakstījušies šim nolūkam attiecīgi pilnvarotie parakstīja šo Protokolu.

Sastādīts Strasbūrā, 1952.gada 6.novembrī, angļu un franču valodās, abi teksti ir vienlīdz autentiski, vienā eksemplārā, kas glabājas Padomes arhīvā. Ģenerālsekretārs izsūtīs apstiprinātas kopijas katras valsts, kas pievienojusies vai parakstījusi, valdībai.

Vispārējā līguma par Eiropas Padomes privilēģijām un imunitātēm otrais protokols

Noteikumi, kas attiecas uz Eiropas Cilvēktiesību komisijas locekļiem

Šo dokumentu parakstījušo valstu valdības, būdamas Eiropas Padomes Dalībvalstis,

ievērojot to, ka saskaņā ar Romā 1950.gada 4.novembrī parakstītās Cilvēka Tiesību un Pamatbrīvību aizsardzības Konvencijas 59.pantu, Eiropas Cilvēktiesību Komisijas (turpmāk saukta "Komisija") locekļi savu pienākumu izpildes laikā bauda privilēģijas un imunitātes, kas formulētas Eiropas Padomes statūtu 40.pantā un līgumos, kuri tikuši noslēgti saskaņā ar to;

ievērojot to, ka ir nepieciešams definēt un precizēt augšminētās privilēģijas un imunitātes ar papildprotokolu pie Parīzē 1949.gada 2.septembrī parakstītā Vispārējā Līguma par Eiropas Padomes privilēģijām un imunitātēm;

vienojās par sekojošo:

1. pants

Komisijas locekļi savu funkciju izpildes laikā un atrodoties ceļā no un uz sanāksmju vietām bauda sekojošas privilēģijas un imunitātes:

a) imunitāti attiecībā uz arestu vai aizturēšanu un uz personiskās bagāžas konfiskāciju un attiecībā uz izteikto vai rakstīto vārdu, uz veiktajām darbībām savu tiešo pienākumu veikšanas laikā, neaizskaramību pret jebkura veida jurisdikciju;

b) visu materiālu un dokumentu neaizskaramību;

c) viņu pašu un viņu laulāto tiesības netikt pakļautiem imigrācijas ierobežojumiem vai ārvalstnieku reģistrācijai valstī, kurā viņi iebrauc vai cauri kurai viņi dodas, pildot savus pienākumus;

2. pants

1. Nekādi administratīvi vai citi ierobežojumi nevar tikt pielietoti attiecībā uz Komisijas locekļu brīvu pārvietošanos, ierodoties uz Komisijas tikšanās vietu vai aizbraucot no tās.

2. Komisijas locekļiem tiek piešķirtas sekojošas tiesības attiecībā uz muitu un apmaiņas kontroli:

a) no savas valdības puses, tās pašas priekšrocības, kādas tiek piešķirtas augsta ranga ierēdņiem dodoties uz ārzemēm oficiālā pagaidu misijā;

b) no citu dalībvalstu valdību puses, tās pašas priekšrocības kā tās, ko bauda ārzemju valsts ierēdņi atrodoties oficiālā pagaidu misijā.

3. pants

Lai nodrošinātu Komisijas locekļiem pilnīgu runas brīvību un pilnīgu neatkarību savu pienākumu izpildes laikā, viņiem piešķirtā neaizskaramība pret jebkuru jurisdikciju attiecībā uz izteikto vai rakstīto vārdu vai uz veiktajām darbībām pildot savas tiešās funkcijas, turpinās arī pēc tam, kad šo personu mandāts ir beidzies.

4. pants

Komisijas locekļiem tiek piešķirtas privilēģijas un imunitātes nevis personīgā labuma gūšanai, bet ar mērķi nodrošināt viņu pienākumu neatkarīgu izpildi. Tikai Komisija ir tiesīga atcelt tās locekļu imunitāti; tai ir ne tikai tiesības, bet arī pienākums atcelt sava locekļa imunitāti ikreizi, kad, pēc tās ieskata, imunitāte varētu traucēt spriest tiesu un kad to var atcelt, nekaitējot mērķim, kā dēļ imunitāte tika piešķirta.

5. pants

Šis protokols ir atvērts parakstīšanai Eiropas Padomes Dalībvalstīm, kas var kļūt par tā pusēm:

a) parakstot to bez rezervācijas attiecībā uz ratifikāciju;

b) parakstot to ar rezervāciju attiecībā uz ratifikāciju.

Ratifikācijas dokumenti tiks iesniegti Eiropas Padomes Ģenerālsekretāram.

6. pants

1. Šis Protokols stājas spēkā, līdzko trīs Eiropas Padomes Dalībvalstis, saskaņā ar 5.panta noteikumiem, to ir parakstījušas bez rezervācijas attiecībā uz ratifikāciju vai ir to ratificējušas.

2. Attiecībā uz jebkuru Dalībvalsti, kas to paraksta vēlāk bez rezervācijas attiecībā uz ratifikāciju vai to ratificē, šis Protokols stājas spēkā no tā parakstīšanas vai no ratifikācijas dokumenta iesniegšanas brīža.

7. pants

Eiropas Padomes Ģenerālsekretārs paziņo Padomes Dalībvalstīm datumu, kad šis Protokols stājas spēkā, un uzskaita Dalībvalstis, kas to ir parakstījušas bez rezervācijas attiecībā uz ratifikāciju vai to ir ratificējušas.

To apliecinot, apakšā parakstījušies, šim nolūkam attiecīgi pilnvarotie parakstīja šo Protokolu.

Sastādīts Parīzē 1956.gada 15.decembrī angļu un franču valodās, kur abi teksti ir vienlīdz autentiski, vienā eksemplārā, kas glabāsies Eiropas Padomes arhīvā. Ģenerālsekretārs izsūtīs apstiprinātas kopijas katras valsts, kas pievienojusies vai parakstījusi, valdībai.

Vispārējā līguma par Eiropas Padomes privilēģijām un imunitātēm ceturtais protokols

Noteikumi, kas attiecas uz Eiropas Cilvēktiesību tiesu

Šo dokumentu parakstījušo valstu valdības, būdamas Eiropas Padomes Dalībvalstis,

ievērojot to, ka saskaņā ar Romā 1950.gada 4.novembrī parakstītās Cilvēka Tiesību un Pamatbrīvību aizsardzības Konvencijas (turpmāk saukta Konvencija ) 59.pantu Eiropas Cilvēktiesību Tiesas (turpmāk saukta "Tiesa") locekļi savu pienākumu izpildes laikā bauda privilēģijas un imunitātes, kas formulētas Eiropas Padomes Statūtu 40. pantā un līgumos, kuri tikuši noslēgti saskaņā ar to;

ievērojot to, ka ir nepieciešams definēt un precizēt augšminētās privilēģijas un imunitātes ar papildprotokolu pie Parīzē, 1949. gada 2. septembrī parakstītā Vispārējā Līguma par Eiropas Padomes privilēģijām un imunitātēm;

vienojās par sekojošo:

1. pants

Ar šai Protokolā lietoto terminu "tiesneši" tiek apzīmēti tiesneši, kas ievēlēti saskaņā ar Konvencijas 39. pantu kā arī jebkurš ad hoc tiesnesis, ko Konvencijas 39. panta ietvaros iecēlusi Dalībvalsts — puse.

2. pants

Tiesneši savu funkciju izpildes laikā un atrodoties ceļā no un uz sanāksmju vietām, bauda sekojošas privilēģijas un imunitātes :

a) imunitāti attiecībā uz arestu vai aizturēšanu un uz personiskās bagāžas konfiskāciju un attiecībā uz izteikto vai rakstīto vārdu, uz veiktajām darbībām savu tiešo pienākumu veikšanas laikā, neaizskaramību pret jebkura veida jurisdikciju;

b) viņu pašu un viņu laulāto tiesības netikt pakļautiem nekādiem ierobežojumiem attiecībā uz viņu pārvietošanās brīvību, izbraucot vai atgriežoties rezidences valstī, un attiecībā uz iebraukšanu vai izbraukšanu no valsts, kurā viņi pilda savas funkcijas, kā arī tiesības netikt pakļautiem imigrācijas ierobežojumiem vai ārvalstnieku reģistrācijai valstī, kurā viņi iebrauc vai cauri kurai viņi dodas, pildot savus pienākumus.

3. pants

Ceļojot savu pienākumu veikšanas laikā, tiesnešiem tiek piešķirtas sekojošas tiesības attiecībā uz muitu un apmaiņas kontroli:

a) no savas valdības puses, tādas pašas priekšrocības, kādas tiek piešķirtas augsta ranga ierēdņiem, dodoties uz ārzemēm oficiālā pagaidu misijā;

b) no citu dalībvalstu valdību puses, tādas pašas priekšrocības kā tās, ko bauda diplomātisko misiju vadītāji.

4. pants

1. Tiesas, tiesnešu un Tiesas sekretariāta dokumenti un materiāli, ciktāl tie attiecas uz Tiesas darbību, ir neaizskarami.

2. Tiesas, tās locekļu un sekretariāta oficiālā korespondence un citi oficiālie ziņojumi nedrīkst tikt aizturēti vai pakļauti cenzūrai.

5. pants

Lai nodrošinātu tiesnešiem pilnīgu runas brīvību un pilnīgu neatkarību savu pienākumu izpildes laikā, viņiem piešķirtā neaizskaramība pret jebkuru jurisdikciju attiecībā uz izteikto vai rakstīto vārdu vai uz veiktajām darbībām, pildot savas tiešās funkcijas, turpinās arī pēc tam, kad šo personu mandāts ir beidzies.

6. pants

Tiesnešiem tiek piešķirtas privilēģijas un imunitātes nevis personīgā labuma gūšanai, bet ar mērķi nodrošināt viņu pienākumu neatkarīgu izpildi. Tikai Tiesa savas plenārsesijas laikā var atcelt savu tiesnešu imunitāti; tai ir ne tikai tiesības, bet arī pienākums atcelt sava tiesneša imunitāti katru reizi, kad pēc tās ieskata imunitāte varētu traucēt spriest tiesu un kad to var atcelt, nekaitējot mērķim, kura dēļ imunitāte tika piešķirta.

7. pants

1. Šī Protokola 2. līdz 5.pantu noteikumi attiecas uz Tiesas Sekretāru, kā arī uz Tiesas Sekretāra vietnieku laikā, kad tas aizstāj Sekretāru, neietekmējot privilēģijas un imunitātes, uz kurām viņiem ir tiesības saskaņā ar Vispārējā Līguma par Eiropas Padomes privilēģijām un imunitātēm 18. pantu.

2. Vispārējā Līguma par Eiropas Padomes privilēģijām un imunitātem 18. panta noteikumi attiecas uz Tiesas Sekretāra vietnieku, kad tas pilda savas funkcijas pat, ja viņš nedarbojas kā Tiesas Sekretārs.

3. Šī panta 1. un 2.paragrāfos paredzētās privilēģijas un imunitātes tiek piešķirtas Tiesas Sekretāram un viņa vietniekam nevis personīgā labuma gūšanai, bet ar mērķi atvieglot viņu pienākumu izpildi. Tikai Tiesa savas plenārsesijas laikā var atcelt sava Sekretāra un Sekretāra vietnieka imunitāti; tai ir ne tikai tiesības, bet arī pienākums atcelt šo imunitāti ikreiz, kad, pēc tās ieskata, imunitāte varētu traucēt spriest tiesu un kad to var atcelt nekaitējot mērķim, kura dēļ imunitāte tika piešķirta.

8. pants

1. Katra valsts, parakstot šo Protokolu bez rezervācijas attiecībā uz ratifikāciju, ratificējot to vai jebkurā laikā pēc tam var deklarēt, nosūtot Eiropas Padomes Ģenerālsekretāram adresētu paziņojumu, ka dotais Protokols attiecas uz visām vai jebkuru no teritorijām, par kuru starptautiskajām attiecībām tā atbildīga, un kurās saskaņā ar Cilvēka Tiesību un Pamatbrīvību aizsardzības konvencijas 63.pantu minētā Konvencija darbojas.

2. Attiecībā uz teritoriju vai teritorijām, kas minētas paziņojumā, Protokols stājas spēkā trīsdesmitajā dienā, skaitot no brīža, kad Eiropas Padomes Ģenerālsekretārs saņem šo paziņojumu.

9. pants

Šis protokols ir atvērts parakstīšanai Eiropas Padomes Dalībvalstīm, kas var kļūt par tā pusēm:

a) parakstot to bez rezervācijas attiecībā uz ratifikāciju;

b) parakstot to ar rezervāciju attiecībā uz ratifikāciju, ar tai sekojošu ratifikāciju.

Ratifikācijas dokumenti iesniedzami Eiropas Padomes Ģenerālsekretāram.

10. pants

1. Šis Protokols stājas spēkā, tiklīdz trīs Eiropas Padomes Dalībvalstis, saskaņā ar 9.panta noteikumiem, to ir parakstījušas bez rezervācijas attiecībā uz ratifikāciju vai ir to ratificējušas.

2. Attiecībā uz jebkuru Dalībvalsti, kas to paraksta vēlāk bez rezervācijas attiecībā uz ratifikāciju vai to ratificē, šis Protokols stājas spēkā no tā parakstīšanas vai no ratifikācijas dokumentu iesniegšanas brīža.

11. pants

Eiropas Padomes Ģenerālsekretārs Padomes Dalībvalstīm paziņo par:

a) parakstījušo valstu sarakstu un jebkura ratifikācijas dokumenta iesniegšanu;

b) datumu, kad šis Protokols stājas spēkā.

To apliecinot, apakšā parakstījušies šim nolūkam attiecīgi pilnvarotie, parakstīja šo Protokolu.

Sastādīts Parīzē, 1961.gada 16.decembrī angļu un franču valodā, kur abi teksti ir vienlīdz autentiski, vienā eksemplārā, kas glabājas Eiropas Padomes arhīvā. Ģenerālsekretārs izsūtīs apstiprinātas kopijas katras valsts, kas pievienojusies vai parakstījusi, valdībai.

Vispārējā līguma par Eiropas Padomes privilēģijām un imunitātēm piektais protokols

Šo dokumentu parakstījušās valstis, būdamas Eiropas Padomes Dalībvalstis,

Ņemot vērā to, ka saskaņā ar Romā 1950.gada 4.novembrī parakstītās Cilvēka Tiesību un Pamatbrīvību aizsardzības Konvencijas (turpmāk saukta "Konvencija") 59.pantu, Eiropas Cilvēktiesību Komisijas (turpmāk saukta "Komisija") un Eiropas Cilvēktiesību Tiesas (turpmāk saukta "Tiesa") locekļi savu pienākumu izpildes laikā bauda privilēģijas un imunitātes, kas formulētas Eiropas Padomes Statūtu 40.pantā un līgumos, kas tikuši noslēgti saskaņā ar to;

Atgādinot, ka augšminētās privilēģijas un imunitātes ir definētas un precizētas Otrajā un Ceturtajā Protokolā, kas tika parakstīti attiecīgi Parīzē 1956.gada 15.decembrī un Parīzē 1961.gada 16.decembrī, un 1949.gada 2.septembrī parakstītā Vispārējā Līgumā par Eiropas Padomes privilēģijām un imunitātēm;

Ņemot vērā to, ka sakarā ar grozījumiem Konvencijas kontroles mehānismā ir nepieciešams papildināt augšminēto Vispārējo Līgumu ar vēl vienu Protokolu,

Vienojās par sekojošo:

1. pants

1. Komisijas locekļi un Tiesas locekļi tiek atbrīvoti no nodokļiem uz algām un ienākumiem, ko viņiem maksā Eiropas Padome.

2. Ar terminu "Komisijas locekļi un Tiesas locekļi" tiek apzīmēti darbinieki, kuri turpina strādāt ar lietām, kas jau atrodas viņu pārziņā pat pēc tam, kad viņi mainījuši amatu, kā arī jebkurš ad hoc tiesnesis, kas ticis iecelts saskaņā ar Konvencijas nosacījumiem.

2. pants

1. Šis protokols ir atvērts parakstīšanai Eiropas Padomes Dalībvalstīm, kas var izteikt savu piekrišanu būt saistītām :

a) parakstot to bez rezervācijas attiecībā uz ratifikāciju, apstiprināšanu vai piekrišanu;

b) parakstot to ar rezervāciju attiecībā uz ratifikāciju, apstiprināšanu vai piekrišanu ar tām sekojošu ratifikāciju, apstiprināšanu vai piekrišanu.

2. Neviena no Eiropas Padomes Dalībvalstīm nevar parakstīt bez rezervācijas attiecībā uz ratifikāciju, ratificēt, apstiprināt vai piekrist šim Protokolam pirms tā nav ratificējusi vai vienlaicīgi ar parakstīšanu neratificē Vispārējo Līgumu par Eiropas Padomes privilēģijām un imunitātēm.

3. Ratifikācijas, apstiprināšanas vai piekrišanas dokumenti iesniedzami Eiropas Padomes Ģenerālsekretāram.

3. pants

1. Šis Protokols stājas pirmajā nākošā mēneša dienā, kas seko trīs mēnešu periodam, skaitot no datuma, kad trīs Eiropas Padomes Dalībvalstis ir izteikušas savu piekrišanu būt saistītām ar šo Protokolu saskaņā ar 2.panta nosacījumiem.

2. Attiecībā uz jebkuru Dalībvalsti, kas izsaka savu piekrišanu būt saistītai ar šo Protokolu vēlāk, tas stājas spēkā pirmajā nākošā mēneša dienā, kas seko trīs mēnešu periodam, skaitot no datuma, kad tā ir parakstījusi vai iesniegusi ratifikācijas, apstiprināšanas vai piekrišanas dokumentus.

4. pants

Kamēr šis Protokols vēl nav stājies spēkā saskaņā ar 3.panta 1. un 2.paragrāfu, to parakstījušās valstis nolemj to pielietot provizoriski, skaitot no tā parakstīšanas datuma, ciktāl tas ir iespējams, ņemot vērā katras valsts konstitucionālo sistēmu.

5. pants

Eiropas Padomes Ģenerālsekretārs Padomes Dalībvalstīm paziņo par:

a) jebkuru parakstīšanu;

b) jebkuru ratifikācijas, apstiprināšanas vai piekrišanas dokumentu iesniegšanu;

c)jebkuru šī Protokola stāšanos spēkā saskaņā ar 3.pantu;

b) jebkuru citu aktu, paziņojumu vai komunikāciju, kas attiecas uz šo Protokolu.

To apliecinot, apakšā parakstījušies šim nolūkam attiecīgi pilnvarotie, parakstīja šo Protokolu.

Vispārējā līguma par Eiropas Padomes privilēģijām un imunitātēm sestais protokols

Šo dokumentu parakstījušās valstis, būdamas Eiropas Padomes Dalībvalstis,

Ņemot vērā Romā 1950.gada 4.novembrī parakstīto Cilvēka Tiesību un Pamatbrīvību aizsardzības Konvenciju (turpmāk saukta "Konvencija");

Ņemot vērā Strasbūrā 1994.gada 11.maijā parakstīto Konvencijas 11.Protokolu, kas groza kontroles mehānisma struktūru (turpmāk saukts "Konvencijas 11. Protokols"), ar ko tiek iedibināta pastāvīga Eiropas Cilvēktiesību Tiesa (turpmāk saukta "Tiesa") un kas aizvietos Eiropas Cilvēktiesību Komisiju un Tiesu;

Ņemot vērā arī Konvencijas 51.pantu, kas norāda, ka tiesneši savu pienākumu izpildes laikā bauda privilēģijas un imunitātes, kas formulētas Eiropas Padomes Statūtu 40.pantā un Līgumos, kas tikuši noslēgti saskaņā ar to;

Ievērojot Parīzē 1949.gada 2.septembrī parakstīto Vispārējo Līgumu par Eiropas Padomes privilēģijām un imunitātēm (turpmāk saukts "Vispārējais Līgums") un tā Otro, Ceturto un Piekto Protokolu;

Uzskatot, ka ir nepieciešams jauns Protokols, lai piešķirtu privilēģijas un imunitātes Tiesas tiesnešiem;

Vienojās par sekojošo:

1. pants

Bez Vispārējā Līguma 18.pantā uzskaitītajām privilēģijām un imunitātēm tiesneši, kā arī viņu laulātie un nepilngadīgie bērni bauda tādas pašas privilēģijas, imunitātes un atvieglojumus, kādas saskaņā ar starptautiskajām tiesībām tiek piešķirtas diplomātiskajiem pārstāvjiem.

2. pants

Ar šai Protokolā lietoto terminu "tiesneši" tiek apzīmēti tiesneši, kas ievēlēti saskaņā ar Konvencijas 22. pantu, kā arī jebkurš ad hoc tiesnesis, ko saskaņā ar Konvencijas 27. panta 2.paragrāfu iecēlusi Dalībvalsts - puse.

3. pants

Lai nodrošinātu tiesnešiem pilnīgu runas brīvību un pilnīgu neatkarību savu pienākumu izpildes laikā, viņiem piešķirtā neaizskaramība pret jebkuru jurisdikciju attiecībā uz izteikto vai rakstīto vārdu vai uz veiktajām darbībām, pildot savas tiešās funkcijas, turpinās arī pēc tam, kad šo personu mandāts ir beidzies.

4. pants

Tiesnešiem tiek piešķirtas privilēģijas un imunitātes nevis personīgā labuma gūšanai, bet ar mērķi nodrošināt viņu pienākumu neatkarīgu izpildi. Tikai Tiesa savas plenārsesijas laikā var atcelt savu tiesnešu imunitāti; tai ir ne tikai tiesības, bet arī pienākums atcelt sava tiesneša imunitāti ikreiz, kad, pēc tās ieskata, imunitāte varētu traucēt spriest tiesu un kad to var atcelt nekaitējot mērķim, kura dēļ imunitāte tika piešķirta.

5. pants

1. Šī Protokola 1., 3. un 4.panta noteikumi attiecas uz Tiesas Sekretāru, kā arī uz Tiesas Sekretāra vietnieku laikā, kad tas aizstāj Sekretāru, un kas tas ticis paziņots Konvencijas Dalībvalstīm.

2. Šī Protokola 3. panta un Vispārējā Līguma 18. panta noteikumi attiecas uz Tiesas Sekretāra vietnieku.

3. Šī panta 1. un 2. paragrāfos paredzētās privilēģijas un imunitātes tiek piešķirtas Tiesas Sekretāram un viņa vietniekam nevis personīgā labuma gūšanai, bet ar mērķi atvieglot viņu pienākumu izpildi. Tikai Tiesa savas plenārsesijas laikā var atcelt sava Sekretāra un Sekretāra vietnieka imunitāti; tai ir ne tikai tiesības, bet arī pienākums atcelt šo imunitāti ikreiz, kad, pēc tās ieskata, imunitāte varētu traucēt spriest tiesu un kad to var atcelt nekaitējot mērķim, kura dēļ imunitāte tika piešķirta.

4. Eiropas Padomes Ģenerālsekretārs ar Tiesas Prezidenta piekrišanu var atcelt citu Tiesas sekretariāta darbinieku imunitāti saskaņā ar Vispārējā Līguma 19. panta noteikumiem un ņemot vērā 3. paragrāfā minētos apsvērumus.

6. pants

1. Tiesas, tiesnešu un Tiesas Sekretariāta dokumenti un materiāli, ciktāl tie attiecas uz Tiesas darbību, ir neaizskarami.

2. Tiesas, tās locekļu un Sekretariāta oficiālā korespondence un citi oficiālie ziņojumi nedrīkst tikt aizturēti vai pakļauti cenzūrai.

7. pants

1. Šis protokols ir atvērts parakstīšanai Eiropas Padomes Dalībvalstīm, kas var izteikt savu piekrišanu būt saistītām :

a) parakstot to bez rezervācijas attiecībā uz ratifikāciju, apstiprināšanu vai piekrišanu.

b) parakstot to ar rezervāciju attiecībā uz ratifikāciju, apstiprināšanu vai piekrišanu ar tām sekojošu ratifikāciju, apstiprināšanu vai piekrišanu.

2. Ratifikācijas, apstiprināšanas vai piekrišanas dokumenti iesniedzami Eiropas Padomes Ģenerālsekretāram.

8. pants

1. Šis Protokols stājas pirmajā nākošā mēneša dienā, kas seko viena mēneša periodam, skaitot no datuma, kad trīs Vispārējā Līguma Dalībvalstis ir izteikušas savu piekrišanu būt saistītām ar šo Protokolu saskaņā ar 7. panta noteikumiem, ja līdz tam laikam Konvencijas 11. Protokols ir stājies spēkā, vai, pretējā gadījumā, dienā, kad stājas spēkā Konvencijas 11. Protokols.

2. Attiecībā uz jebkuru Vispārējā Līguma Dalībvalsti, kas šo Protokolu paraksta bez rezervācijas attiecībā uz ratifikāciju, apstiprināšanu vai piekrišanu vai to ratificē, izsaka apstiprināšanu vai piekrišanu vēlāk, šis Protokols stājas spēkā vienu mēnesi pēc tā parakstīšanas datuma vai no ratifikācijas, apstiprināšanas vai piekrišanas dokumentu iesniegšanas brīža.

9. pants

1. Katra valsts, parakstot šo Protokolu bez rezervācijas attiecībā uz ratifikāciju, ratificējot to vai jebkurā laikā pēc tam var deklarēt, nosūtot Eiropas Padomes Ģenerālsekretāram adresētu paziņojumu, ka dotais Protokols attiecas uz visām vai jebkuru no teritorijām, par kuru starptautiskajām attiecībām tā atbildīga, un uz kurām minētā Konvencija un tās Protokoli attiecas.

2. Attiecībā uz teritoriju vai teritorijām, kas minētas paziņojumā, Protokols stājas spēkā trīsdesmitajā dienā, skaitot no brīža, kad Eiropas Padomes Ģenerālsekretārs saņem šo paziņojumu.

3. Katra deklarācija, kas veikta saskaņā ar 1. paragrāfu, attiecībā uz jebkuru šajā daklarācijā minēto teritoriju var tikt denonsēta vai grozīta ar Ģenerālsekretāram adresētu ziņojumu. Denonsēšana vai grozījumi stājas spēkā tā mēneša pirmajā dienā, kas seko viena mēneša periodam, skaitot no dienas, kad Ģenerālsekretārs ir saņēmis paziņojumu.

10. pants

Eiropas Padomes Ģenerālsekretārs Padomes Dalībvalstīm paziņo par:

a) jebkuru parakstīšanu;

b) jebkuru ratifikācijas, apstiprināšanas vai piekrišanas dokumenta iesniegšanu;

c) jebkuru šī Protokola stāšanos spēkā saskaņā ar 8. un 9. pantu;

b) jebkuru citu aktu, paziņojumu vai komunikāciju, kas attiecas uz šo Protokolu.

To apliecinot, apakšā parakstījušies, šim nolūkam attiecīgi pilnvarotie parakstīja šo Protokolu.

Sastādīts Strasbūrā, 1996.gada 5.martā angļu un franču valodās, abi teksti ir vienlīdz autentiski, vienā eksemplārā, kas glabājas Eiropas Padomes arhīvā. Ģenerālsekretārs izsūtīs apstiprinātas kopijas katrai Eiropas Padomes Dalībvalstij.
