Par memoranda stāšanos spēkā

Ārlietu ministrija informē, ka 2017.gada 28.aprīlī stāsies spēkā Latvijas Republikas un Apvienoto Arābu Emirātu saprašanās memorands par abu valstu vadītāja apliecību savstarpēju atzīšanu (parakstīts Abū Dabī 2017.gada 27.februārī, apstiprināts ar 2017.gada 21.februāra Ministru kabineta noteikumiem Nr.98).

par abu valstu vadītāja apliecību
savstarpēju atzīšanu

Preambula

Latvijas Republikas valdība un Apvienoto Arābu Emirātu Iekšlietu ministrija (turpmāk - "puses"),

tiecoties padziļināt attiecības starp abām valstīm nolūkā nodrošināt katras valsts attiecīgo kompetento institūciju izdoto vadītāja apliecību atzīšanu un apmaiņu apmeklējuma vai pastāvīgas uzturēšanās laikā otras puses valsts teritorijā,

tiecoties attīstīt draudzības un sadarbības saites starp tām un veicinot sadarbības uzlabošanu ceļu satiksmes jomā,

ir vienojušās par turpmāko.

1.pants
Vispārīgi noteikumi

Lai īstenotu šo saprašanās memorandu, katra puse atzīst derīgas vadītāja apliecības tiem otras puses valsts pasu turētājiem, kas ierodas bez pastāvīgas uzturēšanās nolūka, pie nosacījuma, ka vadītāja apliecības turētājs atbilst otras puses noteiktajām minimālā vecuma ierobežojuma prasībām dažādām vadītāja apliecību kategorijām.

2.pants
Procedūras un nosacījumi

Tos pušu pasu turētājus, kas ierodas pastāvīgas uzturēšanās nolūkā un pieteikušies otras puses izdotas vadītāja apliecības apmaiņai, katra puse atbrīvo no atbilstošu teorētisko un praktisko eksāmenu kārtošanas. Šis atbrīvojums tiek attiecināts tikai uz motociklu un vieglo transportlīdzekļu kategorijām. Visu pārējo kategoriju vadītāja apliecību apmaiņai nepieciešams nokārtot atbilstošus teorētiskos, praktiskos un medicīniskos pārbaudījumus, kurus piemēro abu pušu nacionālās institūcijas. Laika periodu, kura ietvaros tiek veikta vadītāja apliecības apmaiņa, sākot ar tās turētāja uzturēšanās laika sākuma otras puses valsts teritorijā, attiecīgi nosaka katra puse tās nacionālajos normatīvajos aktos.

Vadītāja apliecību kategorijas tiek apmainītas atbilstoši tabulā norādītajam:

1. B - mehāniskie transportlīdzekļi ar pilnu masu, kas nepārsniedz 3 500 kg un kuri ir konstruēti un paredzēti ne vairāk kā astoņu pasažieru pārvadāšanai, neskaitot vadītāju; kā arī mehāniskie transportlīdzekļi savienojumā ar piekabi, kuras pilna masa nepārsniedz 750 kg.

1. Vieglie transportlīdzekļi:

Vieglie automobiļi ar masu līdz 2.5 tonnām.

2. D1 - mehāniskie transportlīdzekļi, kuri ir konstruēti un paredzēti ne vairāk kā 16 pasažieru pārvadāšanai, neskaitot vadītāju, un kuru garums nepārsniedz 8 metrus; kā arī mehāniskie transportlīdzekļi savienojumā ar piekabi, kuras pilna masa nepārsniedz 750 kg. 2. Mikroautobuss - mikroautobuss, kas paredzēts ne vairāk kā četrpadsmit pasažieru pārvadāšanai.
3. A1 - motocikli, kuru motora darba tilpums nepārsniedz 125 kubikcentimetrus, jauda nepārsniedz 11 kilovatus un jaudas attiecība pret svaru nepārsniedz 0,1 kilovatu uz kilogramu, kā arī tricikli, kuru jauda nepārsniedz 15 kilovatus;

A2 - motocikli, kuru jauda nepārsniedz 35 kilovatus, jaudas attiecība pret svaru nepārsniedz 0,2 kilovatus uz kilogramu un kuri nav atvasināti no transportlīdzekļiem, kuru jauda ir vairāk nekā divas reizes lielāka;

A - motocikli.

3.pants
Apmaiņas nosacījumi

Vadītāja apliecības var tikt apmainītas, ievērojot šādas normas un nosacījumus:

1. Pretendentam ir derīga uzturēšanās atļauja.

2. Vadītāja apliecība ir derīga un pastāvīga.

3. Pretendents atbilst abu pušu normatīvajos aktos noteiktajām minimālajām vecuma ierobežojuma prasībām vadītāja apliecību kategorijām.

4. Apmaiņai paredzētā vadītāja apliecība atbilst apstiprinātajiem paraugiem.

5. Pretendenta vadītāja apliecība tiek apmainīta pret atbilstošas kategorijas vadītāja apliecību saskaņā ar 2.pantā norādīto tabulu.

6. Pretendents iesniedz vadītāja apliecības juridisku tulkojumu, ko izsniedzis jebkurš sertificēts juridisku tulkojumu birojs.

7. Pretendents nokārto atbilstošus medicīniskus pārbaudījumus.

8. Uz vadītāja apliecību apmaiņu ir attiecināmas jebkuras citas normas, kas paredzētas pušu nacionālajos normatīvajos aktos.

9. Apmainītā vadītāja apliecība tiek nosūtīta tās izdevējai institūcijai otrā valstī pa diplomātiskajiem kanāliem.

4.pants
Vadītāja apliecības derīgums

Neskaidrību gadījumā attiecībā uz apmaiņai iesniegtas vadītāja apliecības derīgumu vai autentiskumu kompetentā institūcija, kas veic vadītāja apliecības apmaiņu, var lūgt otras puses kompetento institūciju pārbaudīt šīs vadītāja apliecības derīgumu vai autentiskumu pa diplomātiskajiem kanāliem.

5.pants
Vadītāja apliecība, satiksmes likumi un noteikumi

1. Katra puse nekavējoties informē otru pusi pa diplomātiskajiem kanāliem par jebkurām izmaiņām vai grozījumiem nacionālajos normatīvajos aktos attiecībā uz vadītāja apliecībām, ceļu satiksmi regulējošiem normatīvajiem aktiem vai kompetentajām institūcijām.

2. Šī saprašanās memoranda īstenošanai sadarbojas šādas kompetentās institūcijas:

a) Latvijas Republikā,

Valsts akciju sabiedrība "Ceļu satiksmes drošības direkcija";

b) Apvienotajos Arābu Emirātos,

Iekšlietu ministrijas Satiksmes koordinēšanas ģenerāldirekcija.

6.pants
Domstarpību risināšana

Visas domstarpības, kas rodas par šī saprašanās memoranda piemērošanu, puses risina sarunu un konsultāciju ceļā pa diplomātiskajiem kanāliem.

7.pants
Spēkā stāšanās un darbības pārtraukšana

1. Šis saprašanās memorands tiek piemērots pagaidu kārtībā no tā parakstīšanas dienas. Šis saprašanās memorands stājas spēkā sešdesmit (60) dienas pēc tā parakstīšanas dienas un paliek spēkā uz nenoteiktu laiku.

2. Šī saprašanās memoranda normas var tikt grozītas ar abu pušu rakstisku vienošanos.

3. Katra puse var izbeigt šī saprašanās memoranda darbību, trīs mēnešus iepriekš rakstiski pa diplomātiskajiem kanāliem sniedzot paziņojumu otrai pusei par nodomu izbeigt šī saprašanās memoranda darbību.

Parakstīts Abū Dabī 2017.gada 27.februārī divos oriģināleksemplāros, katrs latviešu, arābu un angļu valodā, visiem tekstiem ir vienāds spēks. Atšķirīgas šī saprašanās memoranda noteikumu interpretācijas gadījumā noteicošais ir teksts angļu valodā.

Memorandum of Understanding
on Mutual Recognition of Driving Licenses Issued by
the Republic of Latvia
and United Arab Emirates

Preamble

The Government of the Republic of Latvia and the Ministry of Interior of the United Arab Emirates, hereinafter referred to as "the parties",

Believing in deep relations between the two countries with desire to recognize and exchange of driving licenses issued by respective competent authorities of their countries during visit or residence in the territory of the country of other party.

Desiring to develop the friendship and cooperation ties between them and contributing to the enhancement of their cooperation in the area of road traffic,

Have agreed the following:

Article 1
General Provisions

For the purposes of implementing this Memorandum of Understanding, each party shall recognize a valid driving license issued by the other party to passport holders, who arrive not for the purpose of residence, provided that the holder of the driving license fulfills the requirements of minimum age laid down by the other party for the different driving license categories.

Article 2
Procedures and Conditions

For those passport holders who arrive for the purpose of residence, each party shall exempt the applicant for exchange of a driving license issued by the other party, from the related theoretical and practical tests. This exemption shall be limited to driving license categories for motor cycles and light vehicles. All other categories shall remain submitted to pass the related theoretical, practical and medical tests applied by national authorities of both parties. The period of time during which the exchange of driving licenses has to take place, starting from the date on which the holder has taken up residence in the country of the other party, is defined by national legislation of the respective party each of the two parties respectively.

Types of driving licenses are exchanged according to the following table:

1. A1 - motorcycles with a cylinder capacity not exceeding 125 cubic centimeters, of a power not exceeding 11 kW and with a power/weight ratio not exceeding 0,1 kW/kg; motor tricycles with a power not exceeding 15 kW;

A2 - motorcycles of a power not exceeding 35kW and with a power/weight ratio not exceeding 0,2 kW/kg and not derived from a vehicle of more than double its power;

A - motorcycles.

1. Motorcycle, all types of motorcycles.
2. B - motor vehicles with a maximum authorized mass not exceeding 3 500 kg and designed and constructed for the carriage of no more than eight passengers in addition to the driver; motor vehicles in this category may be combined with a trailer having a maximum authorized mass which does not exceed 750 kg.

2. Light vehicle, the net is not exceeding 2.5 tons.

3. D1 - motor vehicles designed and constructed for the carriage of no more than 16 passengers with a length not more than 8 m. Motor vehicles in this category may be combined with a trailer having a maximum authorized mass which does not exceed 750 kg. 3. Microbus up to maximum of 14 passengers.

Article 3
Conditions of Exchanging

The terms and conditions under which driving licenses can be exchanged, are the following:

1. The applicant shall hold a valid residence permit.

2. The driving license must be valid and permanent.

3. The applicant must fulfill the minimum age requirements according to law and regulations laid down by both parties.

4. The driving license which will be exchanged, must be according to the approved samples.

5. The driving license of the applicants should be replaced with equivalent type of driving license as stipulated in the table of Article 2.

6. The applicant must submit a legal translation of the driving license issued by any certified legal translation bureau.

7. The applicant must pass the required medical examination.

8. The exchange of driving licenses is subject to any other terms that are required according to the national legislation of both parties.

9. Replaced driving license shall be sent to issuing authority in the other country through diplomatic channels.

Article 4
The Validity of Driving License

In case of any doubts related to the validity or authenticity of a driving license submitted for exchange, the competent authority carrying out the exchange may request the competent authority of the other party to verify the validity or the authenticity of that driving license through diplomatic channels.

Article 5
Driving License, Traffic Laws and Regulations

1. Each party shall promptly inform the other party of any changes or amendments in its national legislation on driving licenses or traffic laws and regulations or competent authorities through diplomatic channels.

2. For implementing this Memorandum of Understanding, cooperation shall be made:

a- For the Republic of Latvia:

- State Joint Stock Company "Road Traffic Safety Directorate",

b- For the United Arab Emirates:

- Ministry of Interior - General Directorate of Traffic Coordination.

Article 6
Settlement

All disputes arising from the application of this Memorandum of Understanding shall be settled by negotiation and consultation between both parties through diplomatic channels.

Article 7
Entry into Force and Termination

1. This Memorandum of Understanding shall be provisionally applied from the date of its signature. This Memorandum of Understanding shall enter into force after (60) days from the date of signature and will remain valid for an indefinite period.

2. The terms of this Memorandum of Understanding may be amended by mutual written consent of both parties.

3. Either party may terminate this Memorandum of Understanding by giving three months advance written notice to the other party through diplomatic channels by indicating its intention to terminate this Memorandum of Understanding.

Done at Abu Dabi on 27 February 2017 in duplicate copies, each in Latvian, Arabic and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
