Saeima ir pieņēmusi un Valsts
prezidents izsludina šādu likumu:

Par 1960.gada 14.decembra Konvenciju par Ekonomiskās sadarbības un attīstības organizāciju un Līgumu par Latvijas Republikas pievienošanās Konvencijai par Ekonomiskās sadarbības un attīstības organizāciju nosacījumiem

1.pants. 1960.gada 14.decembra Konvencija par Ekonomiskās sadarbības un attīstības organizāciju (turpmāk - Konvencija) un 2016.gada 2.jūnijā Parīzē parakstītais Līgums par Latvijas Republikas pievienošanās Konvencijai par Ekonomiskās sadarbības un attīstības organizāciju nosacījumiem (turpmāk - Līgums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Konvencijā un Līgumā paredzēto saistību izpildi koordinē Ārlietu ministrija.

3.pants. Konvencija stājas spēkā tās 16.pantā noteiktajā laikā un kārtībā, Līgums stājas spēkā vienlaikus ar Konvencijas spēkā stāšanos, un Ārlietu ministrija par to paziņo oficiālajā izdevumā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Līgums un Konvencija angļu un franču valodā un to tulkojums latviešu valodā.

Likums Saeimā pieņemts 2016.gada 16.jūnijā.

ET DE DÉVELOPPEMENT ÉCONOMIQUES


STATEMENT BY THE GOVERNMENT OF THE REPUBLIC OF LATVIA CONCERNING THE ACCEPTANCE BY THE REPUBLIC OF LATVIA OF THE OBLIGATIONS OF MEMBERSHIP OF THE ORGANISATION FOR ECONOMIC CO-OPERATION AND DEVELOPMENT

THE GOVERNMENT OF THE REPUBLIC OF LATVIA:

Having regard to the Convention on the Organisation for Economic Co-operation and Development of 14 December 1960 (hereinafter referred to as "the Convention") and to Supplementary Protocols Nos. 1 and 2 to the Convention;

Having regard to Article 16 of the Convention which provides that the Council may decide to invite any Government prepared to assume the obligations of membership to accede to the Convention;

Having regard to the Resolution of the Council on Strengthening the OECD's Global Reach adopted on 29 May 2013 by which Council decided to open accession discussions with the Republic of Latvia [C(2013)58/FINAL];

Having regard to the Roadmap for the Accession of Latvia to the OECD Convention [C(2013)122/FINAL], adopted by Council on 15 October 2013 which set out the terms, conditions and process for the accession of the Republic of Latvia to the Organisation for Economic Co-operation and Development (hereinafter referred to as "the Organisation");

STATES the following:

A. GENERAL STATEMENT OF ACCEPTANCE

1. The Republic of Latvia shall, by deposit of its instrument of accession to the Convention, assume all obligations of membership of the Organisation including, inter alia, the acceptance of:

i) the aims of the Organisation, as set out in Article 1 of the Convention as well as in the Report of the OECD Preparatory Committee of December 1960;

ii) all of the undertakings and commitments set out in Articles 2 and 3 of the Convention;

iii) Supplementary Protocols Nos. 1 and 2 to the Convention;

iv) all decisions, resolutions, rules, regulations and conclusions adopted by the Organisation relating to its management and functioning including those concerning the governance of the Organisation, the financial contributions of Members, other financial and budget matters, staff matters (including the judgments of the Administrative Tribunal), procedural matters, relations with non-Members and classification of information;

v) the financial statements of the Organisation;

vi) the working methods of the Organisation;


 

DÉCLARATION DU GOUVERNEMENT DE LA RÉPUBLIQUE DE LETTONIE CONCERNANT L'ACCEPTATION PAR LA RÉPUBLIQUE DE LETTONIE DES OBLIGATIONS LIÉES À LA QUALITÉ DE MEMBRE DE L'ORGANISATION DE COOPÉRATION ET DE DÉVELOPPEMENT ÉCONOMIQUES

LE GOUVERNEMENT DE LA RÉPUBLIQUE DE LETTONIE :

Vu la Convention relative à l'Organisation de Coopération et de Développement Économiques en date du 14 décembre 1960 (désignée ci-après par « la Convention ») et les Protocoles additionnels n° 1 et 2 à cette Convention ;

Vu l'article 16 de la Convention qui prévoit que le Conseil peut décider d'inviter tout gouvernement prêt à assumer les obligations de Membre à adhérer à la Convention ;

Vu la Résolution du Conseil sur l'élargissement et l'engagement renforcé adoptée le 29 mai 2013, par laquelle le Conseil a décidé d'ouvrir des discussions sur l'adhésion avec la République de Lettonie [C(2013)58/FINAL] ;

Vu la Feuille de route pour l'adhésion de la Lettonie à la Convention relative à l'OCDE [C(2013)122/FINAL], adoptée par le Conseil le 15 octobre 2013, qui définit les modalités, les conditions et la procédure d'adhésion de la République de Lettonie à l'Organisation de Coopération et de Développement Économiques (désignée ci-après par « l'Organisation ») ;

DÉCLARE ce qui suit :

A. DÉCLARATION GÉNÉRALE D'ACCEPTATION

1. La République de Lettonie assumera, par le dépôt de son instrument d'adhésion à la Convention, toutes les obligations liées à la qualité de membre de l'Organisation et acceptera notamment :

i) les objectifs de l'Organisation, définis à l'article 1 de la Convention ainsi que dans le rapport du Comité préparatoire de l'OCDE de décembre 1960 ;

ii) l'ensemble des initiatives et engagements énoncés aux articles 2 et 3 de la Convention ;

iii) les Protocoles additionnels n°1 et 2 à la Convention ;

iv) toutes les décisions, résolutions, règles, dispositions et conclusions adoptées par l'Organisation en ce qui concerne sa gestion et son fonctionnement, y compris au sujet de la gouvernance de l'Organisation, des contributions financières des Membres, d'autres questions financières et budgétaires, de questions se rapportant au personnel (notamment des jugements du Tribunal administratif), de questions de procédure, des relations avec les non-Membres et de la classification de l'information ;

v) les états financiers de l'Organisation ;

vi) les méthodes de travail de l'Organisation ;


 

vii) all substantive legal instruments of the Organisation in force at the time of the decision of the OECD Council to invite the Republic of Latvia to accede to the Convention, with the remarks specified in Annexes 1 to 4 of the present Statement of which they form an integral part. With regard to any legal instruments adopted between the date of the decision of the OECD Council to invite the Republic of Latvia to accede to the Convention and the date on which the Republic of Latvia deposits its instrument of accession, the Republic of Latvia shall provide its position on each instrument within three months after its adoption.

B. AGREEMENT ON THE PRIVILEGES AND IMMUNITIES OF THE ORGANISATION

2. In accordance with Article 23 of the Agreement between the Republic of Latvia and the Organisation for Economic Co-operation and Development on the Privileges, Immunities and Facilities Granted to the Organisation (hereinafter referred to as "the Agreement on the Privileges and Immunities of the Organisation"), signed on 5 May 2014, the Agreement on the Privileges and Immunities of the Organisation entered into force on 7 November 2014.

C. PARTICIPATION IN OPTIONAL OECD ACTIVITIES AND BODIES

3. The Republic of Latvia wishes to participate in certain optional activities and bodies upon becoming a Member of the Organisation, as set out in Annex 5 which forms an integral part of the present Statement. The Republic of Latvia acknowledges that, for certain optional activities or bodies, there are specific procedures and/or criteria for participation or membership which will be applied.

D. TERMINATION OF PRIOR AGREEMENTS WITH THE ORGANISATION

4. The Republic of Latvia notes that, as from the date of its accession to the Convention, prior agreements between the Republic of Latvia and the Organisation concerning its participation as a non‑Member in certain OECD bodies shall be considered to be terminated. As from the date of its accession, the Republic of Latvia will participate in those OECD bodies as a Member of the Organisation.

E. REPORTING TO OECD COMMITTEES AFTER ACCESSION

5. The Republic of Latvia agrees to submit progress reports to selected OECD Committees after accession as set out in the Decision of the OECD Council to invite the Republic of Latvia to accede to the Convention. The Republic of Latvia further agrees to contribute resources to support the evaluation of post-accession progress reports included by the Council in its Decision to invite the Republic of Latvia to accede to the Convention.

6. The Republic of Latvia agrees to the publication of an annual summary of its post-accession progress prepared by the Secretary-General.


 

vii) tous les instruments juridiques fondamentaux de l'Organisation en vigueur à la date de la décision du Conseil de l'OCDE invitant la République de Lettonie à adhérer à la Convention avec les remarques formulées dans les Annexes 1 à 4 de la présente Déclaration, dont elles font partie intégrante. S'agissant des instruments juridiques adoptés entre la date de la décision du Conseil de l'OCDE invitant la République de Lettonie à adhérer à la Convention et la date de dépôt par la République de Lettonie de son instrument d'adhésion, la République de Lettonie indiquera sa position à l'égard de chaque instrument dans les trois mois suivant son adoption.

B. ACCORD SUR LES PRIVILÈGES ET IMMUNITÉS DE L'ORGANISATION

2. Conformément à l'article 23 de l'Accord entre la République de Lettonie et l'Organisation de coopération et de développement économiques sur les privilèges, immunités et facilités accordés à l'Organisation (désigné ci-après par « l'Accord sur les privilèges et immunités accordés à l'Organisation »), signé le 5 mai 2014, l'Accord sur les privilèges et immunités accordés à l'Organisation est entré en vigueur le 7 novembre 2014.

C. PARTICIPATION À DES ACTIVITÉS ET ORGANES DE L'OCDE À TITRE FACULTATIF

3. Comme indiqué à l'Annexe 5 formant partie intégrante de cette Déclaration, la République de Lettonie souhaite participer, une fois Membre de l'Organisation, à certaines activités et certains organes pour lesquels la participation est facultative. La République de Lettonie reconnaît que, pour certaines activités et certains organes à participation facultative, des modalités et/ou critères spécifiques de participation ou d'admission en qualité de Membre seront appliqués.

D. ABROGATION DES ACCORDS PRÉALABLEMENT PASSÉS AVEC L'ORGANISATION

4. La République de Lettonie note qu'à compter de la date de son adhésion à la Convention, les accords préalablement passés entre la République de Lettonie et l'Organisation au sujet de sa participation en qualité de non-Membre à certains organes de l'OCDE seront considérés abrogés. À compter de la date de son adhésion, la République de Lettonie participera à ces organes de l'OCDE en qualité de Membre de l'Organisation.

E. PRÉSENTATION DE RAPPORTS AUX COMITÉS DE L'OCDE APRÈS L'ADHÉSION

5. La République de Lettonie convient de présenter des rapports d'avancement à certains comités de l'OCDE après son adhésion, comme indiqué dans la Décision du Conseil de l'OCDE invitant la République de Lettonie à adhérer à la Convention. La République de Lettonie accepte en outre de fournir des ressources pour faciliter l'évaluation des rapports d'avancement post-adhésion prévus dans la Décision du Conseil d'inviter la République de Lettonie à adhérer à la Convention.

6. La République de Lettonie accepte que soit publié chaque année un résumé du rapport d'avancement post-adhésion la concernant établi par le Secrétaire général.


 

ANNEX 1: SPECIFIC REMARKS ON ACCEPTANCE OF OECD LEGAL INSTRUMENTS

The Republic of Latvia accepts all OECD legal instruments in force at the time of the decision by the OECD Council to invite the Republic of Latvia to accede to the Convention with the following remarks:

Corporate Governance

Recommendation of the Council on Guidelines on Corporate Governance of State-Owned Enterprises [C(2015)85]

Latvia commits to the establishment of professional boards of directors by the end of 2016 in all large commercial SOEs, based on the application of clear selection and nomination procedures for SOE board members.

Fiscal Affairs

Recommendation of the Council concerning the Model Tax Convention on Income and on Capital C(97)195/FINAL

Latvia accepts this Recommendation with the following reservations and observations on the OECD Model Tax Convention:

Reservations

Article 2, paragraph 2: Latvia holds the view that "taxes on the total amounts of wages or salaries paid by enterprises" should not be regarded as taxes on income and therefore reserves the right not to include these words in paragraph 2.

Article 4, paragraph 1: Latvia reserves the right to include the place of incorporation or a similar criterion in paragraph 1.

Article 5: Considering the special problems in applying the provisions of the Model Convention to activities carried on offshore in a Contracting State in connection with the exploration or exploitation of the sea bed, its subsoil and their natural resources, Latvia reserves the right to insert in a special Article provisions relating to such activities.

Article 5, paragraph 3: Latvia reserves the right to deem any person performing professional services or other activities of an independent character to have a permanent establishment if that person is present in the State for a period or periods exceeding in the aggregate 183 days in any twelve month period.

Article 6, paragraph 2: Latvia reserves the right to include in the definition of the term "immovable property" any option or similar right to acquire immovable property.

Article 6, paragraph 3: Latvia reserves the right to include in paragraph 3 a reference to income from the alienation of immovable property. Latvia also reserves the right to tax income of shareholders in resident companies from the direct use, letting, or use in any other form of the right to enjoyment of immovable property situated in their country and held by the company, where such right is based on the ownership of shares or other corporate rights in the company.


 

ANNEXE 1 : REMARQUES SPÉCIFIQUES CONCERNANT L'ACCEPTATION DES INSTRUMENTS JURIDIQUES DE L'OCDE

La République de Lettonie accepte tous les instruments juridiques de l'OCDE en vigueur à la date de la décision du Conseil de l'OCDE invitant la République de Lettonie à adhérer à la Convention, en formulant les remarques ci-après :

Gouvernance d'entreprise

Recommandation du Conseil relative aux Lignes directrices sur la gouvernance des entreprises publiques [C(2015)85]

La Lettonie s'engage à mettre en place, d'ici à la fin de 2016, des conseils d'administration composés de professionnels dans toutes les grandes entreprises publiques à vocation commerciale en suivant des procédures claires de désignation et de nomination des administrateurs.

Affaires fiscales

Recommandation du Conseil relative au Modèle de Convention fiscale concernant le revenu et la fortune C(97)195/FINAL

La Lettonie accepte cette Recommandation avec les réserves et observations suivantes relatives au Modèle de Convention fiscale de l'OCDE :

Réserves

Article 2, paragraphe 2 : La Lettonie considère que « les impôts sur le montant global des salaires payés par les entreprises » ne devraient pas être considérés comme impôts sur le revenu et se réserve donc le droit de ne pas inclure cette expression dans le paragraphe 2.

Article 4, paragraphe 1 : La Lettonie se réserve le droit d'inclure le lieu de constitution ou un critère analogue dans le paragraphe 1.

Article 5 : Compte tenu des problèmes particuliers que pose l'application des dispositions du Modèle de Convention aux activités exercées en haute mer dans un État contractant relativement à la prospection et l'exploitation du lit de la mer, du sous-sol marin et de leurs ressources naturelles, la Lettonie se réserve le droit d'insérer dans un article spécial des dispositions relatives à ces activités.

Article 5, paragraphe 3 : La Lettonie se réserve le droit de considérer qu'une personne qui exerce une profession libérale ou toute autre activité de caractère indépendant dispose d'un établissement stable lorsqu'elle séjourne sur son territoire pendant une période ou des périodes excédant au total 183 jours durant toute période de douze mois.

Article 6, paragraphe 2 : La Lettonie se réserve le droit d'inclure dans la définition de l'expression « biens immobiliers » une option ou un droit semblable d'acquérir un bien immobilier.

Article 6, paragraphe 3 : La Lettonie se réserve le droit d'inclure dans le paragraphe 3 une référence aux revenus provenant de l'aliénation de biens immobiliers. La Lettonie se réserve aussi le droit d'imposer les revenus d'actionnaires de sociétés résidentes provenant de l'utilisation directe, de la location ou de l'usage, sous toute autre forme, du droit de jouissance de biens immobiliers situés sur son territoire et détenus par la société, lorsqu'un tel droit est fondé sur la propriété d'actions ou d'autres parts sociales de la société.


 

Article 7: Latvia reserves the right to use the previous version of Article 7, i.e. the version that was included in the Model Tax Convention immediately before the 2010 Update, subject to adding to paragraph 3 of that previous version a clarification that expenses to be allowed as deductions by a Contracting State shall include only expenses that would be deductible if the permanent establishment were a separate enterprise of that Contracting State.

Article 8: Latvia reserves the right in exceptional cases to apply the permanent establishment rule in relation to profits derived from the operation of ships in international traffic.

Article 8, paragraph 1: Latvia reserves the right to include a provision that will ensure that profits from the leasing of ships or aircraft on a bare boat basis and from the leasing of containers will be treated in the same way as income covered by paragraph 1 when such profits are incidental to international transportation.

Article 8, paragraph 2: Latvia reserves the right not to extend the scope of the Article to cover inland waterways transportation in bilateral conventions and to make corresponding modifications to paragraph 3 of Articles 13, 15 and 22.

Article 10: Latvia reserves the right not to include the requirement for the competent authorities to settle by mutual agreement the mode of application of paragraph 2. Latvia also reserves its position on the rates provided for in paragraph 2.

Article 10, paragraph 3: Latvia reserves the right to replace, in paragraph 3, the words "income from other corporate rights" by "income from other rights".

Article 11, paragraph 2: Latvia reserves its position on the rate provided for in paragraph 2. Latvia also reserves the right not to include the requirement for the competent authorities to settle by mutual agreement the mode of application of paragraph 2.

Article 11, paragraph 3: Latvia reserves the right to amend the definition of interest to clarify that interest payments treated as distributions under its domestic law fall within Article 10.

Article 12, paragraph 1: Latvia reserves the right to tax royalties at source if the recipient of the income is an individual who is resident of the other Contracting State.

Article 12, paragraph 2: Latvia reserves the right to include in the definition of royalties payments for the use of, or the right to use, industrial, commercial or scientific equipment. Latvia also reserves the right, in order to fill what it considers as a gap in the Article, to add a provision defining the source of royalties by analogy with the provisions of paragraph 5 of Article 11, which deals with the same issue in the case of interest.

Article 13: Latvia reserves the right to insert in a special Article provisions regarding capital gains relating to activities carried on offshore in a Contracting State in connection with the exploration or exploitation of the sea bed, its subsoil and their natural resources.

Article 15: Latvia reserves the right to insert in a special Article provisions regarding income derived from dependent personal services relating to activities carried on offshore in a Contracting State in connection with the exploration or exploitation of the sea bed, its subsoil and their natural resources.


 

Article 7 : La Lettonie se réserve le droit d'utiliser la version précédente de l'article 7, soit la version incluse dans le Modèle de Convention fiscale avant la mise à jour 2010, sous réserve de préciser au paragraphe 3 de cette version précédente que les dépenses devant être admises en déduction par un État Contractant n'incluent que les dépenses dont la déduction serait par ailleurs admise si l'établissement stable était une entreprise distincte de cet État contractant.

Article 8 : La Lettonie se réserve le droit d'appliquer, dans des cas exceptionnels, le principe de l'établissement stable pour l'imposition des bénéfices provenant de l'exploitation de navires en trafic international.

Article 8, paragraphe 1 : La Lettonie se réserve le droit d'inclure une disposition selon laquelle les bénéfices tirés de la location coque nue d'un navire ou d'un aéronef et de la location de conteneurs sont traités de la même façon que les bénéfices couverts par le paragraphe 1 lorsqu'ils sont accessoires au transport international.

Article 8, paragraphe 2 : La Lettonie se réserve le droit, dans ses conventions bilatérales, de ne pas inclure le transport fluvial intérieur dans le champ d'application de l'article et d'apporter des modifications au même effet au paragraphe 3 des articles 13, 15 et 22.

Article 10 : La Lettonie se réserve le droit de ne pas inclure l'obligation, pour les autorités compétentes, de régler d'un commun accord les modalités d'application du paragraphe 2. Elle réserve également sa position sur les taux prévus au paragraphe 2.

Article 10, paragraphe 3 : La Lettonie se réserve le droit de remplacer, au paragraphe 3, l'expression « revenus d'autres parts sociales » par « revenus d'autres droits ».

Article 11, paragraphe 2 : La Lettonie réserve sa position sur le taux prévu au paragraphe 2. La Lettonie se réserve aussi le droit de ne pas inclure l'obligation, pour les autorités compétentes, de régler d'un commun accord les modalités d'application du paragraphe 2.

Article 11, paragraphe 3 : La Lettonie se réserve le droit de modifier la définition des intérêts de façon à clarifier que les paiements d'intérêts considérés comme des distributions de dividendes au regard de son droit interne entrent dans le champ d'application de l'article 10.

Article 12, paragraphe 1 : La Lettonie se réserve le droit d'imposer les redevances à la source si le bénéficiaire de ces revenus est une personne physique résidente de l'autre État contractant.

Article 12, paragraphe 2 : La Lettonie se réserve le droit d'inclure dans la définition des redevances les paiements au titre de l'usage, ou de la concession de l'usage, d'un équipement industriel, commercial ou scientifique. La Lettonie se réserve aussi le droit, en vue de combler ce qu'elle estime être une lacune de l'article, de proposer l'insertion d'une disposition définissant la source des redevances par analogie avec les dispositions du paragraphe 5 de l'article 11 qui traitent de la même question s'agissant des intérêts.

Article 13 : La Lettonie se réserve le droit d'insérer dans un article spécial des dispositions relatives aux gains en capital afférents aux activités exercées en haute mer dans un État contractant relativement à la prospection et l'exploitation du lit de la mer, du sous-sol marin et de leurs ressources naturelles.

Article 15 : La Lettonie se réserve le droit d'insérer dans un article spécial des dispositions concernant les revenus d'emploi afférents aux activités exercées en haute mer dans un État contractant relativement à la prospection et l'exploitation du lit de la mer, du sous-sol marin et de leurs ressources naturelles.


 

Article 16: Latvia reserves the right to tax under this Article any remuneration of a member of a board of directors or any other similar organ of a resident company.

Article 20: Latvia reserves the right to refer to any apprentice and to a trainee in this Article.

Observations

Article 7, commentary: Latvia will interpret Article 7 as it read before the 2010 Update in line with the relevant Commentary as it stood prior to that update.

Convention on Mutual Administrative Assistance in Tax Matters, as amended by the Protocol Amending the Convention on Mutual Administrative Assistance in Tax Matters

Notifications:

ANNEX A - Existing taxes to which the Convention shall apply

Article 2, paragraph 1.a.i:

- Income tax;

- Corporation tax;

Article 2, paragraph 1.b.iii:

B. Taxes on immovable property;

C. Value-Added Tax;

D. Excise taxes.

ANNEX B - Competent Authorities

The Ministry of Finance or its authorised representative.

Reservations:

In accordance with Article 30, paragraph 1.a, of the Convention, the Republic of Latvia reserves the right not to provide any form of assistance in relation to the following taxes of other Parties that are listed in Article 2, paragraph 1.b:

Sub-paragraph ii:

compulsory social security contributions payable to general government or to social security institutions established under public law;

Sub-paragraph iii:

A. estate, inheritance or gift taxes;

E. taxes on the use or ownership of motor vehicles;

F. taxes on the use or ownership of movable property other than motor vehicles;

G. any other taxes;


 

Article 16 : La Lettonie se réserve le droit d'imposer conformément à l'article toute rémunération versée à un membre d'un conseil d'administration ou de quelque autre organe d'une société résidente.

Article 20 : La Lettonie se réserve le droit d'inclure les apprentis et stagiaires dans le champ d'application de cet article.

Observations

Article 7, Commentaires : La Lettonie interprétera l'article 7, tel qu'il se lisait avant la mise à jour 2010, en conformité avec les Commentaires applicables tels qu'ils se lisaient avant cette mise à jour.

ANNEXE A - Impôts auxquels la Convention s'applique

In accordance with Article 30, paragraph 1.b, of the Convention, the Republic of Latvia reserves the right not to provide assistance in the recovery of any tax claim, or in the recovery of an administrative fine, for all taxes to which the above reservation applies.

In accordance with Article 30, paragraph 1.c, of the Convention, the Republic of Latvia reserves the right not to provide assistance in respect of any tax claim, which is in existence at the date of entry into force of the Convention in respect of the Republic of Latvia or, where a reservation has been made under sub-paragraph a or b, till the date of withdrawal of such a reservation in relation to taxes in the category in question.

In accordance with Article 30, paragraph 1.d, of the Convention, the Republic of Latvia reserves the right not to provide assistance in the service of documents for taxes covered by the above reservation regarding Article 30, paragraph 1.a.

In accordance with Article 30, paragraph 1.f, of the Convention, the Republic of Latvia reserves the right to apply paragraph 7 of Article 28 exclusively for administrative assistance related to taxable periods beginning on or after 1 January of the third year preceding the one in which the Convention, as amended by the 2010 Protocol, entered into force in respect of the Republic of Latvia, or where there is no taxable period, for administrative assistance related to charges to tax arising on or after 1 January of the third year preceding the one in which the Convention, as amended by the 2010 Protocol, entered into force in respect of the Republic of Latvia.

Declarations:

In accordance with Article 4, paragraph 3, of the Convention, the Republic of Latvia declares that according to its initial legislation its authorities may inform its resident or national before transmitting information concerning him, in conformity with Article 5 and 7.

Decision of the Council adopting the Code of Liberalisation of Capital Movements [OECD/C(61)96]

Decision of the Council adopting the Code of Liberalisation of Current Invisible Operations [OECD/C(61)95]

The Republic of Latvia proposes to lodge reservations to the Code of Liberalisation of Capital Movements and the Code of Liberalisation of Current Invisible Operations in accordance with Article 2(b) of the Codes. The lists of reservations are set out in Annexes 2 and 3 to the present Statement.

The Republic of Latvia wishes to make the following commitments with regards to its position under the Codes of Liberalisation:

"In accordance with Article 27 of the Vienna Convention on the Law of Treaties of 23 May 1969, Latvia commits to abide by the obligations it will undertake with respect to the OECD Codes of Liberalisation in the accession treaty with the OECD even in cases where its domestic legislation is in conflict with such obligations."

La République de Lettonie propose de formuler des réserves au regard du Code de la libération des mouvements de capitaux et du Code de la libération des opérations invisibles courantes, conformément à l'article 2(b) de ces codes. Les listes de ces réserves figurent aux Annexes 2 et 3 de la présente Déclaration.

La République de Lettonie prend les engagements suivants concernant sa position au regard des codes de la libération :

« Conformément à l'article 27 de la Convention de Vienne sur le droit des traités du 23 mai 1969, la Lettonie s'engage à respecter les obligations relatives aux codes de la libération de l'OCDE auxquelles elle souscrira dans le traité d'adhésion avec l'OCDE même dans les cas où sa législation nationale est en conflit avec de telles obligations. »

In accordance with the Third Revised Decision of the Council on National Treatment [C(91)147 as amended], the Republic of Latvia proposes to lodge certain exceptions to national treatment. The list of exceptions is set out in Annex 4 to the Final Statement.

Timeframe: Latvia accepts the instrument listed above with a timeframe for implementation until the end of 2018 for elements relating to e-procurement.

Tourism

Decision-Recommendation of the Council on International Tourism Policy [C(85)165/FINAL]

Reservations to Annex I:

Reservation to Section b) i)

40 cigarettes or 20 cigarillos or 10 cigars or 50 grams smoking tobacco for persons who are not air travellers. Import of tobacco products is allowed in any combination, if the part of per cent which is used from individually determined amounts, does not exceed 100 per cent in total. Import of alcohol and tobacco products is allowed for travellers who have reached the age of 18 years. The quantitative limits are not set for import of perfume, coffee and tea, these products are considered as "other goods" and monetary limits are applied to them.

Reservation to Section b) iii)

Other goods may be imported free of import duties and taxes up to the value of 300 EUR (approx. 266 units of account) for travellers using land transport, and up the value of 430 EUR (approx. 381 units of account) for travellers using air or sea transport. The import of other goods is free of import duties and taxes up to the value 285 EUR (approx. 252 units of account) for children below 15 years of age regardless of travel type.

Reservation to Section d) i)

Foreign driver may drive a vehicle in Latvia, if in possession of:

• driving permit issued in EU Member state or in EFTA country;

• driving permit where categories thereof are indicated in accordance with 1968 Vienna Convention on Road Traffic;

Réserves formulées au sujet de l'Annexe I :

Réserve formulée au sujet de la Section b) i)

40 cigarettes ou 20 cigarillos ou 10 cigares ou 50 g de tabac à fumer pour les personnes qui ne voyagent pas par voie aérienne. L'importation d'un assortiment de produits du tabac est autorisée quel que soit l'assortiment si les proportions cumulées de la franchise utilisée à l'intérieur de chaque catégorie n'excèdent pas 100 %. L'importation de produits alcoolisés et de tabac est autorisée pour les voyageurs âgés de plus de 18 ans. Aucune limite quantitative n'est fixée pour les importations de parfum, de café et de thé car ces produits sont considérés comme faisant partie des « autres marchandises » et se voient appliquer des limites en valeur.

Réserve formulée au sujet de la Section b) iii)

Les autres marchandises peuvent être importées en franchise de droits et taxes à l'importation à concurrence d'un montant de 300 EUR (approximativement 266 unités de compte) pour les personnes voyageant par voie terrestre, et à concurrence d'un montant de 430 EUR (approximativement 381 unités de compte) pour les personnes voyageant par voie aérienne ou maritime. L'importation des autres marchandises en franchise de droits et taxes à l'importation est autorisée à concurrence d'un montant de 285 EUR (approximativement 252 unités de compte) pour les enfants de moins de 15 ans indépendamment du mode de transport utilisé.

Réserve formulée au sujet de la Section d) i)

Un conducteur étranger est autorisé à conduire un véhicule en Lettonie s'il est en possession :

• d'un permis de conduire délivré par un État membre de l'UE ou un pays de l'AELE ;

• d'un permis de conduire sur lequel figurent les catégories de véhicules pour lesquels il est valable, comme le prévoit la Convention de Vienne de 1968 sur la circulation routière ;


 

• driving permit where categories thereof are not indicated in accordance with 1968 Vienna Convention on Road Traffic. A person having such a driving permit may drive a vehicle corresponding to the category B only, provided it is allowed in the country where this driving permit has been issued. When entries in the driving permit are not made in Latin letters, a person has to submit notarized translation into Latvian.

Latvia, as a Schengen member country, follows the EU common visa policy. Obtaining of visas and entry into the country takes place according to Council Regulation (EC) No. 539/2001 of 15 March 2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders and those whose nationals are exempt from that requirement, Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code), EU visa facilitation agreements with third countries and Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code). Latvia maintains the right to issue single entry visas.

En tant que pays membre de l'Espace Schengen, la Lettonie applique la politique commune de l'UE en matière de visas. L'obtention de visas et l'entrée sur le territoire sont régies par le Règlement (CE) N° 539/2001 du Conseil du 15 mars 2001 fixant la liste des pays tiers dont les ressortissants sont soumis à l'obligation de visa pour franchir les frontières extérieures des États membres et la liste de ceux dont les ressortissants sont exemptés de cette obligation, par le Règlement (CE) N° 810/2009 du Parlement européen et du Conseil du 13 juillet 2009 établissant un code communautaire des visas (code des visas), par les accords de facilitation de délivrance de visas avec les pays tiers et le Règlement (CE) N° 562/2006 du Parlement européen et du Conseil du 15 mars 2006 établissant un code communautaire relatif au régime de franchissement des frontières par les personnes (code frontières Schengen). La Lettonie conserve le droit de délivrer des visas d'entrée simple.

• Latvian citizens and the citizens of other EU countries, EEA countries, and Switzerland;

• State and self-governments and its enterprises;

• Enterprises registered in the Republic of Latvia or enterprises registered in other EU countries, EEA countries, or Switzerland and registered as taxable persons in the Republic of Latvia, which are fully jointly owned by Latvian citizens, other citizens of EU countries, citizens of EEA countries, citizens of Switzerland, the Latvian State or self-government, or which are owned by natural or legal persons from countries with which Latvia has signed and ratified an international agreement on the promotion and protection of investments before 31 December 1996 or an agreement signed and ratified by Latvia after that date, which provides for reciprocal rights to land acquisition.

THE COUNCIL,

Having regard to the Convention on the Organisation for Economic Co-operation and Development of 14 December 1960 (hereinafter referred to as "the Convention") and, in particular to Articles 5 a) and 16;

Having regard to the Resolution of the Council on Strengthening the OECD's Global Reach adopted on 29 May 2013 by which Council decided to open accession discussions with the Republic of Latvia [C(2013)58/FINAL];

Having regard to the Roadmap for the Accession of Latvia to the OECD Convention [C(2013)122/FINAL], adopted by Council on 15 October 2013 which set out the terms, conditions and process for the accession of the Republic of Latvia to the Organisation for Economic Co-operation and Development (hereinafter referred to as "the Organisation");

Having regard to the Report of the Secretary-General on the Accession of Latvia to the Organisation [C(2016)77/REV1];

Having regard to the Final Statement by the Government of the Republic of Latvia dated 29 April 2016 concerning the acceptance by the Republic of Latvia of the obligations of membership of the Organisation [C(2016)54/REV1];

Having regard to the formal opinions of the OECD substantive Committees listed in the Accession Roadmap [C(2016)55];

Having regard to the Note by the Secretary-General on the Position of Latvia on Legal Instruments not Reviewed by OECD Substantive Committees [C(2016)56];

Having regard to the Agreement between the Government of the Republic of Latvia and the Organisation for Economic Co-operation and Development on the Privileges, Immunities and Facilities Granted to the Organisation, which entered into force on 7 November 2014;

Considering that the Government of the Republic of Latvia is prepared to assume the obligations of membership of the Organisation;

DECIDES:

1. The Republic of Latvia is invited to accede to the Convention on the terms proposed in the Final Statement by the Government of the Republic of Latvia C(2016)54/REV1 and those set out below.

2. The Republic of Latvia shall provide its position on each legal instrument of the Organisation adopted between the date of the present Decision and the date of the accession of the Republic of Latvia to the Convention within three months after the adoption of such legal instrument.

Vu la Feuille de route pour l'adhésion de la Lettonie à la Convention relative à l'OCDE [C(2013)122/FINAL], adoptée par le Conseil le 15 octobre 2013 qui définit les modalités, les conditions et la procédure d'adhésion de la République de Lettonie à l'Organisation de coopération et de développement économiques (désignée ci-après par « l'Organisation ») ;

Vu le Rapport du Secrétaire général sur l'adhésion de la Lettonie à l'Organisation [C(2016)77/REV1] ;

Considérant que le gouvernement de la République de Lettonie est prêt à assumer les obligations liées à la qualité de Membre de l'Organisation ;

DÉCIDE :

1. La République de Lettonie est invitée à adhérer à la Convention dans les conditions proposées dans la Déclaration finale du gouvernement de la République de Lettonie [C(2016)54/REV1] et dans celles définies ci-après.

2. La République de Lettonie devra faire connaître sa position sur chaque instrument juridique de l'Organisation adopté entre la date de la présente Décision et la date de son adhésion à la Convention, dans un délai de trois mois après l'adoption dudit instrument.


 

3. All prior agreements on the participation of the Republic of Latvia in OECD bodies as a non-Member shall be terminated as from the date of the accession of the Republic of Latvia to the Convention. As from that date, the Republic of Latvia will participate in those OECD bodies as a Member of the Organisation.

4. The Republic of Latvia shall provide progress reports to OECD bodies after its accession to the Convention as follows:

• Corporate Governance Committee: A progress report to the Committee and its Working Party in Spring 2017 and thereafter as required;

• Health Committee: A progress report within two years after its accession to the Organisation.

5. The Republic of Latvia shall contribute financial resources to support the evaluation of post-accession progress reports indicated above. An annual summary of Latvia's post-accession progress prepared by the Secretary-General shall be made public.


 

3. Tous les accords précédents sur la participation de la République de Lettonie aux organes de l'OCDE en qualité de non-Membre seront abrogés à la date de l'adhésion de la République de Lettonie à la Convention. À compter de cette date, la République de Lettonie participera aux organes de l'OCDE en qualité de Membre de l'Organisation.

4. Après son adhésion à la Convention, la République de Lettonie communiquera aux organes de l'OCDE les rapports d'avancement suivants :

• Comité sur la gouvernance d'entreprise : un rapport d'avancement au Comité et à son Groupe de travail au printemps 2017 et ultérieurement en tant que de besoin ;

• Comité de la santé : un rapport d'avancement dans un délai de deux ans après son adhésion à l'Organisation.

PARIS 14th December 1960

THE GOVERNMENTS of the Republic of Austria, the Kingdom of Belgium, Canada, the Kingdom of Denmark, the French Republic, the Federal Republic of Germany, the Kingdom of Greece, the Republic of Iceland, Ireland, the Italian Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands, the Kingdom of Norway, the Portuguese Republic, Spain, the Kingdom of Sweden, the Swiss Confederation, the Turkish Republic, the United Kingdom of Great Britain and Northern Ireland, and the United States of America;

CONSIDERING that economic strength and prosperity are essential for the attainment of the purposes of the United Nations, the preservation of individual liberty and the increase of general well-being;

BELIEVING that they can further these aims most effectively by strengthening the tradition of co-operation which has evolved among them;

RECOGNISING that the economic recovery and progress of Europe to which their participation in the Organisation for European Economic Co-operation has made a major contribution, have opened new perspectives for strengthening that tradition and applying it to new tasks and broader objectives;

CONVINCED that broader co-operation will make a vital contribution to peaceful and harmonious relations among the peoples of the world;

RECOGNISING the increasing interdependence of their economies;

DETERMINED by consultation and co-operation to use more effectively their capacities and potentialities so as to promote the highest sustainable growth of their economies and improve the economic and social well-being of their peoples;

BELIEVING that the economically more advanced nations should co-operate in assisting to the best of their ability the countries in process of economic development;

RECOGNISING that the further expansion of world trade is one of the most important factors favouring the economic development of countries and the improvement of international economic relations; and

DETERMINED to pursue these purposes in a manner consistent with their obligations in other international organisations or institutions in which they participate or under agreements to which they are a party;

HAVE THEREFORE AGREED on the following provisions for the reconstitution of the Organisation for European Economic Co-operation as the Organisation for Economic Co-operation and Development:

Article 1

The aims of the Organisation for Economic Co-operation and Development (hereinafter called the "Organisation") shall be to promote policies designed:

(a) to achieve the highest sustainable economic growth and employment and a rising standard of living in Member countries, while maintaining financial stability, and thus to contribute to the development of the world economy;

(b) to contribute to sound economic expansion in Member as well as non-member countries in the process of economic development; and

(c) to contribute to the expansion of world trade on a multilateral, non-discriminatory basis in accordance with international obligations.

Article 2

In the pursuit of these aims, the Members agree that they will, both individually and jointly:

(a) promote the efficient use of their economic resources;

(b) in the scientific and technological field, promote the development of their resources, encourage research and promote vocational training;

(c) pursue policies designed to achieve economic growth and internal and external financial stability and to avoid developments which might endanger their economies or those of other countries;

(d) pursue their efforts to reduce or abolish obstacles to the exchange of goods and services and current payments and maintain and extend the liberalisation of capital movements; and

(e) contribute to the economic development of both Member and non-member countries in the process of economic development by appropriate means and, in particular, by the flow of capital to those countries, having regard to the importance to their economies of receiving technical assistance and of securing expanding export markets.

Article 3

With a view to achieving the aims set out in Article 1 and to fulfilling the undertakings contained in Article 2, the Members agree that they will:

(a) keep each other informed and furnish the Organisation with the information necessary for the accomplishment of its tasks;

(b) consult together on a continuing basis, carry out studies and participate in agreed projects; and

(c) co-operate closely and where appropriate take co-ordinated action.

Article 4

The Contracting Parties to this Convention shall be Members of the Organisation.

Article 5

In order to achieve its aims, the Organisation may:

(a) take decisions which, except as otherwise provided, shall be binding on all the Members;

(b) make recommendations to Members; and

(c) enter into agreements with Members, non-member States and international organisations.

Article 6

1. Unless the Organisation otherwise agrees unanimously for special cases, decisions shall be taken and recommendations shall be made by mutual agreement of all the Members.

2. Each Member shall have one vote. If a Member abstains from voting on a decision or recommendation, such abstention shall not invalidate the decision or recommendation, which shall be applicable to the other Members but not to the abstaining Member.

3. No decision shall be binding on any Member until it has complied with the requirements of its own constitutional procedures. The other Members may agree that such a decision shall apply provisionally to them.

Article 7

A Council composed of all the Members shall be the body from which all acts of the Organisation derive. The Council may meet in sessions of Ministers or of Permanent Representatives.

Article 8

The Council shall designate each year a Chairman, who shall preside at its ministerial sessions, and two Vice-Chairmen. The Chairman may be designated to serve one additional consecutive term.

Article 9

The Council may establish an Executive Committee and such subsidiary bodies as may be required for the achievement of the aims of the Organisation.

Article 10

1. A Secretary-General responsible to the Council shall be appointed by the Council for a term of five years. He shall be assisted by one or more Deputy Secretaries-General or Assistant Secretaries-General appointed by the Council on the recommendation of the Secretary-General.

2. The Secretary-General shall serve as Chairman of the Council meeting at sessions of Permanent Representatives. He shall assist the Council in all appropriate ways and may submit proposals to the Council or to any other body of the Organisation.

Article 11

1. The Secretary-General shall appoint such staff as the Organisation may require in accordance with plans of organisation approved by the Council. Staff regulations shall be subject to approval by the Council.

2. Having regard to the international character of the Organisation, the Secretary-General, the Deputy or Assistant Secretaries-General and the staff shall neither seek nor receive instructions from any of the Members or from any Government or authority external to the Organisation.

Article 12

Upon such terms and conditions as the Council may determine, the Organisation may:

(a) address communications to non-member States or organisations;

(b) establish and maintain relations with non-member States or organisations; and

(c) invite non-member Governments or organisations to participate in activities of the Organisation.

Article 13

Representation in the Organisation of the European Communities established by the Treaties of Paris and Rome of 18th April, 1951, and 25th March, 1957, shall be as defined in Supplementary Protocol No. 1 to this Convention.

Article 14

1. This Convention shall be ratified or accepted by the Signatories in accordance with their respective constitutional requirements.

2. Instruments of ratification or acceptance shall be deposited with the Government of the French Republic, hereby designated as depositary Government.

3. This Convention shall come into force:

a) before 30th September, 1961, upon the deposit of instruments of ratification or acceptance by all the Signatories; or

(b) on 30th September, 1961, if by that date fifteen Signatories or more have deposited such instruments as regards those Signatories; and thereafter as regards any other Signatory upon the deposit of its instrument of ratification or acceptance;

(c) after 30th September, 1961, but not later than two years from the signature of this Convention, upon the deposit of such instruments by fifteen Signatories, as regards those Signatories; and thereafter as regards any other Signatory upon the deposit of its instrument of ratification or acceptance.

4. Any Signatory which has not deposited its instrument of ratification or acceptance when the Convention comes into force may take part in the activities of the Organisation upon conditions to be determined by agreement between the Organisation and such Signatory.

Article 15

When this Convention comes into force the reconstitution of the Organisation for European Economic Co-operation shall take effect, and its aims, organs, powers and name shall thereupon be as provided herein. The legal personality possessed by the Organisation for European Economic Co-operation shall continue in the Organisation, but decisions, recommendations and resolutions of the Organisation for European Economic Co-operation shall require approval of the Council to be effective after the coming into force of this Convention.

Article 16

The Council may decide to invite any Government prepared to assume the obligations of membership to accede to this Convention. Such decisions shall be unanimous, provided that for any particular case the Council may unanimously decide to permit abstention, in which case, notwithstanding the provisions of Article 6, the decision shall be applicable to all the Members. Accession shall take effect upon the deposit of an instrument of accession with the depositary Government.

Article 17

Any Contracting Party may terminate the application of this Convention to itself by giving twelve months' notice to that effect to the depositary Government.

Article 18

The Headquarters of the Organisation shall be in Paris, unless the Council agrees otherwise.

Article 19

The legal capacity of the Organisation and the privileges, exemptions, and immunities of the Organisation, its officials and representatives to it of the Members shall be as provided in Supplementary Protocol No. 2 to this Convention.

Article 20

1. Each year, in accordance with Financial Regulations adopted by the Council, the Secretary-General shall present to the Council for approval an annual budget, accounts, and such subsidiary budgets as the Council shall request.

2. General expenses of the Organisation, as agreed by the Council, shall be apportioned in accordance with a scale to be decided upon by the Council. Other expenditure shall be financed on such basis as the Council may decide.

Article 21

Upon the receipt of any instrument of ratification, acceptance or accession, or of any notice of termination, the depositary Government shall give notice thereof to all the Contracting Parties and to the Secretary-General of the Organisation.

IN WITNESS WHEREOF, the undersigned Plenipotentiaries, duly empowered, have appended their signatures to this Convention.

CONSIDÉRANT que la puissance et la prospérité de l'économie sont essentielles pour atteindre les buts des Nations Unies, sauvegarder les libertés individuelles et accroître le bien-être général ;

ESTIMANT qu'ils peuvent progresser très efficacement dans cette voie en renforçant la tradition de coopération qui s'est développée entre eux ;

RECONNAISSANT que le redressement et le progrès économiques de l'Europe, auxquels leur collaboration au sein de l'Organisation Européenne de Coopération Économique a apporté une contribution très importante, ont ouvert de nouvelles perspectives permettant de renforcer cette tradition et de l'appliquer à des tâches nouvelles et à des objectifs plus larges ;

CONVAINCUS qu'une coopération plus large constituera une contribution essentielle à des relations pacifiques et harmonieuses entre les peuples ;

RECONNAISSANT que leurs économies dépendent de plus en plus les unes des autres ;

DÉTERMINÉS, grâce à des consultations mutuelles et à la coopération, à développer au maximum et à utiliser plus efficacement leurs capacités et leurs possibilités pour réaliser la plus forte expansion possible de leur économie et améliorer le bien-être économique et social de leurs peuples ;

ESTIMANT que les nations plus avancées dans le domaine économique devraient coopérer pour aider au mieux de leurs facultés les pays en voie de développement économique ;

RECONNAISSANT que la poursuite de l'expansion du commerce mondial constitue l'un des facteurs les plus importants propres à favoriser l'essor des économies des divers pays et à améliorer les rapports économiques internationaux ;

DÉTERMINÉS à réaliser ces desseins d'une façon compatible avec les obligations découlant de leur participation à d'autres organisations, institutions ou accords internationaux ;

SONT CONVENUS des dispositions suivantes pour la reconstitution de l'Organisation Européenne de Coopération Économique en Organisation de Coopération et de Développement Économiques :

Article 1

L'Organisation de Coopération et de Développement Économiques (appelée ci-dessous l'"Organisation") a pour objectif de promouvoir des politiques visant :

a) à réaliser la plus forte expansion possible de l'économie et de l'emploi et une progression du niveau de vie dans les pays Membres, tout en maintenant la stabilité financière, et à contribuer ainsi au développement de l'économie mondiale ;

b) à contribuer à une saine expansion économique dans les pays Membres, ainsi que non membres, en voie de développement économique ;

c) à contribuer à l'expansion du commerce mondial sur une base multilatérale et non discriminatoire conformément aux obligations internationales.

Article 2

En vue d'atteindre ces objectifs, les Membres conviennent, tant individuellement que conjointement :

a) d'assurer l'utilisation efficace de leurs ressources économiques ;

b) dans le domaine scientifique et technologique, d'assurer le développement de leurs ressources, d'encourager la recherche et de favoriser la formation professionnelle ;

c) de suivre des politiques conçues pour assurer la croissance économique et la stabilité financière interne et externe, et d'éviter que ne se développent des situations qui pourraient mettre en danger leur économie ou celle d'autres pays;

d) de poursuivre leurs efforts en vue de réduire ou de supprimer les obstacles aux échanges de biens et de services, ainsi qu'aux paiements courants, et de maintenir et étendre la libération des mouvements de capitaux ;

e) de contribuer au développement économique des pays Membres et non membres en voie de développement économique par des moyens appropriés et, en particulier, par l'apport à ces pays de capitaux, en tenant en outre compte de l'importance que présentent pour leur économie la fourniture d'assistance technique et l'élargissement des débouchés offerts à leurs produits d'exportation.

Article 3

En vue d'atteindre les objectifs fixés à l'Article 1 et de remplir les engagements énumérés à l'Article 2, les Membres conviennent :

a) de se tenir mutuellement informés et de fournir à l'Organisation les renseignements nécessaires à l'accomplissement de ses tâches ;

b) de se consulter d'une manière continue, d'effectuer des études et de participer à des projets acceptés d'un commun accord ;

c) de coopérer étroitement, s'il y a lieu par une action coordonnée.

Article 4

Sont Membres de l'Organisation les Parties Contractantes à la présente Convention.

Article 5

En vue d'atteindre ses objectifs, l'Organisation peut :

a) prendre des décisions qui, sauf disposition différente, lient tous les Membres ;

b) faire des recommandations aux Membres ;

c) conclure des accords avec ses Membres, des États non membres et des organisations internationales.

Article 6

1. A moins que l'Organisation n'en décide autrement à l'unanimité pour des cas spéciaux, les décisions sont prises et les recommandations sont faites par accord mutuel de tous les Membres.

2. Chaque Membre dispose d'une voix. Si un Membre s'abstient de voter une décision ou une recommandation, une telle abstention ne fait pas obstacle à cette décision ou recommandation, qui est applicable aux autres Membres mais pas au Membre qui s'abstient.

3. Aucune décision ne peut lier un Membre aussi longtemps qu'il ne s'est pas conformé aux prescriptions de sa procédure constitutionnelle. Les autres Membres peuvent convenir que cette décision s'appliquera provisoirement entre eux.

Article 7

Un Conseil, composé de tous les Membres, est l'organe duquel émanent tous les actes de l'Organisation. Le Conseil peut se réunir en sessions de ministres ou de représentants permanents.

Article 8

Le Conseil désigne, chaque année, un Président qui préside les sessions ministérielles, et deux Vice-Présidents. Le Président peut être désigné pour une année supplémentaire consécutive à son premier mandat.

Article 9

Le Conseil peut créer un Comité Exécutif et tout organe subsidiaire nécessaire pour atteindre les objectifs de l'Organisation.

Article 10

1. Un Secrétaire général responsable devant le Conseil est nommé par celui-ci pour une période de cinq ans. Il est assisté d'un ou plusieurs Secrétaires généraux suppléants ou Secrétaires généraux adjoints nommés par le Conseil, sur la proposition du Secrétaire général.

2. Le Secrétaire général préside le Conseil aux sessions de représentants permanents. Il prête son concours au Conseil sous toute forme nécessaire et peut soumettre des propositions au Conseil ou à tout autre organe de l'Organisation.

Article 11

1. Le Secrétaire général nomme le personnel utile au fonctionnement de l'Organisation conformément aux plans d'organisation approuvés par le Conseil. Le statut du personnel est soumis à l'approbation du Conseil.

2. Étant donné le caractère international de l'Organisation, le Secrétaire général, les Secrétaires généraux suppléants ou adjoints et le personnel ne solliciteront ni recevront de directives d'aucun des Membres de l'Organisation, ni d'aucun Gouvernement ou autorité extérieurs à l'Organisation.

Article 12

Dans les conditions qu'il appartient au Conseil de déterminer, l'Organisation peut :

a) exprimer des voeux à des États non membres et des organisations ;

b) établir et entretenir des relations avec des États non membres et des organisations ;

c) inviter des Gouvernements non membres et des organisations à participer à des activités de l'Organisation.

Article 13

La représentation dans l'Organisation des Communautés Européennes instituées par les Traités de Paris et de Rome en date des 18 avril 1951 et 25 mars 1957 est définie dans un Protocole Additionnel N° 1 à la présente Convention.

Article 14

1. La présente Convention sera ratifiée ou acceptée par les signataires conformément à leurs règles constitutionnelles respectives.

2. Les instruments de ratification ou d'acceptation seront déposés auprès du Gouvernement de la République Française, désigné comme Gouvernement dépositaire.

3. La présente Convention entrera en vigueur :

a) soit avant le 30 septembre 1961, dès que les instruments de ratification ou d'acceptation auront été déposés par tous les signataires ;

b) soit le 30 septembre 1961, si à cette date quinze signataires au moins ont déposé ces instruments, et à l'égard de ces signataires, ainsi qu'à l'égard de tout autre signataire dès le dépôt de son instrument de ratification ou d'acceptation ;

c) soit après le 30 septembre 1961, mais au plus tard deux ans après la signature de la présente Convention, dès que ces instruments auront été déposés par quinze signataires, et à l'égard de ces signataires, ainsi qu'à l'égard de tout autre signataire dès le dépôt de son instrument de ratification ou d'acceptation.

4. Les signataires n'ayant pas déposé leur instrument de ratification ou d'acceptation lors de l'entrée en vigueur de la Convention pourront participer aux activités de l'Organisation dans les conditions qui seront fixées par accord entre l'Organisation et lesdits signataires.

Article 15

La reconstitution de l'Organisation Européenne de Coopération Économique prendra effet lors de l'entrée en vigueur de la Convention, et ses objectifs, organes, pouvoirs et nom seront dès lors ceux qui sont prévus dans la Convention. La personnalité juridique que possède l'Organisation Européenne de Coopération Économique se continuera dans l'Organisation, mais les décisions, recommandations et résolutions de l'Organisation Éuropéenne de Coopération Economique requièrent l'approbation du Conseil pour être applicables après l'entrée en vigueur de la présente Convention.

Article 16

Le Conseil peut décider d'inviter tout Gouvernement prêt à assumer les obligations de membre, à adhérer à la présente Convention. Cette décision doit être prise à l'unanimité; toutefois, le Conseil peut admettre à l'unanimité, dans un cas particulier, la possibilité d'abstention, étant entendu que, nonobstant les dispositions de l'Article 6, la décision s'applique alors à tous les Membres. L'adhésion prend effet lors du dépôt de l'instrument d'adhésion auprès du Gouvernement dépositaire.

Article 17

Toute Partie Contractante pourra mettre fin, en ce qui la concerne, à l'application de la présente Convention, en donnant un préavis d'un an à cet effet au Gouvernement dépositaire.

Article 18

Le siège de l'Organisation est à Paris, sauf si le Conseil en décide autrement.

Article 19

La capacité juridique de l'Organisation et les privilèges, exemptions et immunités de l'Organisation, de ses fonctionnaires et des représentants de ses Membres auprès d'elle, sont définis dans le Protocole Additionnel N° 2 à la présente Convention.

Article 20

1. Chaque année, conformément à un Règlement financier adopté par le Conseil, le Secrétaire général soumet à l'approbation du Conseil un budget annuel, des comptes et tout budget annexe demandé par le Conseil.

2. Les dépenses générales de l'Organisation, approuvées par le Conseil, sont réparties conformément à un barème qui sera arrêté par le Conseil. Les autres dépenses sont financées sur la base fixée par le Conseil.

Article 21

Dès la réception des instruments de ratification, d'acceptation, d'adhésion ou de préavis de retrait, le Gouvernement dépositaire en donnera communication à toutes les Parties Contractantes et au Secrétaire général de l'Organisation.

(c) in the United States, the legal capacity, privileges, exemptions, and immunities under the International Organisations Immunities Act provided for in Executive Order No. 10133 of 27th June, 1950; and

(d) elsewhere, the legal capacity, privileges, exemptions, and immunities provided for in any agreement or arrangement on legal capacity, privileges, exemptions, and immunities entered into between the Government concerned and the Organisation.

Supplementary Protocol No. 1 to the Convention for European Economic Co-operation on the Legal Capacity, Privileges and Immunities of the Organisation

PARIS, 16 April 1948

The Government and Authorities signatories to the Convention for European Economic Cooperation;
CONSIDERING that according to the provisions of Article 22 of the Convention, the Organisation for European Economic Co-operation shall enjoy in the territory of each of its Members such legal capacity as may be necessary for the exercise of its functions and the fulfillment of its purposes, and that the Organisation, its officials, and representatives of the Members of the Organisation shall be entitled to the privileges and immunities set out in a Supplementary Protocol;

HAVE AGREED on the following provisions:

PART I: Personality, Capacity

Article 1

The Organisation shall possess juridical personality. It shall have the capacity to conclude contracts, to acquire and dispose of movable and immovable property and to institute legal proceedings.

PART II: Property, Funds and Assets

Article 2

The Organisation, its property and assets wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except insofar as in any particular case it has expressly waived its immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution.

Article 3

The premises of the Organisation shall be inviolable. The property and assets of the Organisation, wherever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action.

Article 4

The archives of the Organisation, and in general all documents belonging to it or held by it, shall be inviolable wherever located.

Article 5

Without being restricted by financial controls, regulations or moratoria of any kind:

(a) the Organisation may hold currency of any kind and operate accounts in any currency;

(b) the Organisation may freely transfer its funds from one country to another or within any country and convert any currency held by it into any other currency.

Article 6

The Organisation, its assets, income and other property shall be:

(a) exempt from all direct taxes; it is understood, however, that the Organisation will not claim exemption from rates and taxes which are in fact no more than charges for public utility services;

(b) exempt from customs duties and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Organisation for its official use. It is understood however that articles imported under such exemption will not be sold in the country into which they were imported except under conditions agreed with the Government of that country;

(c) exempt from customs duties and prohibitions and restrictions on imports and exports in respect of its publications.

Article 7

While the Organisation will not, as a general rule, claim exemption from excise duties and from taxes on the sale of movable and immovable property which forms part of the price to be paid, nevertheless when the Organisation is making important purchases for official use of property on which such duties and taxes have been charged or are chargeable, Members will, whenever possible, make appropriate administrative arrangements for the remission or return of the amount of duty or tax.

PART III: Facilities in Respect of Communications

Article 8

The Organisation shall enjoy in the territory of each Member, for its official communications, treatment not less favourable than that accorded by the Government of that Member to any other Government including its diplomatic mission in the matter of priorities, rates and taxes on mails, cables, telegrams, radiograms, telephotos, telephone and other communications and press rates for information to the press and radio. No censorship shall be applied to the official correspondence and other official communications of the Organisation.

PART IV: The Representatives of Members

Article 9

Representatives of Members to the principal and subsidiary organs of the Organisation shall, while exercising their functions and during their journey to and from the place of meeting, enjoy the privileges, immunities and facilities normally enjoyed by diplomatic envoys of comparable rank.

Article 10

Privileges, immunities and facilities are accorded to the representatives of Members not for the personal benefit of the individuals concerned, but in order to safeguard the independent exercise of their functions in connection with the Organisation. Consequently, a Member has not only the right but the duty to waive the immunity of its representative in any case where, in the opinion of the Member, the immunity would impede the course of justice, and it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 11

The provisions of Article 9 are not applicable as between a representative and the authorities of the State of which he is a national or of which he is or has been the representative.

Article 12

In this Part IV the expression shall be deemed to include all delegates, alternates, advisers, technical experts and secretaries of delegations.

PART V: Officials

Article 13

The Secretary-General will specify the categories of officials to which the provisions of this Part V shall apply. He shall submit a list of these categories to the Council. Thereafter this list shall be communicated to all Members. The names of the officials included in these categories shall from time to time be made known to Members.

Article 14

Officials of the Organisation shall:

(a) be immune from legal process in respect of things done by them in their official capacity; they shall continue to be so immune after completion of their functions as officials of the Organisation;

(b) enjoy the same exemption from taxation in respect of the salaries and emoluments paid to them as is enjoyed by officials of the principal International Organisations and on the same conditions;

(c) be immune, together with their spouses and dependent relatives, from immigration restrictions and alien registration;

(d) be accorded the same privileges in respect of exchange facilities as are accorded to the officials of comparable rank forming a part of diplomatic missions;

(e) be given, together with their spouses and dependent relatives, the same repatriation facilities in time of international crisis as members of diplomatic missions;

(f) have the right to import free of duty their furniture and effects at the time of first taking up their post in the country in question.

Article 15

In addition to the privileges, immunities, exemptions and facilities specified in Article 14, the Secretary-General shall be accorded in respect of himself, his spouse and children under the age of 21, the privileges, immunities, exemptions and facilities accorded to heads of diplomatic missions in conformity with international law.

The Deputy Secretaries-General shall enjoy the privileges, immunities, exemptions and facilities accorded to diplomatic representatives of comparable rank.

Article 16

Privileges, immunities and facilities are granted to officials in the interests of the Organisation and not for the personal benefit of the individuals concerned. The Secretary-General shall have the right and the duty to waive the immunity of any official in any case where, in his opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the Organisation. In the case of the Secretary-General and the Deputy Secretaries-General the Council shall have the right to waive immunity.

Article 17

The Organisation shall co-operate at all times with the appropriate authorities of Members to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuse in connection with the privileges, immunities, exemptions and facilities mentioned in this Part V.

PART VI: Experts on Missions for the Organisation

Article 18

Experts (other than officials coming within the scope of Part V) performing missions for the Organisation shall be accorded such privileges, immunities and facilities as are necessary for the independent exercise of their functions during the period of their missions, including the time spent on journeys in connection with their missions. In particular they shall be accorded:

(a) immunity from personal arrest or detention and from seizure of their baggage;

(b) in respect of things done by them in the course of the performance of their mission, immunity from legal process of every kind;

(c) inviolability for all papers and documents.

Article 19

Privileges, immunities and facilities are granted to experts in the interests of the Organisation and not for the personal benefit of the individuals concerned. The Secretary-General shall have the right and the duty to waive the immunity of any expert in any case where, in his opinion, the immunity would impede the course of justice and it can be waived without prejudice to the interests of the Organisation.

PART VII: Supplementary Agreements

Article 20

The Organisation may conclude with any Member or Members supplementary agreements adjusting the provisions of the present Protocol so far as that Member or those Members are concerned.

In faith whereof the undersigned Plenipotentiaries, being duly authorised to that effect, have signed the present Protocol.

Protocole additionnel no. 1 à la Convention de Coopération économique européenne sur la capacité juridique, les privilèges et les immunités de l'Organisation

PARIS, le 16 avril 1948

Les Gouvernements et Autorités signataires de la Convention de Coopération Économique Européenne;

CONSIDÉRANT qu'aux termes de l'Article 22 de la Convention, l'Organisation Européenne de Coopération Économique jouit sur le territoire de chacun de ses Membres de la capacité juridique qui lui est nécessaire pour exercer ses fonctions et pour atteindre ses buts et que l'Organisation, ses fonctionnaires ainsi que les représentants de ses Membres bénéficient des privilèges et immunités définis dans un Protocole additionnel;

SONT convenus de ce qui suit :

TITRE I : Personnalité, capacité

Article 1

L'Organisation possède la personnalité juridique. Elle a la capacité de contracter, d'acquérir et aliéner des biens immobiliers et mobiliers et d'ester en justice.

TITRE II : Biens, fonds et avoirs

Article 2

L'Organisation, ses biens et avoirs, quels que soient leur siège et leur détenteur, jouissent de l'immunité de juridiction, sauf dans la mesure où l'Organisation y a expressément renoncé dans un cas particulier. Il est toutefois entendu que la renonciation ne peut s'étendre à des mesures d'exécution.

Article 3

Les locaux de l'Organisation sont inviolables. Ses biens et avoirs, où qu'ils se trouvent et quelque soit leur détenteur, sont exempts de perquisition, réquisition, confiscation, expropriation ou de toute autre forme de contrainte exécutive, administrative, judiciaire ou législative.

Article 4

Les archives de l'Organisation et, d'une manière générale, tous les documents lui appartenant ou détenus par elle, sont inviolables où qu'ils se trouvent.

Article 5

Sans être astreinte à aucun contrôle, réglementation ou moratoire financiers :

(a) l'Organisation peut détenir des devises quelconques et avoir des comptes en n'importe quelle monnaie ;

(b) l'Organisation peut transférer librement ses fonds, d'un pays dans un autre ou à l'intérieur d'un pays quelconque et convertir toutes devises détenues par elle en toute autre monnaie.

Article 6

L'Organisation, ses avoirs, revenus et autres biens sont :

(a) exonérés de tout impôt direct. Toutefois, l'Organisation ne demandera pas l'exonération d'impôts qui ne constituent que la simple rémunération de services d'utilité publique ;

(b) exonérés de tous droits de douane et prohibitions et restrictions d'importation ou d'exportation pour son usage officiel. Il est entendu, toutefois, que les articles ainsi importés en franchise ne seront pas vendus sur le territoire du pays dans lequel ils auront été introduits, à moins que ce ne soit à des conditions agréées par le Gouvernement de ce pays ;

(c) exonérés de tout droit de douane et de toutes prohibitions et restrictions d'importation et d'exportation à l'égard de ses publications.

Article 7

Bien que l'Organisation ne revendique pas, en principe, l'exonération des droits d'accise et des taxes à la vente entrant dans le prix des biens mobiliers ou immobiliers, cependant, quand elle effectue pour son usage officiel des achats importants dont le prix comprend des droits et taxes de cette nature, les Membres prendront, chaque fois qu'il leur sera possible, les dispositions administratives appropriées en vue de la remise ou du remboursement du montant de ces droits et taxes.

TITRE III : Facilités de communications

Article 8

L'Organisation bénéficiera sur le territoire de chaque Membre, pour ses communications officielles, d'un traitement au moins aussi favorable que le traitement accordé par lui à tout autre gouvernement, y compris sa mission diplomatique, en ce qui concerne les priorités, tarifs et taxes sur le courrier, les câblogrammes, télégrammes, radiotélégrammes, téléphotos, communications téléphoniques et autres communications, ainsi que sur les tarifs de presse pour les informations à la presse et à la radio. La correspondance officielle et les autres communications officielles de l'Organisation ne pourront être censurées.

TITRE IV : Représentants des Membres

Article 9

Les représentants des Membres auprès des organes principaux et subsidiaires de l'Organisation jouissent, durant l'exercice de leurs fonctions et au cours des voyages à destination ou en provenance du lieu de la réunion, des privilèges, immunités et facilités dont jouissent les agents diplomatiques de rang comparable.

Article 10

Ces privilèges, immunités et facilités sont accordés aux représentants des Membres, non à leur avantage personnel, mais dans le but d'assurer en toute indépendance l'exercice de leurs fonctions en rapport avec l'Organisation. Par conséquent, un Membre a non seulement le droit, mais le devoir de lever l'immunité de son représentant dans tous les cas où, à son avis, l'immunité empêcherait que justice soit faite et où elle peut être levée sans nuire au but pour lequel l'immunité est accordée.

Article 11

Les dispositions de l'article 9 ne sont pas applicables dans le cas d'un représentant vis-a-vis des autorités de l'État dont il est ressortissant ou dont il est ou a été le représentant.

Article 12

Au sens du présent titre, le terme est considéré comme comprenant tous les délégués, suppléants, conseillers, experts techniques et secrétaires de délégation.

TITRE V : Fonctionnaires

Article 13

Le Secrétaire général déterminera les catégories de fonctionnaires auxquels s'appliquent les dispositions du présent titre. Il en soumettra la liste au Conseil et en donnera ensuite communication à tous les Membres. Les noms des fonctionnaires compris dans ces catégories seront communiqués périodiquement aux Membres.

Article 14

Les fonctionnaires de l'Organisation :

(a) jouiront de l'immunité de juridiction pour les actes accomplis par eux en leur qualité officielle ; ils continueront à bénéficier de cette immunité après la cessation de leurs fonctions ;

(b) jouiront, en ce qui concerne les traitements et émoluments versés par l'Organisation, des mêmes exonérations d'impôts que celles dont bénéficient les fonctionnaires des principales Organisations internationales et dans les mêmes conditions ;

(c) ne seront pas soumis, non plus que leurs conjoints et les membres de leur famille vivant à leur charge, aux dispositions limitant l'immigration et aux formalités d'enregistrement des étrangers ;

(d) jouiront, en ce qui concerne les facilités de change, des mêmes privilèges que les fonctionnaires d'un rang comparable appartenant aux missions diplomatiques auprès du Gouvernement ;

(e) jouiront, ainsi que leurs conjoints et les membres de leur famille vivant à leur charge, des mêmes facilités de rapatriement que les membres des missions diplomatiques en période de crise internationale ;

(f) jouiront du droit d'importer en franchise leur mobilier et leurs effets à l'occasion de leur première prise de fonction dans le pays intéressé.

Article 15

Outre les privilèges, immunités, exemptions et facilités prévus à l'article 14, le Secrétaire général, tant en ce qui le concerne et qu'en ce qui concerne son conjoint et ses enfants mineurs, jouira des privilèges, immunités, exemptions et facilités accordés, conformément au droit international, aux chefs de missions diplomatiques.

Les Secrétaires generaux adjoints jouiront des privilèges, immunités, exemptions et facilités accordés aux représentants diplomatiques de rang comparable.

Article 16

Les privilèges, immunités et facilités sont accordés aux fonctionnaires dans l'intérêt de l'Organisation et non à leur avantage personnel. Le Secrétaire général pourra et devra lever l'immunité accordée à un fonctionnaire dans tous les cas où, à son avis, cette immunité empêcherait que justice soit faite et pourra être levée sans porter préjudice aux intérêts de l'Organisation. A l'égard du Secrétaire général et des Secrétaires généraux adjoints le Conseil a qualité pour prononcer la levée des immunités.

Article 17

L'Organisation collaborera, en tous temps, avec les autorités compétentes des Membres en vue de faciliter la bonne administration de la justice, d'assurer l'observation des règlements de police et d'éviter tout abus auquel pourraient donner lieu les privilèges, immunités, exemptions et facilités énumérés dans le présent titre.

TITRE VI : Experts en mission pour l'Organisation

Article 18

Les experts (autres que les fonctionnaires visés au titre V), lorsqu'ils accomplissent des missions pour l'Organisation, jouissent, pendant la durée de cette mission, y compris le temps du voyage, des privilèges, immunités et facilités nécessaires pour exercer leurs fonctions en toute indépendance, notamment de :

(a) l'immunité d'arrestation personnelle ou de détention et de saisie de leurs bagages ;

(b) l'immunité de juridiction en ce qui concerne les actes accomplis par eux au cours de leurs missions ;

(c) l'inviolabilité de tous papiers et documents.

Article 19

Les privilèges, immunités et facilités sont accordés aux experts dans l'intérêt de l'Organisation, et non à leur avantage personnel. Le Secrétaire général pourra et devra lever l'immunité accordée à un expert, dans tous les cas où, à son avis, cette immunité empêcherait que justice soit faite et où elle pourrait être levée sans porter préjudice aux intérêts de l'Organisation.

TITRE VII : Accords complémentaires

Article 20

L'Organisation pourra conclure avec un ou plusieurs Membres des accords complémentaires, aménageant en ce qui concerne ce Membre ou ces Membres les dispositions du présent protocole.

En foi de quoi les Plénipotentiaires soussignés, dûment autorisés à cet effet, ont signé le présent protocole.

Fait à Paris, le 16 avril 1948, en francais et en anglais, les deux textes faisant également foi, en un seul exemplaire qui restera deposé aux Archives du Gouvernement de la République Française, qui en communiquera copie certifiée conforme à tous les autres signataires.

LATVIJAS REPUBLIKAS VALDĪBAS NOSLĒGUMA PAZIŅOJUMS, LATVIJAS REPUBLIKAI PIEŅEMOT EKONOMISKĀS SADARBĪBAS UN ATTĪSTĪBAS ORGANIZĀCIJAS DALĪBVALSTS SAISTĪBAS

2016. gada 29. aprīlī

LATVIJAS REPUBLIKAS VALDĪBA:

ņemot vērā 1960. gada 14. decembra Konvenciju par Ekonomiskās sadarbības un attīstības organizāciju (turpmāk tekstā - "Konvencija") un Konvencijas 1. un 2. papildprotokolu;

ņemot vērā Konvencijas 16. pantu, kurā paredzēts, ka Padome var pieņemt lēmumu uzaicināt pievienoties Konvencijai jebkuru valdību, kas ir gatava uzņemties dalībvalsts saistības;

ņemot vērā 2013.gada 29.maijā pieņemto Padomes rezolūciju par OECD paplašināšanos (Strengthening the OECD's Global Reach), kurā paziņots par Padomes lēmumu sākt iestāšanās sarunas ar Latvijas Republiku [C(2013)58/FINAL];

ņemot vērā "Ceļa karti" Latvijas dalībai OECD Konvencijā [C(2013)122/FINAL], ko Padome pieņēma 2013.gada 15.oktobrī un kurā norādīti nosacījumi un process sarunām par Latvijas Republikas iestāšanos Ekonomiskās sadarbības un attīstības organizācijā (turpmāk tekstā - "organizācija");

PAZIŅO par turpmāk minēto.

A. VISPĀRĪGS PIEŅEMŠANAS PAZIŅOJUMS

1. Latvijas Republika, deponējot instrumentu, ar ko tā pievienojas Konvencijai, uzņemas visus organizācijas dalībvalsts pienākumus, tostarp pieņemot:

i. organizācijas mērķus, kas noteikti Konvencijas 1.pantā, kā arī OECD Sagatavošanas komitejas 1960. gada decembra ziņojumā;

ii. visas apņemšanās un saistības, kas noteiktas konvencijas 2. un 3. pantā;

iii. Konvencijas 1. un 2. papildprotokolu;

iv. visus organizācijas pieņemtos lēmumus, rezolūcijas, noteikumus, priekšrakstus un secinājumus saistībā ar tās vadību un darbību, tostarp attiecībā uz organizācijas pārvaldību, dalībvalstu iemaksām, citiem finanšu un budžeta jautājumiem, personāla lietām (tostarp Administratīvā tribunāla spriedumus), procesuāliem jautājumiem, attiecībām ar valstīm, kas nav un organizācijas dalībvalstis, informācijas klasificēšanu;

v. organizācijas finanšu pārskatus;

vi. organizācijas darbības metodes;

vii. visus organizācijas juridiskos pamatdokumentus, kas ir spēkā laikā, kad OECD Padome pieņem lēmumu uzaicināt Latvijas Republiku pievienoties konvencijai, ar šī galīgā paziņojuma 1. līdz 4. pielikumā minētajām piezīmēm, kas ir šī paziņojuma neatņemama sastāvdaļa. Par katru tiesību aktu/juridisko instrumentu, kas pieņemts starp dienu, kad OECD Padome nolemj uzaicināt Latvijas Republiku pievienoties Konvencijai un dienu, kad Latvijas Republika deponē savu pievienošanās instrumentu, Latvijas Republika sniedz savu viedokli trīs mēnešu laikā pēc šā tiesību akta pieņemšanas.

B. Līgums par organizācijas privilēģijām un imunitātēm

2. Saskaņā ar 2014.gada 5.maijā parakstītā Latvijas Republikas un Ekonomiskās sadarbības un attīstības organizācijas līguma par organizācijas privilēģijām, imunitātēm un atvieglojumiem 23.pantu (turpmāk - Līgums par organizācijas privilēģijām un imunitātēm) Līgums par organizācijas privilēģijām un imunitātēm stājās spēkā 2014.gada 7.novembrī.

C. PIEDALĪŠANĀS OECD IZVĒLES PASĀKUMOS UN STRUKTŪRVIENĪBĀS

3. Kļuvusi par Organizācijas dalībvalsti, Latvijas Republika vēlas piedalīties izvēles pasākumos un struktūrvienībās, kuri norādīti 5.pielikumā, kas ir šī paziņojuma neatņemama sastāvdaļa. Latvijas Republika atzīst, ka izvēles pasākumiem un struktūrvienībām pastāv noteiktas piedalīšanās vai dalības procedūras un/vai kritēriji, kas tiks piemēroti.

D. IEPRIEKŠĒJO LĪGUMU AR ORGANIZĀCIJU IZBEIGŠANA

4. Latvijas Republika atzīmē, ka no datuma, kad tā ir pievienojusies Konvencijai, ir uzskatāmi par izbeigtiem iepriekšējie līgumi starp Latvijas Republiku un Organizāciju par piedalīšanos zināmās Organizācijas struktūrvienībās kā dalībniekam, kas nav Organizācijas dalībvalsts. No savas pievienošanās datuma Latvijas Republika piedalīsies šajās Organizācijas struktūrvienībās kā Organizācijas dalībvalsts.

E. ZIŅOJUMU SNIEGŠANA OECD KOMITEJĀM PĒC PIEVIENOŠANĀS

5. Latvijas Republika piekrīt sniegt progresa ziņojumus atsevišķām OECD komitejām, kā norādīts OECD Padomes lēmumā uzaicināt Latvijas Republiku pievienoties Konvencijai. Turklāt Latvijas Republika piekrīt ieguldīt resursus, lai atbalstītu to progresa ziņojumu izvērtēšanu, kurus tā iesniegs pēc iestāšanās, kā Padome norādījusi savā lēmumā uzaicināt Latvijas Republiku pievienoties Konvencijai.

6. Latvijas Republika piekrīt, ka tiks publicēts ģenerālsekretāra sagatavots gadskārtējs apkopojums par tās progresu pēc iestāšanās.


1.PIELIKUMS: ĪPAŠAS PIEZĪMES PAR OECD JURIDISKO INSTRUMENTU PIEŅEMŠANU

Latvijas Republika pieņem visus OECD juridiskos instrumentus, kas ir spēkā laikā, kad OECD Padome pieņem lēmumu uzaicināt Latvijas Republiku pievienoties Konvencijai, ar šādām piezīmēm:

Korporatīvā pārvaldība

Padomes rekomendācija par OECD vadlīnijām valstij piederošu uzņēmumu korporatīvai pārvaldībai [C(2015)85]

Latvija apņemas līdz 2016.gada beigām visās lielajās komerciāli orientētajās valsts kapitālsabiedrībās izveidot profesionālas padomes, pamatojoties uz valsts kapitālsabiedrību padomju locekļu caurskatāmu atlases un iecelšanas kārtību.

Nodokļu jautājumi

Padomes rekomendācija attiecībā uz Ienākumu un kapitāla nodokļu paraugkonvenciju C(97)195/FINAL

Latvija pieņem šo rekomendāciju ar šādām atrunām un apsvērumiem attiecībā uz OECD nodokļu paraugkonvenciju:

Atrunas

2.panta 2.daļa: Latvija uzskata, ka "nodokļi par uzņēmumu izmaksāto kopējo atalgojuma apjomu" nav uzskatāmi par ienākuma nodokli un tāpēc patur tiesības neiekļaut šos vārdus 2.daļā.

4.panta 1.daļa: Latvija patur tiesības 1.daļā iekļaut uzņēmuma nodibināšanas vietu vai līdzīgu kritēriju.

5.pants: ņemot vērā īpašās problēmas, piemērojot paraugkonvencijas noteikumus darbībām, ko veic līgumslēdzējas valsts šelfa zonā attiecībā uz jūras gultnes, zemes dzīļu un tur esošo dabas resursu izpēti vai izmantošanu, Latvija patur tiesības noteikumus par šādām darbībām iekļaut atsevišķā pantā.

5.panta 3.daļa: Latvija patur tiesības uzskatīt, ka jebkurai personai, kas sniedz profesionālus pakalpojumus vai veic cita veida neatkarīgu darbību, ir pastāvīga pārstāvniecība, ja šī persona uzturas valstī laikposmu vai laikposmus, kuri kopumā pārsniedz 183 dienas jebkurā divpadsmit mēnešu periodā.

6.panta 2.daļa: Latvija patur tiesības iekļaut termina "nekustamais īpašums" definīcijā jebkuru iespēju vai līdzīgas tiesības iegūt nekustamo īpašumu.

6.panta 3.daļa: Latvija patur tiesības iekļaut 3. daļā atsauci uz ienākumiem no nekustamā īpašuma atsavināšanas. Latvija arī patur tiesības aplikt ar nodokli rezidentu uzņēmumu akcionāru ienākumu no nekustamā īpašuma, kas atrodas viņu valstī un pieder uzņēmumam, tiešas izmantošanas, izīrēšanas vai izmantošanas jebkādā citā veidā, ja uzņēmuma akcijas vai citas korporatīvās tiesības paredz šādas tiesības.

7.pants: Latvija patur tiesības izmantot iepriekšējo 7.panta redakciju, proti, redakciju, kas bija iekļauta nodokļu paraugkonvencijā tieši pirms 2010.gadā veiktajiem atjauninājumiem, šīs iepriekšējās redakcijas 3.daļai pievienojot skaidrojumu, ka izdevumos, ko ļauj atskaitīt līgumslēdzējā valstī, drīkst ietvert tikai tādus izdevumus, kādi būtu atskaitāmi, ja pastāvīgā pārstāvniecība būtu atsevišķs šīs valsts uzņēmums.

8.pants: Latvija patur tiesības izņēmuma gadījumos piemērot pastāvīgās pārstāvniecības normu attiecībā uz peļņu, kas gūta no kuģu izmantošanas starptautiskajā satiksmē.

8.panta 1.daļa: Latvija patur tiesības iekļaut noteikumu, kas nodrošinās, ka uz peļņu, kas gūta no neregulāras kuģu vai gaisakuģu iznomāšanas, iznomājot tos bez apkalpes un apgādes, un no konteineru nomas, attiecas tie paši noteikumi, kas uz 1.daļā minēto peļņu, kad šāda peļņa gūta no starptautiskiem pārvadājumiem.

8.panta 2.daļa: Latvija patur tiesības nepaplašināt šī panta tvērumu, lai divpusējās konvencijās iekļautu iekšzemes ūdensceļu pārvadājumus, un veikt attiecīgas izmaiņas 13., 15. un 22.panta 3.daļā.

10.pants: Latvija patur tiesības neiekļaut prasību, lai 2.daļas piemērošanas režīmu, savstarpēji vienojoties, noteiktu atbildīgās iestādes. Latvija arī saglabā tiesības uz savu viedokli par 2.pantā paredzētajām likmēm.

10.panta 3.daļa: Latvija patur tiesības 3.daļā aizstāt vārdus "ienākumi no citām korporatīvām tiesībām" ar vārdiem "ienākumi no citām tiesībām".

11.panta 2.daļa: Latvija patur tiesības uz savu viedokli par 2.daļā minētajām likmēm. Latvija arī patur tiesības neiekļaut prasību, lai 2.daļas piemērošanas režīmu, savstarpēji vienojoties, noteiktu atbildīgās iestādes.

11.panta 3.daļa: Latvija patur tiesības grozīt procentu definīciju, lai precizētu, ka procentu maksājumi, kas saskaņā ar tās nacionālajiem tiesību aktiem ir uzskatāmi par dividendēm, attiecas uz 10.pantu.

12.panta 1.daļa: Latvija patur tiesības uzlikt nodokli autoratlīdzībām ienākuma gūšanas valstī, ja ienākuma guvējs ir fiziska persona, kas ir otras līgumslēdzējas valsts rezidents.

12.panta 2.daļa: Latvija patur tiesības iekļaut autoratlīdzības definīcijā maksājumus par ražošanas, komerciālo vai zinātnisko iekārtu izmantošanu vai par tiesībām tās izmantot. Latvija, lai novērstu, kā tā uzskata, nepilnības šī panta tvērumā, arī patur tiesības pievienot normu, kur definēta autoratlīdzības rašanās valsts pēc analoģijas ar 11.panta 5.daļu, kas apskata to pašu aspektu attiecībā uz procentiem.

13.pants: Latvija patur tiesības ievietot īpašā pantā noteikumus par kapitāla pieaugumu, kas gūts no darbībām līgumslēdzējas valsts šelfa zonā saistībā ar jūras gultnes, zemes dzīļu un tur esošo dabas resursu izpēti vai izmantošanu.

15.pants: Latvija patur tiesības ievietot īpašā pantā noteikumus par ienākumiem, kas gūti, sniedzot neatkarīgus individuālus pakalpojumus saistībā ar darbībām līgumslēdzējas valsts šelfa zonā, kuras veiktas jūras gultnes, zemes dzīļu un tur esošo dabas resursu izpētei vai izmantošanai.

16.pants: Latvija patur tiesības, pamatojoties uz šo pantu, uzlikt nodokļus jebkādam atalgojumam, ko saņem direktoru padomes vai jebkuras citas līdzīgas institūcijas loceklis rezidējošā uzņēmumā.

20.pants: Latvija patur tiesības šajā pantā minēt jebkuru mācekli vai stažieri.

Apsvērumi

7.pants, komentārs: Latvija interpretēs 7.pantu tādā redakcijā kā pirms 2010.gadā veiktajiem atjauninājumiem saskaņā ar attiecīgo komentāru, kāds tas bija pirms šiem atjauninājumiem.

Saskaņā ar Konvencijas 30.panta pirmās daļas "a" punktu Latvijas Republika patur tiesības nesniegt jebkura veida palīdzību attiecībā uz šādiem Konvencijas 2.panta pirmās daļas "b" punktā (turpmāk - "b" punkts) uzskaitītajiem citas Konvencijas dalībvalsts nodokļiem:

(ii) apakšpunkts:

obligātās sociālās apdrošināšanas maksājumiem, kas maksājami valdībai vai saskaņā ar publiskajām tiesībām izveidotām sociālās apdrošināšanas institūcijām;

(iii) apakšpunkts:

A. īpašuma, dāvinājuma vai mantojuma nodokļiem;

E. nodokļiem par īpašumā esošiem mehāniskajiem transportlīdzekļiem vai par to lietošanu;

F. nodokļiem par lietošanā vai īpašumā esošu kustamu īpašumu, kas nav mehāniskie transportlīdzekļi;

G. jebkuriem citiem nodokļiem;

(iv) apakšpunkts:

2.panta 1.daļas "b" punkta (iii) apakšpunktā minēto kategoriju nodokļiem, ko uzliek citas Konvencijas dalībvalsts politiski administratīvo vienību vai pašvaldību labā.

Saskaņā ar Konvencijas 30.panta pirmās daļas "b" punktu Latvijas Republika patur tiesības nesniegt palīdzību nodokļu prasījumu vai administratīvo sodu piedziņā attiecībā uz visiem nodokļiem, uz kuriem attiecas iepriekš minētā atruna.

Saskaņā ar Konvencijas 30.panta pirmās daļas "c" punktu Latvijas Republika patur tiesības nesniegt palīdzību attiecībā uz jebkuru nodokļu prasījumu, kas uz Konvencijas spēkā stāšanās datumu pastāv attiecībā uz Latvijas Republiku, vai - ja nodokļu prasījumi attiecas uz nodokļiem, attiecībā uz kuriem saskaņā ar Konvencijas 30.panta pirmās daļas "a" vai "b" punktu ir noteikta atruna -, kas pastāv pirms datuma, ar kuru šāda atruna tiek atsaukta.

Saskaņā ar Konvencijas 30.panta pirmās daļas "d" punktu Latvijas Republika patur tiesības nesniegt palīdzību dokumentu izsniegšanā attiecībā uz nodokļiem, attiecībā uz kuriem saskaņā ar Konvencijas 30.panta pirmās daļas "a" punktu ir noteikta atruna.

Saskaņā ar Konvencijas 30.panta pirmās daļas "f" punktu Latvijas Republika patur tiesības piemērot 28.panta septīto daļu, tikai lai sniegtu administratīvo palīdzību attiecībā uz taksācijas periodu, kas sākās 1.janvārī vai pēc 1.janvāra trešajā gadā pirms gada, kurā attiecībā uz Latvijas Republiku stājās spēkā ar 2010.gada 27.maija Protokolu grozītā Konvencija, vai, ja nav taksācijas perioda, attiecībā uz administratīvo palīdzību, kas attiecas uz nodokļu uzlikšanu kalendārā gada 1.janvārī vai pēc 1.janvāra trešajā gadā pirms gada, kurā attiecībā uz Latvijas Republiku stājās spēkā ar 2010.gada 27.maija Protokolu grozītā Konvencija.

Deklarācijas:

Saskaņā ar Konvencijas 4.panta trešo daļu Latvijas Republika paziņo, ka saskaņā ar tās nacionālajiem normatīvajiem aktiem tās iestādes var pirms tam informēt tās rezidentus vai valstspiederīgos par informācijas, kas attiecas uz šīm personām, pārsūtīšanu saskaņā ar 5. un 7.pantu.

Investīcijas un daudznacionāli uzņēmumi

Padomes lēmums, ar kuru pieņemts Kapitāla plūsmu liberalizācijas kodekss [OECD/C(61)96]

Padomes lēmums, ar kuru pieņemts Neredzamo darbību liberalizācijas kodekss [OECD/C(61)95]

Latvijas Republika ierosina atrunas Kapitāla plūsmu liberalizācijas kodeksam un Neredzamo darbību liberalizācijas kodeksam saskaņā ar šo kodeksu 2.panta (b) punktu. Atrunu saraksts ir sniegts šī Noslēguma paziņojuma 2. un 3.pielikumā.

Latvijas Republika vēlas uzņemties šādas saistības attiecībā uz liberalizācijas kodeksiem:

"Saskaņā 1969.gada 23.maija Vīnes konvencijas par starptautisko līgumu tiesībām ar 27.pantu Latvija apņemas ievērot saistības, ko tā pievienošanās līgumā ar OECD uzņemsies attiecībā uz OECD liberalizācijas kodeksiem pat gadījumos, ja Latvijas Republikas tiesību normas ir pretrunā ar šādām saistībām."

Padomes lēmuma par nacionālo režīmu trešā aktualizētā versija [C(91)147/FINAL]

Saskaņā ar Padomes lēmuma par valsts režīmu trešo aktualizēto versiju [C(91)147 ar grozījumiem] Latvijas Republika ierosina zināmus izņēmumus valsts režīmam. Izņēmumu saraksts ir sniegts Noslēguma paziņojuma 4.pielikumā.

Publiskā pārvaldība

Padomes rekomendācijas par publisko iepirkumu [C(2015)2]

Laika posms: Latvija pieņem iepriekš minēto instrumentu ar ieviešanas laiku līdz 2018.gada beigām attiecībā uz e-iepirkuma elementiem.

Tūrisms

Padomes lēmums - rekomendācija par starptautisko tūrisma politiku [C(85)165/FINAL]

Atrunas 1.pielikumam:

Atruna b) sadaļas (i) punktam

40 cigaretes vai 20 cigarillas vai 50 gramu smēķējamās tabakas personām, kas neceļo ar gaisa transportu. Tabakas izstrādājumu imports ir atļauts jebkurā kombinācijā, ja procentu daļa, ko izmanto no individuāli noteiktajiem daudzumiem, kopā nepārsniedz 100 procentus. Alkohola un tabakas izstrādājumu imports ir atļauts ceļotājiem, kas ir sasnieguši 18 gadu vecumu. Kvantitatīvie ierobežojumi nav noteikti smaržu, kafijas un tējas importam, šie izstrādājumi tiek uzskatīti par "pārējām precēm", un uz tiem attiecas monetārie robežlielumi.

Atruna b) sadaļas (iii) punktam

Ceļotāji, kas izmanto sauszemes transportu, var bez muitas nodevām un nodokļiem ievest citas preces, ja to vērtība nepārsniedz 300 EUR (apmēram 266 norēķina vienības), un ceļotāji, kas izmanto gaisa vai jūras transportu - ja preču vērtība nepārsniedz 430 EUR (apmēram 381 norēķina vienības). Bērni, kas jaunāki par 15 gadiem, neatkarīgi no ceļošanas veida bez muitas nodevu un nodokļu nomaksas var ievest citas preces, ja preču vērtība nepārsniedz 285 EUR (apmēram 252 norēķina vienības).

Atruna d) sadaļas (i) punktam

Ārvalstnieks var vadīt transportlīdzekli Latvijā, ja viņam ir klāt:

• Eiropas Savienības dalībvalsts vai Eiropas Brīvās tirdzniecības asociācijas dalībvalsts izsniegta vadītāja apliecība;

• vadītāja apliecība, kurā norādītas 1968.gada Vīnes konvencijā par ceļu satiksmi noteiktās vadītāja apliecību kategorijas;

• vadītāja apliecība, kurā nav norādītas 1968.gada Vīnes konvencijā par ceļu satiksmi noteiktās transportlīdzekļu kategorijas. Ar šādu vadītāja apliecību personai atļauts vadīt tikai B kategorijai atbilstošus transportlīdzekļus, ja izdevējvalstī šī vadītāja apliecība dod tiesības vadīt automobili. Ja vadītāja apliecībā ieraksti nav izdarīti ar latīņu alfabēta burtiem, persona uzrāda notariāli apliecinātu tulkojumu latviešu valodā.

Apsvērums par a) sadaļu

Latvija kā Šengenas līguma dalībvalsts ievēro ES kopīgo vīzu politiku. Vīzu saņemšana un ieceļošana valstī notiek saskaņā ar Padomes Regulu (EK) Nr. 539/2001 (2001. gada 15. marts), ar ko izveido to trešo valstu sarakstu, kuru pilsoņiem, šķērsojot dalībvalstu ārējās robežas, ir jābūt vīzām, kā arī to trešo valstu sarakstu, uz kuru pilsoņiem šī prasība neattiecas, Eiropas Parlamenta un Padomes Regulu (EK) Nr. 810/2009 (2009. gada 13. jūlijs), ar ko izveido Kopienas Vīzu kodeksu (Vīzu kodekss), ES nolīgumiem ar trešajām valstīm par vīzu atvieglotu izsniegšanu, Eiropas Parlamenta un Padomes Regulu (EK) Nr. 562/2006 (2006. gada 15. marts), ar kuru ievieš Kopienas Kodeksu par noteikumiem, kas reglamentē personu pārvietošanos pār robežām (Šengenas Robežu kodekss). Latvija saglabā tiesības izsniegt vienreizējas ieceļošanas vīzas.

ii) Gaisa pārvadājumu pakalpojumiem, kuru sniegšanai var izsniegt licenci tikai aviosabiedrībām, kas ar akciju kontrolpaketes starpniecību pieder ES un EEZ dalībvalstīm un/vai valstspiederīgajiem vai ir to faktiskā kontrolē, ja vien ES parakstītā starptautiskā nolīgumā nav paredzēts citādi.

iii) Privātiem apsardzes un novērošanas pakalpojumiem - kontrolpakete ārvalstu ieguldītājiem, izņemot ES dalībvalsts ieguldītājus.

Atruna par privātiem apsardzes un novērošanas pakalpojumiem nebūs spēkā pēc 2019.gada 31.decembra.

iv) Tiktāl, cik saskaņā ar ES Direktīvu 2009/65/EK pārvedamu vērtspapīru kolektīvo ieguldījumu uzņēmuma (PVKIU) turētājbankai vai nu jāreģistrē sava juridiskā adrese PVKIU piederības dalībvalstī vai jābūt reģistrētai attiecīgajā ES dalībvalstī, ja tā juridiskā adrese ir kādā citā ES dalībvalstī.

Nekustamais īpašums: Zemi var iegūt īpašumā visas fiziskas un juridiskas personas, izņemot zemi Latvijas valsts pierobežas joslā, Baltijas jūras un Rīgas jūras līča krasta kāpu aizsargjoslā, publisko ūdenstilpju un ūdensteču aizsargjoslās, dabas rezervātos un citu aizsargājamo teritoriju dabas rezervātu zonās, lauksaimniecības un meža zemi, zemi valsts nozīmes derīgo izrakteņu atradnēs, ko var iegūt īpašumā tikai:

• Latvijas pilsoņi un citu ES dalībvalstu, EEZ valstu un Šveices pilsoņi;

• valsts un pašvaldības, valsts un pašvaldību kapitālsabiedrības;

• Latvijas Republikā reģistrētas kapitālsabiedrības vai citā ES dalībvalstī vai EEZ valstī, vai Šveicē reģistrētas kapitālsabiedrības, kuras reģistrējušās kā nodokļu maksātājs Latvijas Republikā, un kuras pilnībā vai atsevišķi pieder Latvijas pilsoņiem, citu ES dalībvalstu, EEZ valstu un Šveices pilsoņiem, Latvijas valstij un pašvaldībām, vai kuras pieder fiziskām vai juridiskām personām no valstīm, ar kurām Latvijas Republika līdz 1996. gada 31. decembrim ir parakstījusi un ratificējusi starptautisku līgumu par ieguldījumu veicināšanu un aizsardzību, vai līgumu, kas parakstīts un ratificēts pēc šī datuma, ja tas paredz savstarpējas tiesības iegūt zemi īpašumā.

Juridiskais pamatojums: Likums "Par zemes privatizāciju lauku apvidos" (publicēts "Latvijas Republikas Augstākās Padomes un Valdības Ziņotājs", 32.nr., 20.08.1992., ar grozījumiem, kas stājas spēkā 2014. gada 1. augustā) un likums "Par zemes reformu Latvijas Republikas pilsētās" (publicēts "Latvijas Republikas Augstākās Padomes un Valdības Ziņotājs", 14.nr., 13.12.1991).

Gaisa satiksme: Valstī reģistrētā aviosabiedrībā akciju kontrolpaketei jāpieder ES un EEZ dalībvalstīm un/vai to valstspiederīgajiem un jāatrodas ES un EEZ dalībvalstu un/vai to valstspiederīgo faktiskā kontrolē, ja vien ES parakstītā starptautiskā nolīgumā nav paredzēts citādi.

Juridiskais pamatojums: Likums "Par aviāciju" (publicēts "Latvijas Vēstnesis", Nr.123, 20.10.1994.).

Azartspēles un izlozes: Azartspēļu un izložu organizēšanas licences izsniedz tikai uzņēmumiem, kuros ārvalstu dalībnieku vai akcionāru daļa kapitālsabiedrības pamatkapitālā nepārsniedz 49 procentus. Šī prasība neattiecas uz Eiropas Savienības dalībvalstu, Eiropas Ekonomikas zonas valstu un Ekonomiskās sadarbības un attīstības organizācijas dalībvalstu ieguldītājiem (rezidentiem), kā arī uz gadījumiem, kad ārvalstu ieguldījumiem atšķirīgus noteikumus paredz Saeimas apstiprinātie starptautiskie līgumi.

Juridiskais pamatojums: Azartspēļu un izložu likums (26.09.2013.)

Privāti apsardzes un novērošanas pakalpojumi: Uzņēmumi, kuros ārvalstu ieguldītāji, izņemot ES dalībvalstu un Eiropas Ekonomikas zonas (EEZ) valstu ieguldītājus, ir ieguvuši (tiešā vai netiešā veidā) kontrolpaketi, nav tiesīgi saņemt speciālo atļauju (licenci) sniegt privātus apsardzes un novērošanas pakalpojumus.

ņemot vērā 1960. gada 14. decembra Konvenciju par Ekonomiskās sadarbības un attīstības organizāciju (turpmāk tekstā - "Konvencija") un īpaši tās 5. panta "a" punktu un 16. pantu;

ņemot vērā 2013. gada 29. maijā pieņemto Padomes rezolūciju par OECD paplašināšanos (Strengthening the OECD's Global Reach), kurā paziņots par Padomes lēmumu sākt iestāšanās sarunas ar Latvijas Republiku [C(2013)58/FINAL];

ņemot vērā "Ceļa karti" Latvijas dalībai OECD Konvencijā [C(2013)122/FINAL], ko Padome pieņēma 2013. gada 15. oktobrī un kurā norādīti noteikumi, nosacījumi un process, Latvijas Republikai pievienojoties Ekonomiskās sadarbības un attīstības organizācijai (turpmāk tekstā - "pievienošanās "Ceļa karte"");

ņemot vērā Ģenerālsekretāra ziņojumu par Latvijas pievienošanos Organizācijai [C(2016)77/REV1];

ņemot vērā Latvijas Republikas valdības noslēguma paziņojumu 2016. gada 29. aprīlī par to, ka Latvijas Republika pieņem Ekonomiskās sadarbības un attīstības organizācijas dalībvalsts saistības C(2016)54/REV1;

ņemot vērā pievienošanās "Ceļa kartē" uzskaitīto OECD komiteju oficiālos atzinumus [C(2016)55];

ņemot vērā Ģenerālsekretāra vēstuli par Latvijas nostāju par tiesību aktiem, kas nav vērtēti OECD komitejās [C(2016)56];

ņemot vērā 2014. gada 5. maijā parakstīto Latvijas Republikas un Ekonomiskās sadarbības un attīstības organizācijas līgumu par organizācijas privilēģijām, imunitātēm un atvieglojumiem, kas stājās spēkā 2014. gada 7. novembrī;

uzskatot, ka Latvijas Republikas valdība ir gatava uzņemties organizācijas dalībvalsts saistības;

NOLEMJ:

1. Latvijas Republiku uzaicina pievienoties Konvencijai ar noteikumiem, kas ierosināti Latvijas Republikas valdības noslēguma paziņojumā C(2016)54/REV1, un tiem, kas norādīti turpmāk.

2. Par katru Organizācijas tiesību aktu, kas ir pieņemts starp šī Lēmuma datumu un datumu, kad Latvijas Republika pievienojas Konvencijai, Latvijas Republika sniedz savu viedokli trīs mēnešu laikā pēc šā tiesību akta pieņemšanas.

3. No datumu, kad Latvijas Republika ir pievienojusies Konvencijai, ir uzskatāmi par izbeigtiem iepriekšējie līgumi par Latvijas Republikas piedalīšanos OECD struktūrvienībās kā dalībniecei, kas nav Organizācijas dalībvalsts. No šī datuma Latvijas Republika piedalīsies šajās OECD struktūrvienībās kā Organizācijas dalībvalsts.

4. Pēc pievienošanās Konvencijai Latvijas Republika sniedz šādus progresa ziņojumus OECD struktūrvienībām:

• Korporatīvās pārvaldības komitejai: Progresa ziņojumu komitejai un tās darba grupai 2017. gada pavasarī un turpmāk kā prasīts;

• Veselības komitejai: Progresa ziņojumu divu gadu laikā pēc pievienošanās Organizācijai.

5. Latvijas Republika ieguldīs finanšu resursus, lai atbalstītu minēto pēcpievienošanās progresa ziņojumu izvērtēšanu. Ģenerālsekretāra sagatavotais gadskārtējais Latvijas pēcpievienošanās progresa pārskats ir publiskojams.

Parīzē 1960. gada 14. decembrī

Amerikas Savienoto Valstu, Austrijas Republikas, Beļģijas Karalistes, Dānijas Karalistes, Francijas Republikas, Grieķijas Karalistes, Islandes Republikas, Itālijas Republikas, Īrijas, Kanādas, Lielbritānijas un Ziemeļīrijas Apvienotās Karalistes, Luksemburgas Lielhercogistes, Nīderlandes Karalistes, Norvēģijas Karalistes, Portugāles Republikas, Spānijas, Šveices Konfederācijas, Turcijas Republikas, Vācijas Federatīvās Republikas un Zviedrijas Karalistes VALDĪBAS,

IEVĒROJOT, ka ekonomiskā stiprība un labklājība ir būtiski Apvienoto Nāciju Organizācijas mērķu sasniegšanai, individuālās brīvības saglabāšanai un vispārējās labklājības palielināšanai;

UZSKATOT, ka virzību uz šiem mērķiem var ļoti iedarbīgi veicināt, stiprinot sadarbības tradīcijas, kas starp tām izveidojušās,

ATZĪSTOT, ka Eiropas tautsaimniecības atjaunotne un panākumi, ko ievērojami sekmējusi šo valstu dalība Eiropas Ekonomiskās sadarbības organizācijā, ir pavēruši jaunas iespējas šīs tradīcijas stiprināšanai un tās izmantošanai jauniem uzdevumiem un plašākiem mērķiem;

PĀRLIECINĀTAS, ka plašāka sadarbība sniegs nozīmīgu ieguldījumu miermīlīgu un harmonisku attiecību veidošanā starp pasaules tautām;

ATZĪSTOT, ka aizvien palielinās to saimnieciskā mijatkarība;

APŅĒMĪBĀ apspriežoties un sadarbojoties efektīvāk izmantot savas jaudas un iespējas, lai rosinātu savu tautsaimniecību vislielāko ilgtspējīgo izaugsmi un uzlabotu savu tautu ekonomisko un sociālo labklājību;

UZSKATOT, ka ekonomiski attīstītākajām nācijām ir jāsadarbojas, cik vien tas iespējams, palīdzot valstīm to ekonomiskajā attīstībā;

ATZĪSTOT, ka turpmāka pasaules tirdzniecības attīstība ir viens no vissvarīgākajiem faktoriem, kas rosina valstu ekonomisko attīstību un starptautisko ekonomisko attiecību uzlabošanos; un

APŅĒMĪBĀ virzīties uz šiem mērķiem atbilstoši savām saistībām citās starptautiskās organizācijās vai iestādēs, kuru dalībvalstis tās ir, vai saskaņā ar līgumiem, ko tās ir noslēgušas;

TĀDĒĻ IR VIENOJUŠĀS par šādiem noteikumiem, lai Eiropas Ekonomiskās sadarbības organizāciju pārdibinātu par Ekonomiskās sadarbības un attīstības organizāciju:

1. pants

Ekonomiskās sadarbības un attīstības organizācijas (turpmāk tekstā "Organizācija") mērķi ir veicināt politikas virzienus, kas izstrādāti, lai:

(a) sasniegtu visaugstāko ilgtspējīgo ekonomisko izaugsmi un nodarbinātību un celtu dzīves līmeni dalībvalstīs, vienlaikus saglabājot finanšu stabilitāti un tā sniedzot ieguldījumu pasaules ekonomikā;

(b) sekmētu dalībvalstu un trešo valstu tautsaimniecību līdzsvarotu augšupeju ekonomiskās attīstības procesā; un

(c) sekmētu pasaules tirdzniecības paplašināšanos atbilstoši daudzpusējas sadarbības un nediskriminēšanas pieejai un saskaņā ar starptautiskām saistībām.

2. pants

Tiecoties uz šiem mērķiem, dalībvalstis vienojas, ka tās gan atsevišķi, gan kopīgi:

(a) veicinās savu ekonomisko resursu efektīvu izmantošanu;

(b) veicinās savu resursu attīstību zinātnes un tehnoloģijas jomā, rosinās pētniecību un sekmēs profesionālo apmācību;

(c) realizēs politiku, kas izstrādāta, lai sasniegtu ekonomisko izaugsmi un iekšējo un ārējo finansiālo stabilitāti un izvairītos no procesiem, kas varētu apdraudēt šo vai citu valstu tautsaimniecību;

(d) ieguldīs pūles, lai samazinātu vai novērstu šķēršļus preču un pakalpojumu, un kārtējo maksājumu apmaiņai un uzturētu un paplašinātu kapitāla aprites liberalizāciju;

(e) sniegt ieguldījumu gan dalībvalstu, gan trešo valstu ekonomiskās attīstības procesā ar atbilstīgiem līdzekļiem, jo īpaši ar kapitāla plūsmu uz šīm valstīm, ņemot vērā, cik svarīgi to tautsaimniecībai ir saņemt tehnisko palīdzību un nodrošināt eksporta tirgu paplašināšanos.

3. pants

Lai sasniegtu 1. pantā norādītos mērķus un veiktu 2. pantā uzskaitītos uzdevumus, dalībvalstis vienojas, ka tās:

(a) informēs cita citu un sniegs Organizācijai informāciju, kas tai nepieciešama savu uzdevumu veikšanai;

(b) nepārtraukti savstarpēji konsultēsies, veiks pētījumus un piedalīsies projektos, par kuriem vienojušās; un

(c) cieši sadarbosies un atbilstīgos gadījumos veiks saskaņotu rīcību.

4. pants

Šīs Konvencijas līgumslēdzējas puses ir Organizācijas dalībvalstis.

5. pants

Lai sasniegtu savus mērķus, Organizācija var:

(a) pieņemt lēmumus, kas, ja vien nav paredzēts citādi, ir saistoši visām dalībvalstīm;

(b) sniegt rekomendācijas dalībvalstīm; un

(c) slēgt vienošanās ar dalībvalstīm, trešām valstīm un starptautiskām organizācijām.

6. pants

1. Ja vien īpašos gadījumos Organizācija vienprātīgi nelemj citādi, lēmumus pieņem un rekomendācijas sniedz, visām dalībvalstīm savstarpēji vienojoties.

2. Katrai dalībvalstij ir viena balss. Ja dalībvalsts atturas no balsošanas, šāda atturēšanās nepadara lēmumu vai rekomendāciju par spēkā neesošu, un tie attiecas uz citām dalībvalstīm, bet ne uz atturējušos dalībvalsti.

3. Neviens lēmums nav saistošs nevienai dalībvalstij, līdz tā nav izpildījusi savu konstitucionālo procedūru prasības. Pārējās dalībvalstis var vienoties, ka šāds lēmums tām ir piemērojams pagaidu kārtībā.

7. pants

Padome, kurā pārstāvētas visas dalībvalstis, ir institūcija, kas pieņem visus Organizācijas normatīvos aktus. Padome var sasaukt sēdes ministru vai pastāvīgo pārstāvju līmenī.

8. pants

Katru gadu Padome ieceļ priekšsēdētāju, kas vada Padomes sēdes ministru līmenī, un divus priekšsēdētāja vietniekus. Priekšsēdētāju var iecelt veikt amata pienākumus uz vēl vienu papildus pilnvaru termiņu.

9. pants

Padome var izveidot Izpildkomiteju vai savā pakļautībā esošas institūcijas, ja tādas varētu būt nepieciešamas Organizācijas mērķu sasniegšanai.

10. pants

1. Ģenerālsekretāru, kas atbild Padomes priekšā, uz pieciem gadiem ieceļ Padome. Viņam palīdz viens vai vairāki ģenerālsekretāra vietnieki vai ģenerālsekretāra palīgi, ko pēc ģenerālsekretāra ieteikuma ieceļ Padome.

2. Ģenerālsekretārs pilda Padomes priekšsēdētāja pienākumus pastāvīgo pārstāvju sēdēs. Viņš sniedz palīdzību Padomei visos atbilstošos veidos un var iesniegt ierosinājumus Padomei vai jebkurai citai Organizācijas struktūrvienībai.

11. pants

1. Ģenerālsekretārs ieceļ Organizācijai vajadzīgos darbiniekus saskaņā ar Padomes apstiprinātiem organizatoriskiem plāniem. Personāla nolikumu apstiprina Padomē.

2. Ievērojot Organizācijas starptautisko raksturu, ģenerālsekretārs, ģenerālsekretāra vietnieki vai palīgi un darbinieki nelūdz un nesaņem norādījumus ne no vienas dalībvalsts un ne no vienas valdības vai iestādes ārpus Organizācijas.

12. pants

Saskaņā ar Padomes noteikto kārtību Organizācija var:

(a) vērsties ar paziņojumiem pie trešām valstīm vai organizācijām;

(b) nodibināt un uzturēt attiecības ar trešām valstīm vai organizācijām; un

(c) aicināt trešo valstu valdības vai organizācijas piedalīties Organizācijas darbībā;

13. pants

Eiropas Kopienu, kas nodibinātas ar 1951. gada 18. aprīļa Parīzes līgumu un 1957. gada 25. marta Romas līgumu, pārstāvība Organizācijā ir noteikta šīs Konvencijas papildprotokolā Nr. 1.

14. pants

1. Parakstītājvalstis ratificē vai apstiprina šo Konvenciju saskaņā ar savām konstitūcijām.

2. Ratificēšanas vai pieņemšanas instrumentus nodod glabāšanā Francijas Republikas valdībai, kas ar šo pantu ir iecelta par Konvencijas depozitāriju.

3. Šī Konvencija stājas spēkā:

a) līdz 1961. gada 30. septembrim, kad visas parakstītājvalstis ir deponējušas ratificēšanas vai pieņemšanas instrumentus; vai

(b) 1961. gada 30. septembrī, ja līdz šim datumam piecpadsmit vai vairāk parakstītāju valstu deponējušas šādus instrumentus attiecībā uz šīm parakstītājvalstīm, un pēc tam attiecībā uz jebkuru citu parakstītājvalsti, tai deponējot savu ratificēšanas vai pieņemšanas instrumentu.

(c) pēc 1961. gada 30. septembra, bet ne vēlāk kā divus gadus pēc šīs Konvencijas parakstīšanas, kad piecpadsmit vai vairāk parakstītājvalstu deponējušas šādus instrumentus attiecībā uz šīm parakstītājvalstīm, un pēc tam attiecībā uz jebkuru citu parakstītājvalsti, tai deponējot savu ratificēšanas vai pieņemšanas instrumentu.

4. Jebkura parakstītājvalsts, kas nav deponējusi savu ratificēšanas vai pieņemšanas instrumentu, kad Konvencija stājas spēkā, var piedalīties Organizācijas darbībā ar nosacījumiem, ko paredz Organizācijas un šādas parakstītājvalsts vienošanās.

15. pants

Ar šīs Konvencijas stāšanos spēkā notiek Eiropas Ekonomiskās sadarbības organizācijas pārdibināšana, un pēc tam tās mērķi, pilnvaras, iestādes un nosaukums būs tādi, kā noteikts šajā Konvencijā. Organizācija turpina Eiropas Ekonomiskās sadarbības organizācijas juridisko personību, bet Eiropas Ekonomiskās sadarbības organizācijas lēmumiem, rekomendācijām un rezolūcijām, lai tie būtu spēkā pēc šīs Konvencijas stāšanās spēkā, ir nepieciešams Padomes apstiprinājums.

16. pants

Padome var nolemt uzaicināt jebkuru valdību, kas ir gatava uzņemties dalībvalsts pienākumus, pievienoties šai Konvencijai. Šādiem lēmumiem jābūt vienprātīgiem ar noteikumu, ka katrā atsevišķā gadījumā Padome var vienprātīgi nolemt, ka pieļaujama atturēšanās, un tad, neraugoties uz 6. panta noteikumiem, lēmums attiecas uz visām dalībvalstīm. Pievienošanās stājas spēkā pēc tam, kad depozitāram iesniegts pievienošanās instruments.

17. pants

Jebkura Līgumslēdzēja Puse var pārtraukt Konvencijas piemērošanu attiecībā uz sevi, divpadsmit mēnešus iepriekš par to paziņojot depozitārijam.

18. pants

Organizācijas galvenā mītne ir Parīzē, ja vien Padome nevienojas citādi.

19. pants

Organizācijas tiesībspēja un rīcībspēja, un Organizācijas, tās amatpersonu un dalībvalstu pārstāvju privilēģijas, atvieglojumi un imunitātes ir tādas, kā noteikts šīs Konvencijas papildprotokolā Nr. 2.

20. pants

1. Katru gadu saskaņā ar Padomes pieņemtajiem finanšu noteikumiem ģenerālsekretārs iesniedz Padomei apstiprināšanai gada budžetu, pārskatus un tādus papildu budžetus, ko pieprasa Padome.

2. Pēc Padomes vienošanās Organizācijas vispārējās izmaksas samērīgi sadala pēc skalas, par ko ir nolēmusi Padome. Citus izdevumus finansē tā, kā nolemj Padome.

21. pants

Saņemot jebkuru ratifikācijas, pieņemšanas vai pievienošanās instrumentu vai jebkuru paziņojumu par pārtraukšanu, depozitārijs par to paziņo visām līgumslēdzējām pusēm un Organizācijas ģenerālsekretāram.

TO APLIECINOT, šim mērķim attiecīgi pilnvarotas personas ir parakstījušas šo Konvenciju.

SAGATAVOTS Parīzē tūkstoš deviņi simti sešdesmitā gada četrpadsmitajā decembrī angļu un franču valodā, abiem tekstiem esot vienlīdz autentiskiem, vienā eksemplārā, ko deponē depozitāram, kurš izsniegs apliecinātas kopijas visām parakstītājvalstīm.


Konvencijas par OECD Papildprotokols Nr. 1

1960. gada 14. decembris

Ekonomiskās sadarbības un attīstības organizācijas konvencijas PARAKSTĪTĀJVALSTIS

IR VIENOJUŠĀS par turpinājumā norādīto:

1. Eiropas Kopienu, kuras dibinātas ar 1951. gada 18. aprīļa Parīzes līgumu un 1957. gada 25. marta Romas līgumu, pārstāvību Ekonomiskās sadarbības un attīstības organizācijā nosaka saskaņā ar šo līgumu institucionālajām normām.

2. Šīs organizācijas darbībā piedalās Eiropas Ekonomikas kopienas komisija un Eiropas Atomenerģijas kopienas komisija, kā arī Eiropas Ogļu un tērauda kopienas augstākā iestāde.

TO APLIECINOT, attiecīgi pilnvarotās personas ir parakstījušas šo Protokolu.

SAGATAVOTS Parīzē tūkstoš deviņi simti sešdesmitā gada četrpadsmitajā decembrī angļu un franču valodā, abiem tekstiem esot vienlīdz autentiskiem, vienā eksemplārā, kuru uzglabās Francijas Republikas valdība, kas izsniegs visām parakstītājvalstīm apliecinātas kopijas.


Konvencijas par OECD Papildprotokols Nr. 2

Parīzē 1960. gada 14. decembrī

Ekonomiskās sadarbības un attīstības organizācijas (turpmāk tekstā "Organizācija") konvencijas PARAKSTĪTĀJVALSTIS;

IR VIENOJUŠĀS par turpinājumā norādīto:

Organizācijai tiek noteikta tiesībspēja, un Organizācijai, tās amatpersonām un dalībvalstu pārstāvjiem ir tiesības uz privilēģijām, atvieglojumiem un imunitātēm saskaņā ar turpinājumā norādīto:

(a) 1948. gada 16. aprīļa Eiropas Ekonomiskās sadarbības Konvencijas dalībvalstu teritorijā - tiesībspēja, privilēģijas, atvieglojumi un imunitātes saskaņā ar šīs Konvencijas Papildprotokolu Nr. 1;

(b) Kanādā - tiesībspēja, privilēģijas, atvieglojumi un imunitātes, kas norādītas jebkurā līgumā vai līgumā par tiesībspēju, privilēģijām, atvieglojumiem un imunitātēm, kurš noslēgts starp Kanādas valdību un Organizāciju;

(c) Amerikas Savienotajās Valstīs - tiesībspēja, privilēģijas, atvieglojumi un imunitātes saskaņā ar Starptautisko organizāciju imunitāšu likumu, kas noteikts 1950. gada 27. jūnija izpildu rīkojumā Nr. 10133;

(d) jebkurā citā vietā - tiesībspēja, privilēģijas, atvieglojumi un imunitātes, kas norādītas jebkurā līgumā vai līgumā par tiesībspēju, privilēģijām, atvieglojumiem un imunitātēm, kurš noslēgts starp attiecīgo valdību un Organizāciju.

TO APLIECINOT, attiecīgi pilnvarotās personas ir parakstījušas šo Protokolu.

SAGATAVOTS Parīzē tūkstoš deviņi simti sešdesmitā gada četrpadsmitajā decembrī angļu un franču valodā, abiem tekstiem esot vienlīdz autentiskiem, vienā eksemplārā, kuru uzglabās Francijas Republikas valdība, kas izsniegs visām parakstītājvalstīm apliecinātas kopijas.

Eiropas Ekonomiskās sadarbības konvencijas Papildprotokols Nr. 1 par Organizācijas tiesībspēju, privilēģijām un imunitātēm

PARĪZĒ 1948. gada 16. aprīlī

Valdība un Eiropas Ekonomiskās sadarbības konvencijas parakstītājas iestādes,

ŅEMOT VĒRĀ, ka saskaņā ar Konvencijas 22. panta noteikumiem Eiropas Ekonomiskās sadarbības organizācijai visu tās dalībvalstu teritorijā ir tāda tiesībspēja, kāda nepieciešama tās funkciju veikšanai un mērķu sasniegšanai, un Organizācijai, tās amatpersonām un Organizācijas dalībvalstu pārstāvjiem ir tiesības uz papildprotokolā norādītajām privilēģijām un imunitātēm,

IR VIENOJUŠĀS par turpmāk norādītajiem noteikumiem:

I DAĻA: Personas statuss, tiesības

1. pants

Organizācijai ir juridiskas personas statuss. Tā var slēgt līgumus, iegādāties kustamo un nekustamo īpašumu un rīkoties ar to, un vērsties ar prasību tiesā.

II DAĻA: Īpašums, līdzekļi un aktīvi

2. pants

Organizācijai, tās īpašumam un aktīviem neatkarīgi no tā, kur tie atrodas un kā rīcībā tie atrodas, ir imunitāte pret jebkāda veida tiesvedību, ja vien kādā konkrētā gadījumā Organizācija nav nepārprotami atteikusies no savas imunitātes. Tomēr ar šo saprot, ka atteikšanās no imunitātes neattiecas uz jebkāda veida nolēmumu izpildi.

3. pants

Organizācijas telpas ir neaizskaramas. Organizācijas īpašumam un aktīviem neatkarīgi no tā, kur tie atrodas un kā rīcībā tie atrodas, ir imunitāte pret kratīšanu, rekvizīciju, konfiskāciju, atsavināšanu vai jebkādu citu iejaukšanās veidu neatkarīgi no tā, vai tā ir izpildvaras, tiesu varas vai likumdevējvaras iestāžu rīcība, tai skaitā administratīvā procesa ietvaros.

4. pants

Organizācijas arhīvi un kopumā visi tai piederošie vai tās rīcībā esošie dokumenti neatkarīgi no to atrašanās vietas ir neaizskarami.

5. pants

Bez jebkādiem finanšu kontroles, regulējumu vai moratoriju ierobežojumiem:

(a) Organizācija var turēt jebkāda veida valūtu un rīkoties ar kontiem jebkurā valūtā;

(b) Organizācija var brīvi pārskaitīt savus līdzekļus no vienas valsts uz otru un jebkuras valsts ietvaros, kā arī konvertēt jebkuru savā rīcībā esošu valūtu citā valūtā.

6. pants

Organizācija, tās aktīvi, ienākumi un citi īpašumi ir atbrīvoti no:

(a) visiem tiešajiem nodokļiem; tomēr ar to tiek saprasts, ka Organizācija neprasa atbrīvojumu no maksas vai nodokļiem, kas veido vienīgi maksu par komunālajiem pakalpojumiem;

(b) visām muitas nodevām un importa un eksporta aizliegumiem un ierobežojumiem attiecībā uz precēm, kuras Organizācija ieved vai izved savām oficiālajām vajadzībām. Taču ar to tiek saprasts, ka ar šādu atbrīvojumu ievestās preces netiek pārdotas valstī, kurā tās ir ievestas, izņemot gadījumos, par kuriem panākta vienošanās ar attiecīgās valsts valdību;

(c) visām muitas nodevām, importa un eksporta aizliegumiem un ierobežojumiem attiecībā uz Organizācijas publikācijām.

7. pants

Organizācija parasti neprasīs atbrīvojumu no akcīzes nodokļa un nodevas par kustamā un nekustamā īpašuma pārdošanu, kas veido daļu no maksājamās summas, taču, kad Organizācija veic svarīgus īpašuma pirkumus savām oficiālajām vajadzībām, uz kuriem attiecināti vai var tikt attiecināti šādi nodokļi vai nodevas, dalībvalstis, ja iespējams, veiks attiecīgas administratīvās darbības, lai panāktu šāda nodokļa vai nodevas atlaišanu vai atmaksāšanu.

III DAĻA: Atvieglojumi saistībā ar komunikāciju

8. pants

Organizācija katras dalībvalsts teritorijā bauda ne mazāk labvēlīgus nosacījumus oficiālajai saziņai, kādus katras dalībvalsts valdība nodrošina jebkurai citai valdībai, tai skaitā diplomātiskajām pārstāvniecībām, attiecībā uz prioritāti, maksu un nodokļiem par pasta sūtījumiem, kablogrammām, telegrammām, radiogrammām, telefoto, telefona sakariem vai jebkuru citu saziņu, kā arī attiecībā uz tarifiem, kas noteikti informācijas nodošanai presē un radio. Organizācijas oficiālā sarakste un jebkura cita oficiālā saziņa netiek pakļauta cenzūrai.

IV DAĻA: Dalībvalstu pārstāvji

9. pants

Dalībvalstu pārstāvjiem Organizācijas galvenajās un pakārtotajās iestādēs, pildot savus pienākumus un braucot uz sanāksmes vietu un no tās, tiek piešķirtas privilēģijas, imunitātes un atvieglojumi, kādus parasti bauda līdzvērtīga ranga diplomātiskie sūtņi.

10. pants

Dalībvalstu pārstāvjiem privilēģijas, imunitātes un atvieglojumi tiek piešķirti nevis viņu personīgā labuma gūšanai, bet gan ar mērķi nodrošināt neatkarīgu to funkciju izpildi, kas saistītas ar viņu darbu Organizācijā. Tādējādi dalībvalstīm ir ne vien tiesības, bet arī pienākums atcelt sava pārstāvja imunitātes statusu visos gadījumos, kad dalībvalsts uzskata, ka imunitātes statuss varētu traucēt tiesvedību, un kad to var atcelt, nekaitējot mērķim, kura dēļ tas ticis piešķirts.

11. pants

9. panta normas nav attiecināmas attiecībās starp pārstāvi un tās valsts varas iestādēm, kuras pilsonis ir šis pārstāvis vai kuras pārstāvis viņš vai viņa ir šobrīd vai ir bijis vai bijusi iepriekš.

12. pants

IV daļā jēdziens iekļauj visus delegāciju delegātus, vietniekus, padomniekus, tehniskos ekspertus un sekretārus.

V DAĻA: Amatpersonas

13. pants

Ģenerālsekretārs nosaka to amatpersonu kategorijas, uz kurām attiecas V daļas noteikumi. Viņš iesniedz sarakstu ar šīm kategorijām Padomei. Pēc tam šis saraksts tiek izplatīts visām dalībvalstīm. Šajās kategorijās iekļauto amatpersonu vārdi periodiski tiek darīti zināmi dalībvalstīm.

14. pants

Organizācijas amatpersonām:

(a) ir imunitāte pret tiesvedību saistībā ar darbībām, ko tās ir veikušas, pildot amata pienākumus; šī imunitāte saglabājas arī tad, kad amatpersonas beigušas pildīt amata pienākumus Organizācijā;

(b) ir tāds pats atbrīvojums no nodokļiem par saņemto algu un ienākumiem, kāds pienākas galveno starptautisko organizāciju amatpersonām, kā arī saskaņā ar tādiem pašiem noteikumiem;

(c) ir imunitāte, līdz ar viņu ar laulātajiem partneriem un apgādājamiem tuviniekiem, pret imigrācijas ierobežojumiem un ārvalstnieku reģistrāciju;

(d) ir piešķirtas tādas pašas atvieglojumu maiņas privilēģijas, kādas pienākas līdzvērtīga ranga diplomātisko misiju amatpersonām;

(e) tiek piešķirti, līdz ar viņu laulātajiem partneriem un apgādājamiem ģimenes locekļiem, tādi paši repatriācijas atvieglojumi, kādi starptautiskas krīzes gadījumā tiek piešķirti diplomātisko pārstāvniecību dalībniekiem;

(f) ir tiesības ievest mēbeles un personiskās mantas bez nodokļiem, kad viņi pirmo reizi uzsāk pildīt amata pienākumus attiecīgajā valstī.

15. pants

Papildu privilēģijām, imunitātēm, atbrīvojumiem un atvieglojumiem, kas noteikti 14. pantā, ģenerālsekretāram, viņa laulātajam un bērniem līdz 21 gada vecumam tiek piešķirtas privilēģijas, imunitātes, atbrīvojumi un atvieglojumi, kas pienākas diplomātisko pārstāvniecību vadītājiem saskaņā ar starptautiskajiem likumiem.

Ģenerālsekretāra vietniekiem piešķirtas tādas pašas privilēģijas, imunitātes, atbrīvojumi un atvieglojumi kā līdzvērtīga ranga diplomātiskajiem pārstāvjiem.

16. pants

Amatpersonām privilēģijas, imunitātes un atvieglojumi tiek piešķirti nevis viņu personīgā labuma gūšanai, bet gan Organizācijas interešu nodrošināšanai. Ģenerālsekretāram ir tiesības un pienākums atcelt imunitāti jebkurai amatpersonai jebkurā gadījumā, kad, pēc viņa domām, imunitātes statuss varētu traucēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interešu nodrošināšanai. Ģenerālsekretāra un ģenerālsekretāra vietnieku imunitāti var atcelt Padome.

17. pants

Organizācija vienmēr sadarbojas ar attiecīgajām dalībvalstu iestādēm, lai veicinātu pienācīgu tiesvedību, nodrošinātu policijas noteikumu ievērošanu, un novērstu visus privilēģiju, imunitāšu un atvieglojumu ļaunprātīgas izmantošanas gadījumus, kas minēti šī protokola V daļā.

VI DAĻA: Eksperti Organizācijas uzdevumu pildīšanai

18. pants

Ekspertiem (personām, kuras nav V daļā norādītās amatpersonas), kuri pilda Organizācijas uzdevumus, tiek piešķirtas tādas privilēģijas, imunitātes un atvieglojumi, kādi nepieciešami neatkarīgai funkciju izpildei uzdevumu veikšanas laikā, ieskaitot laiku, kas pavadīts ceļā saistībā ar viņu uzdevumiem. Īpaši viņiem tiek piešķirta:

(a) imunitāte pret personīgo arestu vai aizturēšanu un personiskās bagāžas arestu;

(b) visa veida tiesas procesu imunitāte attiecībā uz visām darbībām, ko viņi veikuši uzdevuma pildīšanas laikā;

(c) visu materiālu un dokumentu neaizskaramība.

19. pants

Ekspertiem privilēģijas, imunitātes un atvieglojumi tiek piešķirti nevis viņu personīgā labuma gūšanai, bet gan Organizācijas interešu nodrošināšanai. Ģenerālsekretāram ir tiesības un pienākums atcelt imunitāti jebkuram ekspertam jebkurā gadījumā, kad, pēc viņa domām, imunitātes statuss varētu traucēt tiesvedību un to var atcelt, nekaitējot Organizācijas interesēm.

VII DAĻA: Papildlīgumi

20. pants

Organizācija var noslēgt ar jebkuru dalībvalsti vai dalībvalstīm papildu vienošanās, grozot šī Protokola noteikumus, ciktāl tas attiecas uz attiecīgo dalībvalsti vai attiecīgajām dalībvalstīm.

To apliecinot, šim mērķim pienācīgi pilnvarotās personas ir parakstījušas šo Protokolu.

Sagatavots Parīzē tūkstoš deviņi simti četrdesmit astotā gada sešpadsmitajā aprīlī angļu un franču valodā, abiem tekstiem esot vienlīdz autentiskiem, vienā eksemplārā, kurš paliks glabāšanā Francijas Republikas valdības arhīvā, kas izsniegs visām parakstītājvalstīm apliecinātas kopijas.
